Decree of the Ministry of Defence on the provision of health care in military medical facilities

on the provision of health care in military medical institutions
The Ministry of Defence provides, in an agreement with the Ministry of Health pursuant to § 94 (3) of Act No. 221 / 1999 Coll., on professional soldiers, and under § 90 (3) of Act No. 220 / 1999 Coll., on the course of essential or alternative service and military exercises and on certain legal ratios of soldiers in reserve:
§ 1
Outpatient care
(1) Ambulant care is provided to professional soldiers, to soldiers in primary or secondary service and to soldiers in reserve called for military training ("soldiers") by crew and equivalent medical care facilities ("crew medical facilities") at the site of a military unit, military facility or military rescue unit ("service"). For services with a small number of soldiers, outpatient care is provided by separated workplaces of the crew nursing homes. In the absence of an outpatient nursing home or a separate workplace, outpatient care shall be provided by another medical institution with which the service authority has concluded a contract for the provision of outpatient care to soldiers and which has a contract for the provision of medical care with the Military Health Insurance Agency under a specific legislation. 1)
(2) Health care in crew care centres and in separate departments of crew care centres is provided to soldiers and pupils of military secondary schools in the care range of a general practitioner for adults, including dental care, when part of the crew nurse's dental work.
(3) If a condition of injured or ill care which cannot be provided on an outpatient basis is required, the
(a) a soldier in primary or secondary service, a soldier in reserve called for a military exercise and a student in a military secondary school of care in the berth of the crew infirmary;
(b) a soldier in the care profession in the berth part of a crew infirmary may not, on the basis of a decision taken by the treating physician, provide treatment at the place of permanent or temporary residence.
(4) Outpatient care can be provided in the crew and in the detached departments of the crew nurseries to civil servants, family members of professional soldiers and civil servants, military pensioners and other natural persons.
(5) In the event of adequate personnel and material equipment, the medical services of first-aid personnel shall be provided. In other cases, such care shall be provided by the nearest medical institution providing first-aid medical services. Professional pre-hospital emergency care shall be provided to soldiers by medical facilities authorised to provide such care under specific legislation.2)
§ 2
Constitutional care
In the case of severe or difficult to diagnose injuries or diseases, and following the exhaustion of diagnostic and therapeutic possibilities of crew nurseries or separate departments of crew nurseries, soldiers of constitutional care shall be provided in military hospitals or other medical facilities as decided by the doctor who provided outpatient medical care.
§ 3
Spa care
Spa care is provided to soldiers in military spa hospitals or other spa hospitals according to special legislation .3)
§ 4
Assessment activities
(1) Assessment of the medical fitness of a soldier to perform a military active service shall be carried out by military doctors and review committees in accordance with special legislation. 4)
(2) The incapacity of a soldier to serve the disease or accident shall be assessed by a doctor of a crew sickbay or a dislocated workplace of a crew sickbay and, if not set up, by a doctor of another medical establishment as referred to in § 1 (1) or by a doctor of a medical establishment as referred to in § 2 and 3.
(3) The failure of a soldier to serve as a disease or accident prescribed by a doctor of another medical establishment in accordance with Article 1 (1) and exceeding 14 days shall be notified by the service authority to the medical practitioner of the crew sickbay or of the detached workplace of the crew sickbay to which the service is assigned to the care.
§ 5
Military air medical transport
Military air health services may provide for the transport of injured or sick soldiers or other natural persons, as the case may be, in so far as they are not carried under specific legislation. 5)
§ 6
Military hospitals
Military hospitals
(a) provide professional and specialised health care to soldiers, pupils of military secondary schools, civil servants, family members of professional soldiers and civil servants and military pensioners;
(b) may provide professional and specialised healthcare to other natural persons;
(c) provide dispensary care to soldiers;
(d) provide specialist and specialised examinations, including assessment activities, for soldiers, students of military secondary schools and civil servants;
(e) participate in the training of doctors and other healthcare professionals;
(f) carry out the tasks arising from the international treaties by which the Czech Republic is bound, on the basis of the requirements of the service authorities.
§ 7
Air Health Institute
The Institute of Air Health provides professional and specialised health care, carries out assessment activities and other special activities in the field of aviation medicine to determine specific medical fitness under specific legislation. 4), 6)
§ 8
Military rehabilitation institute
Military Rehabilitation Institute provides
(a) the medical rehabilitation of soldiers and pupils of military secondary schools following accidents and diseases which they have suffered in the performance of their duties or employment, in direct connection with them or for the performance of their duties or employment and, where appropriate, other natural persons;
(b) preventive rehabilitation of professional soldiers. 7)
§ 9
Military spa facilities
Military spa hospitals provide
(a) spa care for professional soldiers, civil servants, military pensioners, family members of professional soldiers, civil servants and military pensioners and, where appropriate, other natural persons under special legislation, 3)
(b) preventive rehabilitation (7) to professional soldiers.
§ 10
Military sanitary and anti-epidemic facilities
Central Military Health Institute and branch of Central Military Health Institute in particular
(a) ensure hygienic-anti-epidemic tasks;
(b) implement technical hygienic-antiepidemic measures;
(c) collect, analyse and evaluate health and epidemiological data, including the epidemiology of drug addiction, and carry out expert tasks;
d) Solves the issue of microwave and air noise hygiene;
(e) address the issue of protection against ionising radiation within the defined scope;
(f) participate in the assessment of the health status of soldiers in relation to the conditions of service or employment;
(g) carry out the role of the vaccination centre of the armed forces.
§ 11
Central Health Base
The central health base and its branches shall in particular ensure the distribution of medicines and medical devices, the control of medicines and medical devices, and the control of the handling of medicines and medical devices. 8)
§ 12
Efficacy
This Decree shall take effect on 1 December 1999.
