laying down the procedure for the national committees to sell apartments for personal ownership
The Government of the Czech Republic orders pursuant to § 14 paragraph 2 of Act No. 52 / 1966 Coll., on Personal Property to Houses, as amended by Act No. 30 / 1978 Coll.:
§ 1
(1) Personal property shall be sold to apartments as well as non-residential rooms (hereinafter referred to as "flats') intended for the personal use of citizens who are State-owned and for whom the right of management is exercised by the local national committee or housing organisation, namely:
(a) new state housing,
(b) already used and released;
(c) the personal use of citizens who have applied for them.
(2) (1) apartments in demolition houses, nursing homes, barrier-free apartments and apartments in houses which have become wholly owned under the special regulation.2)
(3) The number of flats from the new state housing to be sold to citizens is determined by the district national committees and by the National Committee of Prague in the capital of Prague.
(4) The local national committees shall keep an overview of citizens seeking to purchase the apartments referred to in paragraph 1 (a) and (b).
(5) Where the number of candidates exceeds the number of flats referred to in points (a) and (b) of paragraph 1 that can be sold, the local national committees shall select candidates for individual apartments; taking into account the housing needs of interested parties and giving priority to young and incomplete families who undertake to modernise flats in older buildings. A young family shall be considered a family in which neither spouse has exceeded 35 years of age; an incomplete family shall be considered to be a family made up of a single parent with at least one minor child under his own care.
§ 2
Local national committees or housing organisations which exercise the right to manage apartments shall not conclude sales contracts with citizens who have the right to use the apartment and have applied for it in respect of the apartments referred to in Article 1 (2).
§ 3
For the sale of commercial apartments, military apartments, apartments of the Ministry of Interior or of the members of the Department of Correctional Education for which the right of management is exercised by local national committees or housing organisations, the approval of the organisation which manages such apartments or of the military administration or authority of the Ministry of Interior or of the Ministry of Justice shall also be required.
§ 4
For the sale of apartments in houses which are cultural monuments, prior agreements of the local national committee or housing organisation with the competent authority of the state conservation are needed.
§ 5
This Regulation shall enter into force on the day of its publication.
