DECLARATION
of 5 September 2016
implementing certain provisions of the pyrotechnic Act
The Ministry of Industry and Trade provides, pursuant to § 11 (5), § 17 (2), § 26 (3), § 28, § 38 (2) and (4), § 39 (2) and § 52 (3) of Act No. 206 / 2015 Coll., on pyrotechnic articles and on the modification of certain laws (Act on pyrotechnic):
Subject matter
This decree provides
(a) a model format for the register of pyrotechnic articles certified by the notified body;
(b) requirements for security measures to ensure fire-fighting measures, the marking, storage and use of pyrotechnic articles, the definition and provision of vulnerable space and the conditions for the display of pyrotechnic articles;
(c) the content of the records of stored pyrotechnic articles;
(d) requirements for walls, bulkheads, doors and roof structures, surface treatment of inner walls, ceilings and floors, safety distance and linkage and fire safety of the warehouse and protection against external effects;
(e) the scope and duration of the training, the theoretical and practical plan of the training and the test schedule;
(f) the content of medical examinations, the particulars of the medical assessment and the conditions for assessing medical fitness for handling pyrotechnic articles of category P2, T2 or F4;
(g) diseases, defects or conditions which exclude or restrict medical fitness for the treatment of pyrotechnic articles of category P2, T2 or F4;
(h) description and content of the test for detonation characteristics of the pyrotechnic article.
Register of pyrotechnic articles
The model format of the register of pyrotechnic articles certified by the notified body is set out in Annex 1 to this Regulation.
Security measures for display
(1) When issuing an operator shall ensure that security measures are taken to ensure that pyrotechnic articles are displayed and stored:
(a) in the smallest packages intended for sale or in the original packaging of the manufacturer bearing the mark that the sample is an exhibition;
(b) in such a way as to comply with the conditions laid down in the manufacturer's instructions or instructions;
(c) separately from flammable and flame-retardant substances;
(d) dry and in such a way that their temperature does not exceed 40 ° C unless otherwise specified in the manufacturer's instructions or instructions;
(e) in such a way as to prevent their spontaneous fall, prevent their unintentional initiation or ignition and minimise the risk to the life and health of persons or property; and
(f) in the quantity and species corresponding to the fire safety of the exhibition area and the declaration to the fire brigade pursuant to Section 31 of the pyrotechnic Act.
(2) In the space where the operator issues pyrotechnic articles, at least one portable water or foam fire extinguisher with a fire extinguisher of at least 13 A or a portable powder extinguisher with a fire extinguisher of at least 21 A shall be placed for immediate use in excess of the requirements of the Fire Prevention Regulation (1).
(3) The hazardous space in which pyrotechnic articles may be used during display shall be defined according to the manufacturer's instructions or instructions for the pyrotechnic article. In the event that the instructions for use or instructions of the manufacturer do not define the compartment at risk, the space at risk shall be defined according to the instructions of the pyrotechnic article which is functionally closest to the pyrotechnic article to be used.
Registration of stored pyrotechnic articles
(1) The records of stored pyrotechnic articles shall contain at least the name, type, category, registration number and series or batch of pyrotechnic articles and an indication of the quantity of pyrotechnic articles in storage, hand warehouse and sales room.
(2) In the register of stored pyrotechnic articles for use in vehicles, the data referred to in paragraph 1 may be replaced, except for the quantity of pyrotechnic articles in storage, hand storage and sales rooms, by the catalogue numbers of spare parts.
(3) In the case of pyrotechnic articles which are not marked with a registration number, this entry should not be entered in the register of stored pyrotechnic articles.
Construction technical requirements for the warehouse
Construction technical requirements for the warehouse:
(a) the materials used for the construction of the warehouse protect stored pyrotechnic articles from dangerous reactions to shocks in contact or friction with the floors, walls, ceilings or structures of such objects;
(b) materials liable to be broken by internal or external pressure forming the roof structure, walls, bulkheads and opening fillings did not constitute sharp shrapnel when breaking;
(c) the external doors were opened outside and their opening was ensured by simple pushing from the inside and simple handling from the outside;
(d) the floors have a solid, solid and flat surface; and
(e) the glazing of the apertures exposed to sunlight did not show any defect or inequality of the surface which would cause the sun to converge and was coated with a coating that would limit the passage of sunlight.
