GOVERNMENT REGULATION
of 7 November 2007
amending Government Regulation No 197 / 2005 Coll., laying down the conditions for granting aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Čl. I
Government Regulation No 197 / 2005 Coll., laying down the conditions for the grant of aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, is amended as follows:
1. In Paragraph 4 (1) (d), the amount "50 000 CZK" is replaced by "20 000 CZK."
2. In Paragraph 4, the dot is replaced by a comma at the end of paragraph 1 and the following point (e) is added:
"(e) the organisation of lectures for children and youth on the topic listed in Part C of Annex 1."
3. In Article 4 (2), at the end of point (d), the dot is replaced by a comma and the words "and the undertaking that the installation will hold and operate for at least 5 years, 'are added;
4. in Article 4 (2), the following point (e) is added:
"(e) the number and topics of the lectures to which the subsidy is requested, if applicable, in accordance with paragraph 1 (e).";
5. In Article 4 (4), at the end of point (d), the dot is replaced by a comma and the words "and which undertake to hold and operate the equipment referred to in paragraph 1 (d) for at least 5 years, 'are added;
6. in Article 4 (4), the following point (e) is added:
"(e) the organisation of lectures for children and youth referred to in paragraph 1 (e), provided that the applicant has demonstrated by 31 August of the relevant calendar year at the latest that the individual lectures:
1. has led the head of the apiculture ring approved by the applicant,
2. have been in total at least 50 hours in the relevant period; and
3. at least 5 members of the apiculture club have been present for at least 80% of the total duration of the lecture. ';
7. In Article 5 (1), at the end of point (b), the comma is replaced by a dot and point (c) is deleted.
8. In Paragraph 5 (2), the comma at the end of point (b) is replaced by a dot and point (c) is deleted.
9. in Article 5 (3), point (b) is deleted and the designation of point (a) is deleted; after the words "the relevant calendar year ', the words" production and sale, where appropriate' shall be inserted, the words "individual bee breeders' shall be deleted and the comma shall be replaced by a dot at the end of paragraph 3.
10. in Article 6 (1) (a), "investment in equipment" is replaced by "acquisition of equipment" and "50 000 CZK" is replaced by "20 000 CZK."
11. in Article 6 (1) (b), the words "the care of a travelling colony located outside a permanent beekeeping post at least" shall be replaced by the words "the pursuit of the coking of hives by the location outside their permanent habitat."
12. in Article 6 (2) (a), the words "or intends to" shall be inserted after the words "which implement."
13. in Paragraph 6 (2), at the end of point (b), the dot is replaced by a comma and the words "and the undertaking that these establishments will hold and operate for at least five years."
14. Paragraph 6 (3) reads:
"(3) The application shall be accompanied by:
(a) a declaration by the bee-keeper of the intention to do the coking of hives referred to in paragraph 1 (b);
(b) notification to the bee-keeper of the hives site under special legislation (6);
(c) a situation sketch drawn up by a bee breeder in accordance with a special legislation (7), indicating the number of hives introduced. ';
footnote 5 is deleted.
15. in Article 6 (4) (a), the words "investment in equipment" shall be replaced by the words "acquisition of equipment" and, at the end of point (a), the words "which undertake to hold and operate equipment referred to in paragraph 1 (a) for at least 5 years," shall be added;
16. in Article 6 (4) (b), the words "the care of the hives' shall be replaced by the words" the carrying out of the beekeeping operations' and the words "an officially certified copy of the certificate issued by the State Veterinary Administration 'shall be deleted.
17. in Article 7 (1), including footnotes 9 and 10:
"(1) The subsidy under the measure for the reimbursement of the costs of the honey analysis may be granted to cover the costs of:
(a) physico-chemical analysis of mede9),
(b) analysis of honey for the presence of Paenibacillus larvae spores carried out in laboratories accredited under the law governing technical requirements for products10).
9) Table 2 of Annex 3 to Decree No 76 / 2003 Coll., laying down requirements for natural sweeteners, honey, confectionery, cocoa powder and mixtures of cocoa with sugar, chocolate and chocolate sweets, as amended by Decree No 43 / 2005 Coll.

„§ 8
(1) The subsidy under the renewal measures may be granted for:
(a) breeding of bees from a recognised breeding programme (11) in the Czech Republic;
(b) the acquisition of new equatorial hives of the type Langstroth, Dadant or type with a frame size of 390 x 240 mm after the winter mortality of the hives, for which the State Veterinary Administration has determined the contagious disease.
(2) The applicant shall indicate in the application:
(a) the name and, where applicable, the name, surname, date of birth and address of the place of permanent residence or place of business and, if assigned, the identification number of the breeders of bees from a recognised breeding programme, if any, if they are a natural person and if they are a grant under paragraph 1 (a); or
(b) the business firm or name, registered office and identification number, if assigned, breeders of bee mothers from a recognised breeding programme, if it is a legal person and if the subsidy referred to in paragraph 1 (a) goes,
(c) the name and, where applicable, the name, surname, date of birth and address of the place of permanent residence or place of business, and the identification number, if any, of the bee breeder, if any, if it is for a natural person and the number and type of new appendices of that bee breeder, if the grant referred to in paragraph 1 (b),
(d) the business firm or name, registered office and identification number, if any, of the bee breeders, if any, in the case of a legal person, and the number and type of new apiculture hives of that bee breeder, if applicable, in accordance with paragraph 1 (b).
(3) The Fund will grant a subsidy to cover the costs of breeding bees from a recognised breeding programme, provided that the applicant provides proof, by 31 August of the calendar year concerned at the latest, of the number of bees sold from a recognised breeding programme by their breeders in accordance with paragraph 2 (a) or (b).
(4) The Fund shall grant a subsidy to cover the costs of acquiring new replacement hives if the applicant submits, by 31 August of the calendar year concerned at the latest, documents demonstrating the number of new replacement hives purchased by the breeder in accordance with paragraph 2 (b). (c) or (d).
(5) The Fund will grant a grant for the acquisition of a maximum of 2 new hive hives referred to in paragraph 1 (b) per bee breeder affected by bee mortality.

