DECLARATION
of 1 November 2019
on tests of doctors, dentists and pharmacists and amending Decree No. 188 / 2009 Coll., on the test test, the final test of the certified course and the procedure for verifying the knowledge of the Czech language by interview of doctors, dentists and pharmacists (on tests of doctors, dentists and pharmacists), as amended by Decree No. 118 / 2018 Coll.
The Ministry of Health ("the Ministry ') provides, pursuant to § 37 (1) (f) and (l) of Act No. 95 / 2004 Coll., on the conditions for obtaining and recognising professional competence and specialised competence for the exercise of the medical profession of physician, dental practitioner and pharmacist, as amended by Act No. 189 / 2008 Coll. and Act No. 67 / 2017 Coll., (" the Act'):
BASIC PROVISIONS
This decree regulates
(a) the composition of the examination committee for:
1. test after completion of primary school education,
2. final test of the superstructure;
3. the final test of the functional course; and
(b) Test schedule
1. post-primary school examinations,
2. testing tests;
3. final tests of superstructure;
4. final examinations of the functional course.
TEST AFTER DISCONTINUATION OF EDUCATION IN THE BASIC TRIBE
Trial panel for post-primary-school examination
(1) The examination committee for a given examination date after completion of the basic tribe shall have at least 3 members selected for that examination date by the mandated organisation or its medical faculty, if the mandated organisation has multiple medical faculties, from the list of examiners for the test after completion of the basic strain. At least 1 of the members of the Examination Board shall not be in employment relationship with the health service provider for which the examination after the completion of the training in the base tribe takes place and shall not be in employment relationship with the entrusted organisation or its medical faculty which provides the examination after completion of the training in the base tribe. A maximum of 1 member of the examination committee in accordance with the second sentence may take part in the examination after completion of the training in the base tribe in a distance manner using teleconferencing services. A member of the test committee participating in the distance shall not be chairman of the test committee and his signature on the test report shall be ensured retrospectively, by sending through the postal operator or by electronic means after the test.
(2) The examiner appoints and rescues the Minister of Health on a proposal from the Czech Medical Chamber or the Czech Pharmacy Chamber, professional companies and designated organisations. By 1 December, the Ministry shall publish on its website a list of examiners for the following calendar year, including information on who proposed the examiner. In case of appointment or removal of the examiner during the calendar year, the Ministry shall publish an updated list of examiners without undue delay. The list of investigators and its updated version shall also be made available by the Ministry within the same time limit in the Administration system.
(3) The members of the examination committee shall elect the chairman of that panel for the term of the examination after completion of the primary school. The President may be elected twice. If the latter fails to elect a chairman, it shall be determined by drawing lots. The Chairperson shall direct and be responsible for the work of the Examination Board.
Application for a test after completion of primary school education
(1) The applicant shall submit an application for a post-education examination to the Ministry's base tribe or, where appropriate, to the organisation, no later than 60 days before the date of its completion. The applicant shall submit an application for a test after completion of the training in the base tribe electronically via the Administration system.
(2) The statutory body of the accredited establishment or employer may, in case of doubt as to the course of specialisation training, request the opinion of all trainers in the relevant field who participated in the training in the basic tribe of the applicant.
(3) Where a professional practice or part thereof has been counted, completed in another core tribe or, abroad or in an unaccredited workplace, or part of the study period completed in the doctoral study1), the Ministry or the delegated organisation shall enter this information electronically into the Administration system.
(4) All the requirements laid down in the Ordinance governing education in the basic2 are fulfilled. In order to assess compliance with these requirements, the provisions of Act No. 95 / 2004 Coll. shall apply mutatis mutandis to the assessment of requirements for accession to the test.
Date and place of examination after completion of primary education
(1) The examination after completion of education in the base tribe shall take place at the dates set by the organisation or its medical faculty, if the organisation has multiple medical faculties, for each basic group. Each delegated organisation or each of its medical faculties, if the mandated organisation has multiple faculties, shall specify the number of dates for the baseline tribe according to the expected number of candidates for the completion of the examination after completion of the basic tribe education, based on the data of the Administration system.
(2) The dates and places of the post-school examinations for the following calendar year will always be published by the Ministry on its website by 31 December. The dates and places of examinations after completion of primary school are available in the Administration system. If the Ministry does not receive the testing dates for the following calendar year referred to in paragraph 1 by 30 November, it shall set the dates on its own initiative in accordance with the conditions referred to in paragraph 1.
(3) The post-school examination in the base tribe shall take place at the place of work of the entrusted organisation or in an accredited establishment designated by the Ministry or, where appropriate, by the authorised organisation. The Ministry or, where appropriate, the designated organisation shall determine the place of the examination after completion of the training at the base tribe and shall confirm it together with a deadline of at least 30 calendar days prior to the date of its performance to all tenderers who have submitted an application pursuant to § 3 and have complied with the requirements laid down in the Ordinance governing the training in the basic tribes). Candidates who have fulfilled the requirements laid down in the Ordinance governing basic school education until after the application for the post-basic school examination referred to in Article 3 no later than 30 calendar days before the date of its holding, the Ministry or, where applicable, its mandated organisation or its medical faculty, if more than one medical faculty has a delegated organisation, shall determine the place of the examination after completion of the basic school education and shall confirm it together with the date of its holding to that candidate at least 20 calendar days before the date of the primary school examination. Confirmation of the date and place of the examination after completion of the basic tribe education, including compliance with all requirements, shall be recorded by the Ministry or, where appropriate, by an authorised organisation electronically via the Administration system.
