GOVERNMENT REGULATION
of 26 October 2015
amending Government Regulation No 154 / 2005 Coll., laying down the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended
The Government orders pursuant to § 150 (1) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll. and Act No. 468 / 2011 Coll., to implement § 24 (5) of the Act on Electronic Communications:
In item 1 of the Annex to Government Decree No. 154 / 2005 Coll., establishing the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended by Government Decree No. 288 / 2007 Coll., Government Decree No. 162 / 2008 Coll., Government Decree No. 228 / 2009 Coll., Government Decree No. 156 / 2011 Coll. and Government Decree No. 175 / 2012 Coll., Part A reads:
"A. TERM MOVEMENT SERVICES
A.1. Radio networks
CZK per year according to calculation
All-area radio networks are for charging purposes networks where radio frequencies are used by radio devices throughout the Czech Republic. All-area terrestrial mobile service radio networks shall not include radio networks with a national radio frequency used only for mobile radio equipment. Furthermore, radio networks through which the important interests of the State are ensured shall be understood as flat-screen radio networks.
Calculation:
C = S1 × K1 × K16
where is
C charge for the use of one radio frequency
S1 Rate per 1 kHz of frequency band width used
S1 = 1600 CZK
K1 Coefficient of frequency bandwidth used.
This coefficient shall be calculated from the width (in kHz) of one frequency channel equal to the channel pitch in the frequency band used.

A. 2. Other terrestrial mobile service radio networks

A 2.1 Regional and local radio networks
Regional and local radio networks are for charging purposes radio networks in which radio frequencies are used by radio equipment in the defined territory of the Czech Republic under radio frequency allocation conditions for the purpose of providing publicly available electronic communications services.
Calculation:
C = S1 × K1 × K16 × Kr

A 2.2 Other radio networks
The radio frequency usage fee shall be the sum of the charge for the use of one radio frequency by mobile radio equipment and the charge for the use of one radio frequency by non-mobile radio equipment.
Calculation:

C charge for the use of one radio frequency
Ca A charge for the use of radio frequency transmitted by mobile radio equipment within the operating area, which depends on the size of the operating area and radiated power of mobile radio equipment
Cb A charge for the use of frequency transmitted by non-mobile radio equipment that depends on radiated performance of individual non-mobile radio equipment
Calculation of fee Ca
The fee shall be charged regardless of the number of mobile radio equipment in the network. For the purpose of calculating the fee, the area served for the radio frequency is a geographical area which is determined by the geographical coordinates of the centre of the area and its radius (maximum distance of mobile radio equipment from the centre of the geographical area in which it can be operated). In determining the area to be served, the technical parameters of the radio network shall be based on the provision of uninterrupted operation of other radio networks. The service area may be determined by the Authority if it is not determined in accordance with the above parameters.
For the purposes of the interaction of the essential components of the integrated rescue system on the dedicated helical radio frequencies defined in the Radio Spectrum Use Plan, the coefficient K2 = 1 shall be determined regardless of the size of the radii of the operator area.
Calculation of the fee The Ca shall also apply to mobile electronic communication devices in remote control and signalling networks.
Calculation:
Ca = S2 × K1 × K2 × K3

Calculation:
Cb = S2 × K1 × K4

| K1 | Koeficient využívané šířky kmitočtového pásma. Tento koeficient se vypočte ze šířky (v kHz) jednoho kmitočtového kanálu, která se rovná kanálové rozteči ve využívaném kmitočtovém pásmu. |

Efficacy
This Regulation shall enter into force on 1 November 2015.
