GOVERNMENT REGULATION
of 3 July 2000
amending Government Regulation No 170 / 1997 Coll., laying down technical requirements for machinery, as amended by Government Regulation No 15 / 1999 Coll.
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll., ("the Act ') to implement Sections 11, 12 and 13 of the Act:
Čl. I
Government Decree No. 170 / 1997 Coll., laying down technical requirements for machinery, as amended by Government Decree No. 15 / 1999 Coll., is amended as follows:
1. in Article 1, the following paragraph 1 is inserted:
"(1) This Regulation lays down technical requirements for machinery in accordance with the law of the European Communities (1) and the international Treaty (2).
1) Directive 98 / 37 / EC of the European Parliament and of the Council of 22 June 1998 on the approximation of the laws of the Member States relating to machinery, as amended by Article 21 (1) of Directive 98 / 79 / EC of the European Parliament and of the Council.
2) Protocol to the Europe Agreement on Conformity Assessment and Acceptance of Industrial Products. '.
Paragraph 1 shall become paragraph 2 and paragraph 2 shall be deleted.
2. in Paragraph 1 (2) (c):
"(c) an interchangeable additional device which is a machine which modifies the function of machinery which is placed on the market for the purpose of connecting to, or operating, machinery or a number of different machinery or tractor, which is not a spare part or tool."
3. in Article 1 (2), point (d) is deleted;
4. the following paragraphs 3, 4, 5 and 6 are added to Article 1, including footnote 3:
"(3) For the purposes of this Regulation, a component which is not an replaceable additional device referred to in paragraph 2 (c) and which is placed on the market separately in order to perform a safety function when using it and whose failure or malfunction endangers the safety or health of persons.
(5) If the manufacturer or, where applicable, the authorised representative or importer does not provide for the conformity assessment referred to in Article 3, the assessment shall be made by the person who places the machinery or safety component on the market. The conformity assessment referred to in Article 3 shall also be carried out by those who assemble machinery or parts thereof or security components of different origins or produce machinery or safety components for their own use.
(6) The conformity assessment shall not be carried out or shall not be ensured if an interchangeable additional device [Paragraph 1 (2) (c)] is attached to the machinery or tractor, provided that these parts are compatible and conformity has been assessed for each of these parts constituting the assembled machinery, has been issued a declaration of conformity or has been bearing the CE marking (Section 5a). The designation CE3) concerns products originating in the Czech Republic or in the Member States of the European Community.
3) Government Decree No 291 / 2000 Coll., laying down the graphic form of the CE marking. '
5. Paragraph 2 (3) reads as follows:
"(3) Where a harmonised Czech technical standard (Section 4a of the Act) or a foreign technical standard transposing a harmonised European standard in the Member States of the European Community indicates one or more essential requirements for machinery and machinery are produced in accordance with that standard, the machinery thus manufactured shall be deemed to comply with the relevant essential requirements. ';
6. In Article 2, paragraphs 4 and 5 are added, including footnote 4:
"(4) Where the risks or risks for machinery or safety components referred to in this Regulation are contained, in whole or in part, in other government regulations specifying the risks or risks in question, then, as from the time of application of such regulations, those risks or risks for the machinery or safety components concerned shall not be covered by this Regulation or shall be waived from their application.
(5) Machinery of major electrical origin is subject to specific legislation (4)
4) Decree No. 168 / 1997 Coll., laying down technical requirements for low voltage electrical equipment, as amended by Decree No. 281 / 2000 Coll. '.
7. In the first line of Article 3 (1), the words "or authorised representative 'shall be inserted after the words" manufacturer'.
8. in Article 3 (1) (a), the words "or authorised representative" shall be inserted after the words "manufacturer."
