on the conditions for monitoring and storing casino records
The Ministry of Finance provides pursuant to § 50 (2) of Act No. 202 / 1990 Coll., on lotteries and other similar games, as amended by Act No. 149 / 1998 Coll.:
§ 1
(1) The camera system, microphone system, recording system, own monitors and other related equipment for casino monitoring (hereinafter referred to as "monitoring equipment") must be adapted so that it is possible to monitor each playing table separately in real time.
(2) The recording system shall be equipped with time, data and resolution functions and shall allow recording and playback with sound.
§ 2
(1) All gaming tables (including roulette wheel and chip box) located in the casino, the cash register and the premises where the final statement of the results of the game day is made shall be monitored. The monitoring shall be continuous.
(2) The visual and audible recording from monitoring (hereinafter referred to as the "recording") must be clear, clear and distinctive. In particular, the digits on the roulette wheel and on the playing tables, chip marking, card values, number of chips shall be clearly visible from the record.
(3) The sound is recorded simultaneously with the image. The sound played must not be distorted against the reality monitored.
(4) Monitoring shall be carried out under conditions such that the record is of good quality. In particular, the casino lighting shall be maintained at the appropriate intensity under which the recording can be made according to the technical data of the camera system and all lenses and covers behind which the camera system is located shall be kept clean.
§ 3
(1) The outputs from the camera and microphone systems are concentrated in a special separate and enclosed space (the control room). The control room must be secured against forced entry.
(2) The casino's operating rules include a range of persons responsible for the operation of the monitoring equipment, as well as a range of persons who have access to the monitoring equipment control room, to the record carrier archive and who are authorised to delete the records. Public oversight staff shall have access to the control room and record-keeping archives, accompanied by such persons.
§ 4
(1) Record carriers must be stored in such a place as to prevent damage, misuse, theft or destruction. Record carriers shall be chronologically marked with the date of recording on the carrier's packaging. Any tampering with a record carrier shall be recorded.
(2) Records shall be kept of the record containing the identification of the gaming table, the date of the recording, the date of deletion of the record, the name and signature of the worker who carried out the deletion.
§ 5
(1) The operator shall notify the national surveillance staff of the failure on the monitoring equipment and the date of its removal within 24 hours of the detection of the malfunction. In the event of failure of the monitoring equipment on the day of work, the reporting obligation shall be fulfilled on the first working day after that date. The persons responsible for fulfilling the notification requirement shall be listed in the casino's operating rules.
(2) The operator shall keep a repair record, partial or complete replacement of the monitoring equipment and shall keep it for at least 1 year.
(3) The records referred to in paragraph 2 shall contain the date, exact time and extent of the repairs, the name and address of the service company and the names of the persons who have carried out the repairs.
§ 6
This Decree shall take effect on 1 January 1999.