Storage security and storage requirements
(1) Storage fire safety:
(a) signs prohibiting smoking and tampering with open fire are placed on all doors leading to storage areas;
(b) only authorised persons may enter the warehouse; unauthorised persons may enter only with the assistance of authorised persons and must follow their instructions,
(c) the warehouse shall be closed except when the warehouse is being or is being removed from storage; if no one is in the warehouse, the warehouse must be locked,
(d) during the maintenance of a warehouse which may endanger stored pyrotechnic articles, such products must be moved to another warehouse during the maintenance work;
(e) cleaning of indoor walls, ceilings, floors, doors, shelves and other equipment shall not be used cleaning agents containing flammable substances;
(f) in and around the warehouse, only works related to the actual operation of the warehouse and its maintenance may be carried out within a distance of 30 metres if the security distance exceeds 30 metres;
(g) only mechanisation intended for the handling of stored pyrotechnic articles, including mechanisation for the handling of other products, may be placed in storage, provided that such storage has been authorised;
(h) in the case of the main entrance on the outside, the information board shall be placed on a non-flammable ground containing at least:
1. the number of the decision enabling the warehouse to be used;
2. the maximum number of persons allowed to move in storage;
3. maximum net mass of explosive substances,
4. emergency instructions.
(2) Storage requirements:
(a) pyrotechnic articles classified as dangerous goods class 1 and the relevant subclasses and tolerance groups may be stored in the warehouse to the extent appropriate to UN numbers for pyrotechnic articles in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR);
(b) pyrotechnic articles which do not comply with point (a) shall be stored as pyrotechnic articles classified in subsection 1.1 in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR);
(c) only pyrotechnic articles falling within the tolerance groups of substances and articles may be stored together in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) which are compatible with each other,
(d) pyrotechnic articles classified in different subclasses in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) shall be stored separately to avoid confusion;
(e) temperature and humidity shall be maintained so as to comply with the conditions laid down for the storage of pyrotechnic articles in accordance with the manufacturer's instructions;
(f) in the case of storage of several types of pyrotechnic articles, a critical pyrotechnic article with the most stringent conditions shall be that the storage conditions of other pyrotechnic articles must not be adversely affected at the same time;
(g) products shall be stored in such a way as to prevent their spontaneous fall, the height of the stored products being determined by reference to the design and technical parameters indicated by the manufacturer according to the load capacity of the lower layers of packaging, the load capacity of the shelf and the load capacity of the warehouse;
(h) packaging is stored in such a way as to allow easy access to data on the transport packaging of individual pyrotechnic articles;
(i) the damaged pyrotechnic articles shall be stored separately in a place designated by the operator and clearly marked.
(3) The fulfilment of obligations under paragraphs 1 and 2 is without prejudice to the obligations laid down in another legislation2).
Safety distance
(1) The location of the storage of pyrotechnic articles classified in subsection 1.1 in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR) shall comply with the safety distances. The method of calculating the safety distance is set out in Annex 2 to this Decree.
(2) The method of calculation referred to in Annex 2 to this Decree shall not apply where a maximum of 100 kg net mass of explosive substances contained in pyrotechnic articles classified in subsection 1.1 is stored in storage in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR).
(3) The security distance does not apply to access roads and buildings and structures used for warehouse operation.
Protection against external influences
The design documentation of the warehouse shall specify the method of securing the storage of pyrotechnic articles against their theft or damage, taking into account the risk of stored pyrotechnic articles which may arise from their theft or damage.
Professional training to obtain a certificate of competence
(1) Professional training is carried out in the range of 40 hours for the treatment of pyrotechnic articles of categories F4 and T2 together and 40 hours for the treatment of pyrotechnic articles of category P2. The duration of the lesson is 45 minutes. The theoretical and practical training plan is set out in Annex 3 to this Decree.
(2) The test schedule is set out in Annex 4 to this Decree.
Content of medical examinations
(1) The content of each medical examination for the assessment of medical fitness is a basic examination which includes:
(a) an analysis of the data on the state of health and the diseases, conditions or defects to date (hereinafter referred to as "disease"), with a particular focus on the occurrence of diseases which may reduce or exclude medical fitness for the treatment of pyrotechnic articles of categories P2, T2 or F4;
(b) a comprehensive physical examination, including an indicative examination of hearing, vision, skin and indicative neurological examination, with an emphasis on the detection of diseases which exclude or restrict medical fitness for the treatment of pyrotechnic articles of category P2, T2 or F4; diseases which exclude or restrict medical fitness for the treatment of pyrotechnic articles of category P2, T2 or F4 are listed in Annex 5 to this Regulation.