9. in Article 3 (1) (b) and (c):
"(b) for machinery listed in Annex 4 to this Regulation, the characteristics of which do not comply with the technical standards referred to in Article 2 (3), or where such technical standards do not specify all the essential requirements which apply to the machinery in question or for which such technical standards do not exist, their manufacturer or authorised representative or importer shall, prior to placing on the market, provide for an assessment of the conformity of a sample of machinery (" EC type-examination ") by an authorised person (Article 12 (4) (b) of the Law) in accordance with Annex 5 to this Regulation,
(c) for machinery listed in Annex 4 to this Regulation, the characteristics of which comply with the technical standards referred to in Article 2 (3) which specify all essential requirements, the manufacturer and, where appropriate, the authorised representative or importer at their choice:
1. draw up the technical documentation referred to in Annex 3 to this Regulation and send it to an authorised person (Article 11 (1) of the Act), which shall confirm the receipt and archive of the technical documentation;
2. submit the technical documentation referred to in Annex 3 to this Regulation to an authorised person who shall verify that the technical standards referred to in Article 2 (3) have been correctly used by the manufacturer,, authorised representative or importer, as appropriate, and draw up a certificate of completeness and suitability for conformity assessment technical documentation; or
3. submit a sample of EC type-examination machinery as referred to in Annex 5 to this Regulation. ';
10. Paragraph 3 (2) is deleted.
Paragraph 3 shall become paragraph 2.
11. in Article 3 (2), the words "during the EC type-examination procedure referred to in Article 3 (1) (b) or (c) (3)" shall be inserted after the words "authorised person."
12. In Article 3, the following paragraph 3 is inserted after paragraph 2:
"(3) Where products are also subject to other government regulations relating to other essential requirements and also provide for the location of the CE marking or the issue of a declaration of conformity, the CE marking or the declaration of conformity shall also indicate compliance with the provisions of those other regulations of the Government. ';
13. in Paragraph 3 (4):
"(4) However, if one or more of these regulations are allowed by the Government to choose a conformity assessment procedure during a transitional period, the CE marking (§ 5a) or the declaration of conformity shall only indicate compliance with those regulations of the Government which have been applied. In this case, the references to the government regulations applied are in the documentation, instructions or instructions required by the government regulations and supplied with machinery. ';
14. In Article 3, the following paragraph 5 is added:
"(5) This Regulation shall not restrict the validity of technical regulations which contain the requirements necessary for the protection of persons and in particular workers when using the machinery or safety components concerned. In doing so, it is assumed that the method of adjusting the machinery or safety components used complies with the essential requirements of this Regulation. ';
15. The following Section 3a is inserted after Section 3:
„§ 3a
In the case of machinery [§ 1 (2) (a) and (b)] intended to be incorporated into another machinery or to be assembled with another machinery by the creation of machinery covered by this Regulation, the assessment of the conformity of its characteristics with the essential requirements shall not be carried out where the manufacturer or, where appropriate, the authorised representative or importer makes a declaration (§ 5 (3)). This provision shall not apply to machinery capable of a separate function [§ 1 (2) (a) and (b)], to replaceable equipment and safety components [§ 1 (2) (c) and (3)]. '

„§ 4
The evidence of the conformity assessment method used (Section 13 (8) of the Act) shall include the technical documentation set out in Annex 3 to this Regulation and, where appropriate, documents issued when assessing conformity by an authorised person. In cases resulting from Paragraph 13 (8) of the Act, the importer shall submit to the supervisory authority documentation in the official language of the country in which the product originates or in a language agreed with the supervisory authority. '
17. in Article 5 (1) (d), the words "harmonised Czech technical standards" shall be replaced by the words "technical standards referred to in Article 2 (3)"; in point (e), the words "authorised person" shall be inserted after the words "[referred to in Article 3 (1) (b) and (c)]";
18. in Article 5 (3), "[Annex 2 (s)]" is replaced by "(Article 3a)."
19. in Article 5 (3), the following point (e) is inserted after point (d):
"(e) a statement that machinery must not be put into service until a declaration of conformity of the machinery to which it is to be incorporated has been issued;"
Point (e) shall be renumbered as point (f).
