DECLARATION
of 2 June 2006
amending Decree No. 221 / 2004 Coll., laying down lists of dangerous chemicals and dangerous chemicals whose placing on the market is prohibited or whose placing on the market, putting into circulation or use is restricted, as amended
In agreement with the Ministry of Health and the Ministry of Agriculture, the Ministry of the Environment provides, pursuant to § 26 (3) of Act No. 356 / 2003 Coll., on Chemicals and Chemical Products and amending certain laws:
Čl. I
Annex No 2 to Decree No. 221 / 2004 Coll., establishing lists of dangerous chemicals and dangerous chemicals whose placing on the market is prohibited or whose placing on the market, circulation or use is restricted, as amended by Decree No. 109 / 2005 Coll. and Decree No. 78 / 2006 Coll., is amended as follows:
1. in Part I, points 48 to 51a are added:
'48. Toluene Cas No 108- 88-3 It shall not be placed on the market, put into circulation or used as a substance or as an ingredient of preparations in a concentration equal to 0,1% by mass as from 15 June 2007. or higher in adhesives and spray paints intended for sale to consumers. 49. Trichlorobenzene Cas No 120- 82- 1Shall not be placed on the market, put into circulation or used as a substance or constituent of preparations in a concentration equal to 0,1% by mass as from 15 June 2007. or higher for all uses except use - as an intermediate of synthesis, - as a solvent in the chlorination process in closed systems, or - in the manufacture of 1.3.5 - trinitro - 2.4.6 - triaminobenzene (TATB). 50. Polycyclic aromatic hydrocarbons (PAU) 1. Benz (a) pyrene (BaP) Cas No 50- 32- 8 2. Benz (e) pyrene (BeP) Cas No 192-97-2 3. Benz (a) anthracene (BaA) Cas No 56- 55-3 4. Chryzen (CHR) Cas No 218- 01-9 5. Benz (b) fluoranten (BbFA) Cas No 205- 99-2 6. Benz (j) fluoranten (BjFA) Cas No 205- 8- 3 7. Benz (k) fluoranten (BkFA) Cas No 207- 08- 9 8. Dibenz (a, h) anthracene (DBAHA) Cas No 53-70-31. The adjustment oils shall not be placed on the market, put into circulation or used in the manufacture of tyres or parts of tyres from 1 January 2010, if they contain: - more than 1 mg / kg BaP or - more than 10 mg / kg of the total quantity of all PAHs referred to in the second column. The limit shall be deemed to be complied with when the polycyclic aromatic (PCA) extract is less than 3% by mass, measured according to the IP346: 1998 Oil Institute Standard (Determination of PCA in unused lubricating oils and asphaltic-free petroleum fractions - method of refractive index of dimethylsulfoxide extract), provided that compliance with the limit values BaP and PAHs set out in the second column, as well as the relationship between measured values and PCA extract, are controlled by the manufacturer or importer every 6 months or after any major operational change that may affect compliance with the limits, whichever is the earlier. 2. Furthermore, tyres and retreading treads produced after 1 January 2010 may not be placed on the market or put into circulation if they contain adjustment oils exceeding the limits referred to in paragraph 1. For vulcanised rubber mixtures the limit of 0,35%, bay protons based on ISO 21461 measurements and calculations (vulcanised rubber - determination of oil flavourings in vulcanised rubber mixtures) shall be considered to comply with this limit. 3. Paragraph 2 shall not apply to retreaded tyres where the person placing on the market or putting into circulation shows that their tread does not contain adjustment oils exceeding the limits referred to in paragraph 1.51. The following phthalates: Di (2-ethylhexyl) phthalate (DEHP) Cas No 117- 81-7 EINECS No 204- 211- 0 Dibutyl phthalate (DBP) Cas No 84- 74-2 EINECS No 201- 557- 4 Benzyl butyl phthalate (BBP) Cas No 85- 68- 7 EINECS No 201- 622- 7 The restriction applies to these substances even if other CAS and EINECS numbers are not allowed to be used as substances or constituents of preparations at a concentration above 0,1% by mass as from 16 January 2007. in plasticised plastic materials for the manufacture of toys and childcare articles. Toys and childcare articles containing such phthalates at a higher concentration than the above value shall not be placed on the market. A childcare article means any product intended to facilitate sleeping, calming, hygiene, feeding or sucking children. 51a. The following phthalates: Diisononyl phthalate (DINP) Cas No 28553-12-0 and 68515-48-0 EINECS No 249-079-5 and 271-090-9 Diisodecyl phthalate (DIDP) Cas No 26761-40-0 and 68515-49-1 EINECS No 247- 977-1 and 271-091-4 Di (n-octyl) -phthalate (DNOP) Cas No 117-84-0 EINECS No 204-214-7 The restriction applies to these substances even if other CAS and EINECS numbers are not allowed to be used as substances or constituents of preparations at a concentration above 0,1% by mass as from 16 January 2007. soft plastic materials used in the manufacture of toys and childcare articles which children may put in their mouths. Toys and childcare articles containing such phthalates at a higher concentration than the above value shall not be placed on the market. A childcare article means any product intended to facilitate sleeping, calming, hygiene, feeding or sucking children. "
2. In point 1 of Part II, the current text in the second column is replaced by the word "vacant 'and the text in the third column is deleted.

Efficacy
This Decree shall take effect on 1 July 2006.
