DECLARATION
of 14 August 2003
on the organisation and financing of competitions and shows for pupils
In agreement with the Ministry of Finance, the Ministry of Education, Youth and Sports provides, pursuant to § 13 (c) of Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education:
§ 1
Preliminary provisions
(1) This decree covers competitions and shows ("competitions') organised for pre-school pupils, schools and school establishments (" schools').
(2) Student competitions are part of education and education in schools. Their mission is to promote the talent, talent and efficient use of pupil time and to develop targeted educational and educational work with pupils.
(3) The provisions of this Decree also apply to the concentration organised for selected participants in the central rounds of competitions before their deployment at international competitions and to the concentration organised at regional and central level.
§ 2
Organisation of competitions
(1) The competitions are organised according to the age categories of pupils, professional focus, or according to the type of school or field of education, as a general rule in the form of advanced bicycles (school bikes, district bikes, county bikes, central bikes).
(2) Participation in competitions is voluntary for pupils. The school director shall be authorised to participate in all competitions at the time of teaching.
(3) The school director supports the involvement of pupils and educational staff in competitions.
§ 3
Announcement of competitions
(1) The school director declares competitions within the school and may agree on a joint announcement of competitions with other school directors.
(2) The regional authorities declare regional and regional competitions within their territorial competence.
(3) The Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry") declares competitions of a national character, competitions with international participation and international competitions.
(4) The Ministry may announce competitions together with the central authorities of state administration, self-government, civil associations or other legal persons on the basis of a written agreement. Expenses associated with competitions shall be shared by the promoters in advance.
(5) The applicants shall compete as referred to in paragraphs 1 to 4.
(a) determine the topics of competitions and their expertise;
(b) specify details of the organisation of individual competitions in the organisational orders or guidelines containing specific data relating to the security of competitions in the relevant school year, including the breakdown of the age categories of pupils, the setting of conditions for evaluation of competitions and price fixing.
(6) The applicants for competitions referred to in paragraphs 2 to 4 shall entrust the performance of the school competition, other contribution organisations set up by the applicant and other legal persons (hereinafter referred to as the organiser); the school may be entrusted with the organisation of the competition only with the consent of its founder, another legal person only with its consent.
(7) The school heads (school wheels), the regional authorities (district bikes and regional bikes) and the Ministry (central bikes) shall be responsible for the implementation of the individual training courses announced in accordance with paragraphs 2 to 4.
(8) The regional authorities may agree on a common organisation of the competitions referred to in paragraph 2. The joint organisation of regional competitions referred to in paragraphs 3 and 4 may be agreed with their promoters after consultation.
(9) The Ministry recommends that schools participate in other competitions which have not been announced in accordance with paragraphs 3 and 4.
(10) Each year, the Ministry shall issue an overview of the competitions it declares in accordance with paragraphs 3 and 4 and recommends in accordance with paragraph 9, including their individual steps. This summary shall be published by 30 June of the year in the Ministry of Education, Youth and Sports Bulletin.
(11) The date of the lowest round of the competition is crucial for the inclusion of the competition in the overview for the relevant school year.
(12) The school director shall publish at the school all offers for the participation of pupils in the competitions listed in the summary referred to in paragraph 10.
(13) At international competitions, pupils are selected on the basis of the results of the central rounds of the competitions referred to in § 3 (3) and (4), or on the basis of the results of the concentration organised for selected participants of the central rounds.
§ 4
Supervision of pupils
(1) Pupils' supervision during transport to and from competitions is provided by the sending school, unless otherwise agreed with the legal representative. During the competition, the organiser shall take over the supervision of pupils, which shall determine the beginning and the end of such supervision.
(2) For sport competitions, artistic competitions and other competitions, where the character of the competition so requires and given by the organizational order or instruction of the organiser, the supervision of pupils sending the school shall be ensured in full unless otherwise agreed with the legal representative.
§ 5
Financial security of competitions
(1) The Ministry shall contribute funds to regional authorities and other legal persons to cover the costs associated with the organisation of regional, regional and central rounds of competitions announced in accordance with § 3 (3) and (4), with the exception of the contribution to the implementation of school competitions.
(2) The Ministry and the regional authorities may contribute funds to the implementation of the centres organised at regional and central level.
(3) The Ministry provides funding to cover costs related to the implementation of the concentration organised for selected participants in the central rounds before their deployment to international competitions.
§ 6
Reimbursement of expenditure
(1) The organiser provides pupils, persons overseeing pupils, jurors, arbitrators and other persons involved in the security of the competition, the payment of the proven travel expenses for transport (hereinafter referred to as "fare") by public means of transport to regional, regional or central wheels of competition and back.
(2
(3) The organiser may authorise the use of a road vehicle by persons supervising pupils, jurors and other persons involved in the security of competitions, if it is economically advantageous.
(4) The organizer may arrange for a special bus for transport to the venue of the competition if it is economically or organically advantageous.
(5) The organiser is responsible for the overall expenditure linked to the competitions and includes expenditure on the preparation, promotion and actual performance of the competition.
(6 This proportion shall be notified by the organiser to the pupils or sending the school before the competition and shall be determined on the basis of the difference between the funds allocated by the promoter and, where appropriate, the promoter to secure the individual competitions for the relevant school year and the actual costs of the specific running round of the competition. The share shall not be eligible for expenditure on the remuneration of persons providing for the performance of the competition.
(7) The Ministry contributes to the payment of the expenses of the competitors and their necessary pedagogical escort associated with participating in international competitions.
(8) Pupils' catering expenditure is governed by specific legislations.1)
§ 7
Rewards for participants
(1) Competitors who place themselves in the 1st - 3rd place belong to a gift or a book order (hereinafter referred to as a gift).
(2) The maximum amount of the gift in kind can be paid by State budget resources
(a) in the district round
1. 600 CZK for winner - individual, or
2.1,200 CZK for winning team,
(b) in the regional round
1. 900 CZK for winner - individual, or
2.1,500 CZK for winning team,
(c) in the central round
1.1,400 CZK for winner - individual, or
2. 2 400 CZK for winning team.
(3) The sum of the value of the gifts in kind for the contestants who are placed in second and third places must not exceed the amount determined for the gift in kind for the competitor in first place.
(4) For contests for which the exact order of all participants is not determined, the total price of the gifts provided shall not exceed three times the value of the gift in question for the winner referred to in paragraph 2.
§ 8
Safety and health in competition
(1) If the specific focus of the competition so requires, the organiser shall give details of the safety and health of the competition in the organisational rules of the competition or in the guidelines.
(2) According to the character of the competition, the organizer will conclude an appropriate insurance contract.
§ 9
Provision of information on successful contenders
(1) The organizer of the regional round shall, within one month of the end of the relevant round of the Institute of Children and Youth of the Ministry of Education, Youth and Sports, communicate the name, surname, year of birth of the competitor and the address of the school he visits. The organizer of the regional round gives this information about the contestants who placed themselves in the first to tenth place.
(2) The central wheel operator shall provide the data referred to in paragraph 1 for all competitors.
(3) The Institute of Children and Youth of the Ministry of Education, Youth and Sports shall process the total profit and loss sheets in each of the competitions referred to in paragraphs 1 and 2. The processing of personal data referred to in paragraph 1 shall be subject to a separate law.2)
§ 10
Repeal
(1) Decree No. 431 / 1992 Coll., on the organisation and financing of competitions and shows of pupils of preschool, school and school establishments, is hereby repealed.
(2) Decree No. 182 / 1998 Coll., on the organisation and financing of competitions and shows of pupils of preschool, school and school establishments, is hereby repealed.
§ 11
This Decree shall take effect on 1 September 2003.