20. The following Section 5a is inserted after Section 5:
„§ 5a
(1) For machinery originating in the Czech Republic or in the Member States of the European Community, the CE marking is placed on the product instead of issuing a declaration of conformity. The CE marking may be used on machinery [Sections 1 (2) (a) to (c)] when the EC declaration of conformity referred to in Annex 6 (1) has been issued for them. The CE marking shall not be used for the safety component (Paragraph 1 (3)) and shall be issued for the EC declaration of conformity in accordance with Annex 6 (3).
(2) The CE marking shall be placed on machinery clearly and visibly in accordance with point 1.7.3 of Annex 1 to this Regulation. It shall be prohibited for machinery to place marks which could mislead third parties as regards the meaning and presentation of the CE marking. Any other marking may be affixed to machinery only if the visibility and legibility of the CE marking are not thereby reduced. The CE marking shall cover only machinery referred to in § 5a (1).
(3) At trade fairs, exhibitions, demonstrations, etc., machinery or safety components which do not comply with the provisions of this Regulation may be operated provided that they are visibly marked with a warning of this non-compliance and a notice that they are not intended for sale until compliance with this Regulation has been ensured by the manufacturer and, where appropriate, by an authorised representative. During the demonstration, the necessary measures are provided to protect persons.
21. in Annex 1, the introductory provisions shall read as follows:
"(a) The essential health and safety requirements shall apply only if there is an appropriate risk to the machinery in question, under the conditions foreseen by the manufacturer when it is used. In any case, requirements 1.1.2, 1.7.3 and 1.7.4 shall apply to all machinery covered by this Regulation.
(b) The essential health and safety requirements laid down in this Regulation are binding. However, achieving the objectives identified by the essential requirements may not always be possible under the state of the art. In such a case, machinery must be designed and manufactured in such a way that these objectives are as close as possible.
(c) The essential health and safety requirements shall be grouped together according to the hazards involved. Machinery presents a series of hazards that may also be listed in several articles of this Annex. The manufacturer shall assess these hazards in such a way as to identify those applicable to his machine. ';
22. In Annex No 1, in the title in point 1, the words "FOR PROPOSAL AND PRODUCTION OF MACHINERY DEVICES 'are deleted.
23. In Annex 1, point 1.1.1 is inserted after point 1.1:
"1.1.1.
For the purposes of this Regulation, the following definitions shall also apply:
(a) any area within and around the machinery in which a person is exposed to a danger to his health and safety;
(b) any person at risk who is in a dangerous area or parts of the body intervenes in that area;
(c) by service, the person or persons who install, service, adjust, maintain, clean, repair or transport machinery. ';
24. In Annex 1, points 1.1.1 to 1.1.4 shall be renumbered as points 1.1.2 to 1.1.5.
25. in Annex No 1, point 1.1.2 (b), the words "or importer" shall be deleted, the words "construction" shall be replaced by the words "production"; in point 3, the words "the measures remain" shall be inserted after the words "alert to the need for special training," the words "specify" shall be replaced by the words "establish" and in point (c) the words "or the importer" shall be deleted.
26. In Annex 1, point 1.2.3, the words "one part of the trigger mechanism 'are replaced by the words" one single trigger device'.
27. in Annex 1, point 1.2.5 (b), the word "launch" is replaced by the word "movements."
28. In Annex 1, point 1.3.5, in the title and sentence, first after the word "multipurpose ', the word" combined' is inserted.
29. in Annex 1, point 1.3.8.2 (b), the words "locally controlled" are replaced by "remotely controlled."
30. in Annex 1, point 1.4.1 (e), the words "production process" are replaced by the words "production process monitoring."
31. in Annex 1, point 1.4.2.2 (a), the words "type A" shall be inserted after the words "type B";
32. In Annex 1, point 1.5.1, the following sentence is added at the end: "The specific legislation applicable to electrical equipment designed for use to a certain extent of voltage shall also apply to machinery intended for this voltage range. '.
33. In Annex 1, point 1.5.10, the words "harmless' are inserted after the words" reduced to 'and the words "as low as reasonably achievable' are deleted at the end of the sentence.
34. In Annex 1, point 1.5.14, the word "permit 'is replaced by" prevent' and the word "could 'is replaced by" could'.
35. In Annex 1, point 1.6.2, the sentence "Parts of machinery where persons are moving or standing shall be designed and manufactured in such a way as to avoid falls. 'is deleted.
36. In Annex 1, point 1.6.4, the words "there must be a possibility to carry it out 'are replaced by the words" it must be possible to carry it out'.
37. in Annex 1, point 1.6.5 reads:
"1.6.5. Machinery shall be designed and constructed in such a way that it is possible to clean the interior parts containing dangerous substances or preparations (or both) without the need to enter them and to allow the necessary unlocking from the outside. If it is not entirely possible to exclude access to machinery, structural measures shall be taken to allow cleaning to take place at a minimum risk. ';
38. In Annex 1, point 1.7.0, the word "tell-tales' is replaced by" devices' and the words "in particular they must correspond to the function and their number must not cause excessive psychological burden 'are deleted.
39. In the last sentence of point 1.7.2 of Annex 1, the dot is deleted and the following words are added: "and shall be supplemented, upon request, in the languages which the operator understands. '
40. in Annex 1, point 1.7.3, the following point (b) is inserted after point (a):
"(b) the CE marking for products originating in the Czech Republic or in the Member States of the European Community,"
Points (b), (c) and (d) shall be renumbered (c), (d) and (e).
41. in Annex 1, point 1.7.4 (a) (4), the words "installation or installation or both" shall be deleted, the words "assembly, dismantling," in paragraph 5, the words "instructions" shall be replaced by the words "instructions" and in paragraph 6, the words "tools included in the supply of machinery" shall be replaced by the words "tools to be connected to the machine."
42. In Annex 1, point 1.7.4 (b), the words "Instructions for use in the Czech language must be supplied together with the machinery." shall be replaced by the words "Instructions for use must be drawn up by the manufacturer or, where appropriate, by an authorised representative or importer in the Czech language or in one of the languages of the Member States of the European Community. When putting into service machinery shall be accompanied by a translation of the instructions in the language (s) of the country where the machinery is to be used and by instructions for use in the original language. This translation shall be drawn up either by the manufacturer or, where appropriate, by an authorised representative or importer or by a person placing machinery on the market in the language area concerned. Exemptions from this requirement shall consist of maintenance instructions intended for professionals employed by the manufacturer or authorised representative, as appropriate. This can only be written in the Czech language or one of the languages of the European Community which these workers understand. '
43. In Annex 1, point 1.7.4 (c), the word "diagrams' is replaced by" diagrams' and the text in brackets at the end of the sentence is deleted.
44. in Annex 1, point 1.7.4 (d), "Commercial literature" is replaced by "Any documentation."
45. in Annex 1, point 1.7.4 (e), 'species and quantities' is replaced by 'species and weight';
46. In the third sentence of point 1.7.4 (f) of Annex 1, the words "cannot be 'are replaced by the words" are not' and the words "harmonised Czech technical standards' are replaced by the words" technical standards referred to in Article 2 (3) '.
47. in Annex 1, point 1.7.4 (g), the words "or importer" shall be deleted;
48. in the first sentence of point 2.1 (a) of Annex 1, the words "parts of machinery" shall be replaced by the words "materials," the words "in contact" shall be replaced by the words "foodstuffs" and the words "sanitary" shall be replaced by "legal." In the second sentence, "parts' is replaced by" materials'.
49. In the first sentence of point 2.1 (c) of Annex 1, the words "assembly units must be designed 'are replaced by the words" assembly parts must be designed' and the second sentence is: "It should be made preferably by welding or continuous bonding '.
50. in Annex 1, point 2.2 (a), the words "grab or" shall be deleted;

52. 80. In Annex 1, point 4.2.1.3, the word "load 'is replaced by the word" load'.

