DECLARATION
of 5 September 2017
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended by Decree No. 287 / 2013 Coll.
The Ministry of Health provides, pursuant to § 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), for the implementation of § 11 (4) of the Health Services Act:
Decree No. 99 / 2012 Coll., on minimum staff security requirements for health services, as amended by Decree No. 287 / 2013 Coll., is amended as follows:
1. In Article 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (i) is added:
"(i) the alcohol and toxic containment services are set out in Annex 9 to this Decree."
2. In Annex 3, Part II, point 3.4, the words "health professionals referred to in points 11 (b) and (c) of Part I, as well as psychiatrists, gerontopsychiatrists, doctors with specific competence in addictive diseases or sexologists' are deleted and the following points (a) and (b) are added after the words" secured ':
"(a) by a doctor,
1. a psychiatrist, a gerontopsychiatrist, a doctor with a special professional or special specialised competence in addictive diseases or a sexologist; or
2. a physician qualified with a certificate (14) if the physical presence of the doctor referred to in point 1 is ensured within 30 minutes of the request; and
(b) health professionals eligible for the non-medical profession referred to in point 11 (c) of Part I of this Annex '.
3. the following Annex 9 is inserted after Annex 8:
"Annex No. 9 to Decree No. 99 / 2012 Coll.
Personnel security requirements for alcohol and toxic containment services
Requirements for personnel security of alcohol and toxic containment services:
(a) a physician with specialised competence in fields with a common baseline strain of anesthesiological, dermatoenerologic, gynaecological, gynaecological, hygienic-epidemiological, surgical, internal, cardiothoracic, maxillofacialsurgical, neurosurgery, neurologic, ophthalmological, orthopaedic, otorinolaryngological, pathological, paediatric, psychiatric, radiological, urological or general practical - availability; availability for the purposes of this Annex means the physical presence of a doctor at the reception and release of a patient, the availability of advice and the assistance of a doctor by telephone or electronically, or, if requested, the physical presence of a doctor at the workplace within 20 minutes of the request,
(b) a general nurse qualified to pursue an occupation without professional supervision or a health care professional qualified to pursue an occupation without professional supervision; and
(c) an orderly or a nurse.
The provider of an alcohol and antitoxicomanical detention service shall ensure the personnel security of the alcohol and antitoxic detention services by medical professionals of individual experts in the number corresponding to the local conditions for the provision of that medical service and the requirements for its provision at the appropriate professional level. ';
Transitional provision
The provider of the anti-alcoholic and anti-toxic detention service, which provides an alcohol and anti-toxic detention service on the date of entry into force of this decree, shall comply with the requirements for minimum personnel security of the alcohol and anti-toxic detention services provided for in Decree No. 99 / 2012 Coll., as effective from the date of entry into force of this decree, within 12 months of the date of entry into force of that decree.
Efficacy
This Order shall take effect on the first day of the second calendar month following its publication.