(2) The initial examination shall be extended by additional professional examinations if such examinations are indicated by the assessor if:
(a) this is necessary to exclude the diseases listed in Annex 5 to this Decree or other diseases which restrict or exclude the safe treatment of pyrotechnic articles of category P2, T2 or F4; or
(b) the person under consideration is in the continuous care of another doctor or clinical psychologist for the disease listed in Annex 5 to this Decree or another disease which excludes or limits the safe treatment of pyrotechnic articles of category P2, T2 or F4, if this is known to the assessor.
(3) Further professional examinations may not be carried out until the initial examination has been carried out by the investigator.
(4) In the request for further technical examination, in addition to the requirements laid down in the legislation governing the formalities and content of the medical document3), the requirement to assess the medical fitness of the person under investigation for the treatment of pyrotechnic articles of categories P2, T2 or F4 shall be indicated in the scope of the medical professional carrying out the professional examination.
(5) The person to be assessed may be recognised as fit or fit subject to condition if, on the basis of a medical examination, a disease excluding medical fitness has not been detected in that person or another disease which excludes the safe treatment of pyrotechnic articles of category P2, T2 or F4.
(6) In the detection of diseases which, according to Annex 5 to this Decree, restrict or suspect medical fitness, the person under assessment may be recognised as fit only on the basis of the positive conclusion of a professional examination.
Medical assessment requirements
The medical opinion on medical fitness, in addition to those required under the legislation governing the formalities and content of medical documents3) contains information that this is a medical assessment for the treatment of pyrotechnic articles of categories P2, T2 or F4.
Description and content of the detonation characteristics test
The description and content of the test are given in Annex 6 to this Decree.
Notification
This decree was notified in accordance with Directive 2015 / 1535 / EU of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services, as amended.
Efficacy
This decree shall take effect on the 15th day following its publication.

Safety distances for stores of pyrotechnic articles classified in subsection 1.1 in accordance with the European Agreement on the International Carriage of Dangerous Goods by Road (ADR)
The safety distance of the warehouse which is the smallest permissible distance between the warehouse and the surrounding installation, roads and railways shall be calculated:
- for surrounding installation according to the formula
E = 22 × NEC1 / 3
- for infrastructure and railways according to the formula
E = 15 × NEC1 / 3

E is the safety distance in meters,
The NEC is the net mass of explosive substances in kilograms.

Test schedule
Test Panel
1. The test committee is set up by the Czech Office for the Testing of Weapons and Ammunition in cooperation with the Czech Mining Office. The test committee is three members.
2. The examination committee shall be able to resolve if an absolute majority of its members are present. Each member of the examination committee shall have one vote when voting. The agreement of an absolute majority of the members of the examination committee present shall be required for the adoption of the resolution. In the event of a tie, the chairman shall vote.
Test
1. The test shall verify the applicant's acquired expertise on obtaining a certificate of competence for the handling of pyrotechnic articles of the relevant pyrotechnic article category.
2. The test consists of 3 parts - written, oral and practical. The oral and practical examination shall be aimed at the relevant category of pyrotechnic article as determined in accordance with the applicant's request for a certificate of competence for the handling of pyrotechnic articles.
3. The written part of the examination shall be carried out by means of a test of knowledge from the whole subject subject of vocational training. The written part of the test shall be evaluated by the Examination Committee by assessing each correct response with one point. In order to obtain a "benefit 'rating, at least 80 per cent of the maximum number of points shall be achieved. Otherwise, the evaluation shall be" not successful' and it shall not be possible to proceed to the oral and practical part of the test.
4. The oral part of the test is aimed at:
(a) the legislation applicable to pyrotechnic articles;
(b) characteristics, categories, design and technical requirements for pyrotechnic articles;
(c) explosive substances and mixtures thereof contained in pyrotechnic articles;
(d) the handling of pyrotechnic articles and fireworks.
5. The practical part consists of a separate task which contains:
