DECLARATION
of 3 September 2013
amending Decree of the Ministry of Transport and Communications No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll., as amended
The Ministry of Transport provides pursuant to Section 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., Act No. 374 / 2007 Coll., Act No. 133 / 2011 Coll. and Act No. 297 / 2011 Coll.:
Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 152 / 2003 Coll., Decree No. 298 / 2006 Coll. and Decree No. 156 / 2008 Coll., is amended as follows:
1. In Section 1 (b), the words "driving authorisation 'are replaced by the words" admission to teaching and training'.
2. In Section 1 (i), the words "individual categories and subcategories of driving licence 'are replaced by the words" driving licence for the relevant group of vehicles'.
3. in Article 1, points (l) and (m) are deleted;
Point (n) shall be renumbered as point (l).
4. In the heading of Title II of Part Two, the words "RIGHTS 'are replaced by the words" ENFORCEMENT AND TRAINING'.
5. In Section 3, the words "driving authorisation 'are replaced by the words" admission to teaching and training' and in brackets under the heading "5 'is replaced by the words" 6'.
6. The first sentence of Paragraph 3 (1) reads: "The application for admission to teaching and training is a bilateral A4 format form. '.
7. In the first sentence of Article 3 (2), the words "application for a driving licence 'are replaced by the words" application for admission to teaching and training'; the words "assessor 'are replaced by the words" person certifying compliance with the conditions for admission to teaching and training (6)'; and the words "before the application for admission 'are replaced by the words" prior to admission'.

8. In the third sentence of Article 3 (2), the words "applications for a driving licence 'are replaced by the words" applications for admission to teaching and training' and the words "and shall be supplemented when the licence is issued by the municipal authority of the municipality with extended scope 'are deleted.
9. In Article 4 (1) (c), the words "the relevant group or subgroup of driving licences' are replaced by the words" the group of vehicles in respect of which the relevant driving licence is entitled to drive '.
10. in Article 4 (1) (e), the words "the relevant group or subgroup of driving licences" shall be replaced by the words "the groups of vehicles in respect of which the relevant driving licence is entitled to drive."
11. in Article 4, at the end of paragraph 3, the dot is replaced by a comma and the following point (v) is added:
"(v) familiarisation with the essential acts at the scene of the accident in relation to road safety, including the principles for the use of the reflective vest, warning triangle and other marking of the place of the accident.";
12. In Article 5, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) knowledge of the location of the mandatory equipment elements in the vehicle and how they are used, including practical skills in handling the warning triangle and its correct location behind the vehicle.";
13. in Paragraph 7 (3) (h), the words "the relevant group or subgroup of driving licences" are replaced by the words "classified in the category of vehicles of the relevant driving licence."
14. in § 9 (3) (a), § 10 (2) (f) and § 13a (1) (b), the word "stay" is replaced by "residence."
15. in Article 9 (3) (c):
"(c) the driving licence applied for by the applicant;"
16. in § 9 (4), in § 10 (4), in § 11 (5), in § 12 (3) and in § 20 (4), the word "readable" shall be deleted;
17. in Article 11 (3), the words "and the time of start of training in the proceedings of each applicant for a driving licence" shall be added at the end of the text in point (c).
18. In Article 11 (3), the words "and the time of completion of training in the proceedings of each applicant for a driving licence 'shall be added at the end of the text of point (d).
19. in Paragraph 11 (4), the word "termination" is replaced by the word "implementation."
20. in Article 12 (1) (c):
"(c) the driving licence for which instruction and training are carried out;"
21. In Paragraph 12 (2), the words ", the time-limits of the beginning and end of the training" shall be inserted after the words "the dates of the lesson."
22. in Article 13a (1) (c):
"(c) the driving authorisation of the group of vehicles in question for which the applicant for a driving licence has started teaching and training;"
23. in Article 13a (3), the words "application for a driving licence" shall be replaced by the words "application for admission to teaching and training" and the words "medical certificate for admission to teaching and training, unless this certificate is part of the application for a driving licence," shall be replaced by the words "certificate of medical fitness for driving motor vehicles."
24. In Part Three, in brackets under the heading of Title One, the words "paragraph 4 'are replaced by the words" paragraph 5'.
25. In Paragraph 14 (1), the words "with a focus on the application of basic pedagogic-psychological principles and procedures for communication with the applicant for a driving licence in the conduct of the test and the subsequent evaluation of the results of the test, with an emphasis on the training of accurate expression, the choice of grammatically and stylistically appropriate terms, terminology, gesturing and improving the verbal capabilities of the examiner," shall be added at the end of the text of point (c).
26. in Article 14 (1) (f):
"(f) knowledge of the organisation, content and scope of the proficiency tests for the driving of motor vehicles, with a view to consistently fulfilling the legal requirements for the examination of the knowledge, skills and behaviour of the applicant for a driving licence, while maintaining uniform principles for the assessment of the components of the proficiency test for the driving of motor vehicles,"
27. In Paragraph 14, at the end of paragraph 1, the dot is replaced by a comma and the following point (h) is added:
"(h) knowledge of the practical control, control and handling of the vehicle following the scope of the approval to carry out the proficiency tests for motor vehicles held or intended to obtain by the test Commissioner, at least within the scope of the competence tests for motor vehicles for the relevant group of vehicles.";
28. In Paragraph 14 (5), the words "or subgroup of driving licences' are replaced by the words" vehicles'.
29. in Paragraph 15 (2) (f), the words "or subgroup of driving licences" are replaced by the words "vehicles."
30. In Article 15, the words "and the applicant for renewal of the probationary officer's licence shall be added at the end of paragraph 3, at least 47 points of the maximum possible 50 points'.
31. in Article 17 (5) of the introductory part of the provision, the words "AM and A and subgroups A1" are replaced by the words "vehicles AM, A1, A2 and A."
32. in Article 17 (6) of the Introductory Part of the Provisions, the words "C, C + E, D, D + E and subgroups C1, C1 + E" are replaced by the words "vehicles C1, C1 + E, C + E, D1, D1 + E, D and D + E."