19. in Paragraph 9 (1) (e), "35" is replaced by "50."
20. In Article 9, the dot is replaced by a comma at the end of paragraph 1 and the following point (f) is added:
"(f) 10 000 CZK per calendar year for the organisation of lectures according to § 4 (1) (e)."
21. In Article 9 (2), the word "a" is replaced by a comma and at the end of the text of paragraph 2 the words "for the calendar year 2008, for the calendar year 2008, for the calendar year 2009, the amount of CZK 14 267 000 and for the calendar year 2010, the amount of CZK 14 336 000."
22. in Paragraph 10 (1), the comma shall be replaced by a dot at the end of point (b) and point (c) shall be deleted;
23. In Paragraph 10 (2), the words "or (c)" shall be deleted, the word "and" shall be replaced by a comma and the words "shall be added at the end of the text of paragraph 2," for the calendar year 2008 the amount of CZK 16458 000, for the calendar year 2009 the amount of CZK 17477 000 and for the calendar year 2010 the amount of CZK 17563 000. "
24. in Article 11 (1) (a), the number "35" is replaced by "50" and the amount "100 000 CZK" is replaced by "150 000 CZK."
25. in Article 11 (1) (b):
"(b) CZK 50 per travelling bee in accordance with § 6 (1) (b), not more than CZK 150 per calendar year per travelling bee."
26. In Article 11 (2), the word "a" is replaced by a comma and at the end of the text of paragraph 2 the words ", for the calendar year 2008 the amount of 8 229 000 CZK, for the calendar year 2009 the amount of 8 738 000 CZK and for the calendar year 2010 the amount of 8 782 000 CZK."
27. in Article 12 (1):
"(1) The amount of the subsidy under the measure under Article 7 is:
a) 800 CZK per 1 physical chemical analysis of medu9),
b) 400 CZK for 1 analysis of honey for the presence of spór Paenibacillus larvae. "
28. In Article 12 (2), the word "a 'is replaced by a comma and at the end of the text of paragraph 2 the words", for the calendar year 2008 the amount of CZK 2 743 000, for the calendar year 2009 the amount of CZK 2 913 000 and for the calendar year 2010 the amount of CZK 2 927 000' are added.
29. in Paragraph 13 (1):
"(1) The amount of the subsidy under the measure under Article 8 is:
(a) CZK 200 per bee mother sold from a recognised breeding programme (11),
(b) CZK 2 000 per new extension hive according to § 8 (1) (b). "
30. In Article 13 (2), the word "a" is replaced by a comma and at the end of the text of paragraph 2, the words "for the calendar year 2008, for the calendar year 2008, for the calendar year 2009, and for the calendar year 2010, 14 936 000 CZK."
Article 31 (14) reads:
„§ 14
Where, for the calendar year 2009 and calendar year 2010, the total amount of revenue of the Fund is reduced from the previous calendar year for the subsidy rates provided for in this Regulation, the subsidy rates provided for in this Regulation for the calendar year 2009 and the calendar year 2010 shall be reduced by the percentage by which the total amount of revenue of the Fund shall be reduced from the previous calendar year for those purposes. ';
32. In Annex No 1, the words "children and youth 'shall be added at the end of the title of Part C.
33. In the title of Annex No 2, the words "study topics' are deleted.
34. In Annex No 2, Part A, at the end of the text in point 4, the words "and the container intended for honey processing 'shall be added.
35. In Annex No 2, the following points 10 and 11 are added at the end of Part A:
"10. Honey containers.
11. Refractometer. '
36. In Annex No 2, Part B, point 2, the words "and fumigation tapes' and the words" Gabon PF 92, Gabon PA 90 'are replaced by "Gabon PF 90, Gabon PA 92'.
37. Point 4 of Part B of Annex 2 reads as follows:
"4. Other means of application decided by the authority responsible for veterinary care. '
38. In Annex 2, Part C is deleted.
Čl. II
Transitional provisions
1. Legal relationships arising before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
2. Subsidy procedures managed by the Fund and not completed by the date of entry into force of this Regulation shall be completed and the rights and obligations arising therefrom shall be assessed in accordance with the existing legislation.

Efficacy
This Regulation shall enter into force on 15 November 2007.