84. In the first sentence of point 4.3.3 of Annex 1, the word "point 'shall be inserted after the words" set out in'; in the last sentence, the words "or supports' shall be deleted.
85. In Annex 1, point 4.4.2, first sentence, and in paragraph 1, point (a), the word "part 'is replaced by the word" point'.
86. In Annex 1, point 5.4, second sentence, the word "mechanical 'is replaced by" mechanised'.
87. In Annex 1, paragraph 5.6, the sentence "In the case of machinery containing highly flammable components, the machinery incorporated by the fire extinguishing system shall be replaced by the sentence" The provisions of paragraph 3.5.2 (b) shall be mandatory for machinery containing highly flammable parts. "
88. In Annex 1, point 6.1.1, the word "persons' is deleted.

95.In Annex 2 (i):
"(i) means of transport, such as vehicles and their trailers, aircraft and vessels, intended exclusively for the carriage of passengers by rail, road, air or water, as well as means of transport intended for the transport of goods by rail, road, air or water; vehicles used in the mining industry are not excluded; ';
96.In Annex 2 (l):
"(l) agricultural and forestry tractors. Agricultural or forestry tractor means any motor vehicle equipped with wheels or belts having at least two axles, the main function of which is the towing force and which is specially designed for the towing, pushing, carrying or propulsion of certain tools, machinery or trailers intended for agricultural or forestry use. It may be equipped to carry costs and persons. This Regulation shall apply only to tractors as defined in that definition which are fitted with tyres, having at least two axles and a maximum design speed of between 6 and 40 km / h, '.
97. In Annex 2, point (m), the words "or police or fire protection purposes' are replaced by the words" for or for the purpose of ensuring public order '.
98. In Annex 2, point (s) is deleted.
99. In Annex 3, the words "harmonised Czech technical standards' are replaced by the words" technical standards referred to in Section 2 (3) ', the words "harmonised Czech technical standard' are replaced by the words" technical standard referred to in Section 2 (3) '.
10. in Annex 3 (1) (e), the words "or authorised representative" shall be inserted after the word "manufacturer."
101. In Annex 3 (1) (f), in the second line after the word "manufacturer", the words "authorised representative" shall be added, and in the third line after the word "manufacturer," the words "authorised representative" shall be added. "
102. In Annex 3, the following sentence shall be added at the end of point 2: "The manufacturer or, where appropriate, the authorised representative or importer shall carry out the necessary assessments or tests on components, accessories or on complete machinery to ensure that the machinery, as designed and manufactured, is capable of safe installation and entry into service. 'and after point 2, the following points 3 and 4 are added:
"3) The documentation referred to in paragraph 1 may not be permanently available but shall be compiled and made available in due time. It does not need to contain detailed drawings or other details concerning the parts used in the manufacture of machinery, if their knowledge is not necessary to verify compliance with the essential requirements of the Government Regulation. For products originating in the Member States of the European Community, the said dossier shall be drawn up in one of the official languages of the European Community, with the exception of instructions for the use of machinery.
(4) Failure to submit documentation to a duly substantiated request by the supervisory authority (Paragraph 18 of the Act) may be sufficient to call into question the presumption of conformity of machinery with the requirements of this Regulation. '
103. In Annex 4, points 1.1, 1.2 and 1.3, the words "Circular saws' are replaced by the words" saw 'and in point 14, the word "universal' is replaced by the word" cross' and the word "part 'is replaced by the word" point'.
104. In Annex 5, the title reads:
"EC TYPE REVIEW '.
105. In Annex 5 (1), the words "type-examination 'are replaced by the words" EC type-examination'.
106. In Annex 5 (2), the first sentence is replaced by the following: "Application for EC type-examination by the manufacturer or, where applicable, the authorised representative or importer, shall include: '. in point (a), the word" importer' is replaced by "authorised representative ';
107. In Annex 5 (2) (b), the word "or, where appropriate," shall be inserted after the word "supplemented."