"(1) In the vehicle control and maintenance test, the applicant for a driving licence for vehicle categories C1, C1 + E, C, C + E, D1, D1 + E, D and D + E shall demonstrate the knowledge of the essential systems of the vehicle and of the factors affecting the safety of driving, the economy of operation and the environment, the knowledge in the maintenance of the vehicle, as well as the recognition and removal of existing failures with regard to the safety requirements of the operation of motor vehicles and trailers. ';
39. In Paragraph 18, the following paragraph 2 is inserted after paragraph 1:
"(2) The disabled person shall demonstrate the knowledge referred to in paragraph 1 to a vehicle designed to be disabled. ';
Paragraph 2 shall become paragraph 3.
40. In Section 18 (3), the word "individual 'is deleted and the words" and subcategories of driving licences' are replaced by the words "vehicles C1, C1 + E, C, C + E, D1, D1 + E, D and D + E '.
41. in Article 19 (1) (a), the words "and subgroups of driving licences" shall be replaced by the words "vehicles."
42. In Article 19 (1) (a) (1), "C, C + E, D and D + E and subgroups C1, C1 + E, D1 and D1 + E" is replaced by "vehicles C1, C1 + E, C + E, C + E, D1, D1 + E, D and D + E."
43.In Article 19 (1) (a) (2), "B and subgroups B1" is replaced by "vehicles B and B1."
44. in Article 19 (1) (b), the words "category AM and A and subcategory A1" are replaced by the words "category AM, A1, A2 and A vehicles."

46. in Article 19 (1) (c) (1), the words "first aid features and" shall be replaced by the words "the mandatory vehicle features, their location and their applicability, including the ability to compile a warning triangle and check."
47. in Article 19 (1) (c) (2), the words "demonstrate the safety of work when loading and unloading a load on a vehicle" shall be replaced by the words "show the knowledge in the location, attachment and securing of the load on a vehicle or trailer, including the safety of work when loading and unloading it from a vehicle or trailer and skills."
48. in Paragraph 19 (1) (d), the words "driving licences of categories B + E, C + E, D + E and T and subgroups C1 + E and D1 + E" are replaced by the words "vehicle groups B + E, C1 + E, C + E, D1 + E, D + E and T";
49. in Article 19 (1) (d), the words "disconnect this trailer or semi-trailer" shall be replaced by the words "position, attachment and securing of the prescribed load and disconnect this trailer or semi-trailer after all prescribed driving operations and park the towing vehicle next to the trailer or semi-trailer in its original position."
50. in Article 19 (1) (e), the words "category C, C + E, D, D + E and T and subgroups C1, C1 + E, D1 and D1 + E" are replaced by the words "category C1, C1 + E, C + E, C + E, D1, D1 + E, D, D + E and T";

52. in Article 19 (2) (a), the words "and subgroups of driving licences" shall be replaced by the words "vehicles."
53.In Article 19 (2) (a) (1), the words "driving with a view to reducing fuel consumption and emissions," shall be inserted after the words "driving direction."

"(d) in a practical driving test to obtain or extend the scope of a driving licence for a category B vehicle to a combination of vehicles consisting of a category B vehicle and a trailer with a maximum authorised mass of not more than 750 kg, where the maximum authorised mass of that combination exceeds 3 500 kg but does not exceed 4 250 kg, the applicant for a driving licence shall demonstrate the knowledge and skills as for category B + E."
57. In Paragraph 19 (4), the words "economical, safe, energy efficient" shall be inserted after the words "adaptable."
58. In brackets under the heading of Section 20, "27 (5) 'is replaced by" 39 (4)'.
(59) In Article 20 (3) (c), the words "or subgroup of driving licences" are replaced by the words "vehicles."

Transitional provision
The forms of the professional certificate and the certificate of the examiner produced before the entry into force of this Order may be used until their stocks are exhausted, but for a maximum period of 1 year from the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 15 October 2013.