(4) The Ministry or, where appropriate, the designated organisation shall inform the members of the examination committee of the date and place of the examination after completion of the training in the base tribe. The Ministry shall cancel the examination if, within 60 calendar days of the date of the examination, at least 1 tenderer in the relevant base tribe does not apply.
Content and course of the post-primary education examination
(1) The Ministry or, where appropriate, the designated organisation shall publish on its website a list of test subjects and recommended literature for testing after completion of the basic strain training for each base strain valid for the following calendar year by 31 December. The Ministry shall also make available the list of test circuits and recommended literature for the post-education examination in the base tribe within the same time limit in the Administration system.
(2) The content of the post-primary examination is laid down in the Ordinance governing primary education (2).
(3) The post-school examination in the base tribe is accessible to health practitioners (3), to Ministry staff and to the administrative staff of the entrusted organisation, with the exception of consulting on the outcome of an examination which is non-public and which is attended only by members of the examination committee and the staff of the entrusted organisation which is responsible for carrying out the examination, and, where appropriate, by the staff of the Ministry. The Chairman of the Examination Board may refer to a health professional who is interfering with the proper conduct of the examination after completion of the basic strain training, after prior notice, from the place where the test is conducted.
(4) Before the start of the test after the completion of the basic group, the tenderer shall prove his identity before the commission and shall provide proof of payment of the costs associated with his organisation, unless the first date of the examination after the completion of the basic group. An entry in the test report shall be made on the submission of the identity document and the proof of payment of the costs associated with the organisation of the examination after completion of the training in the base strain.
(5) The test after completion of the primary tribe education is practically focused and consists of 3 separate test circuits. After winning the test circuits, the test panel shall provide the candidate with a reasonable time to prepare the response, but not less than 30 minutes.
(6) In the event that, during the post-school examination at the base tribe, the response within 1 of the test circuits was insufficient, but the candidate failed to demonstrate a fundamental ignorance, the examination committee may ask the candidate a supplementary question for which the time for preparing the response is not provided. A supplementary question can only be asked once throughout the post-primary school examination. The text of the supplementary question shall be recorded in the test report.
Evaluation of post-primary school examinations
(1) The test after completion of primary education is assessed as a result of "benefit" or "benefit".
(2) The examination committee shall decide on the outcome of the examination after completion of the training at the base tribe by voting. In the event of a decisive vote, the President of the Commission shall vote.
(3) The examination committee, after consulting on the outcome of the post-education examination in the base tribe, will declare its evaluation. The assessment shall be recorded in the test report. The chair of the Examination Board or a committee member appointed by him shall only record on the certificate of competence a successfully completed examination after completion of the training in the base tribe.
Non-participation in the test after completion of primary school and withdrawal from the test after completion of primary school
(1) If the candidate is unable to attend the examination after the completion of the training at the base tribe by the date for which he was invited, the Ministry or, where appropriate, the entrusted organisation may excuse his non-participation. An apology is considered
(a) a written apology received by the Ministry or, where appropriate, by an authorised organisation prior to the date of completion of the examination after the completion of the training in the base tribe;
(b) in the event of a serious reason, a written apology sent to the Ministry or, where appropriate, to the organisation responsible, within 5 working days of the date of completion of the examination after the completion of the basic training.
(2) Apology shall be made electronically through the Administration system.
(3) If the tenderer has apologized or has withdrawn from the examination after the completion of the training in the base strain before the start of the training, he may apply for the examination after the completion of the training in the base strain as soon as possible, if possible for organisational reasons; the period referred to in Article 3 (1) does not apply.
(4) If the tenderer withdraws from the examination after the completion of the training in the base tribe after or during the start of the training, the test after the completion of the training in the base tribe shall be assessed as "non-profit-making '.
(5) If the candidate does not show up for the test after the end of the basic tribe education without an apology, the test after the end of the basic tribe education shall be assessed as a "no benefit 'test.
ATESTATION TEST
Application to the test
(1) The applicant shall submit an application for an attestation test to the Ministry or, where appropriate, to the organisation, no later than 60 days before the date of its performance. The applicant submits an application for the test procedure electronically through the Administration system.
(2) The statutory body of an accredited establishment or employer may, in case of doubt as to the course of specialisation training, request the opinion of all trainers in the relevant field who participated in the specialisation training of the tenderer.
(3) Where a professional practice or part thereof has been included in another field of specialisation or, abroad, or in an unaccredited workplace, or part of the study period completed in a doctoral study1), the Ministry or a delegated organisation shall enter this information electronically into the Administration system.
(4) Where the training programme provides that a written work is to be carried out in the theoretical part of the test, the applicant shall add to the application for the test test 2 a written work by electronic means through the Administration system and the defence of the test is always part of the test. The Ministry and, where appropriate, the designated organisation shall ensure that an opposing opinion is drawn up. The written work and its assessment shall be filed together with the test report.
Date and place of the test
(1) The test shall take place at the dates specified by the organisation or its medical faculty, if the organisation has multiple medical faculties, for each field of specialisation. The mandated organisation or its medical faculty, if the mandated organisation has multiple medical faculties, shall determine the dates and places of the tests of doctors so that the attestations of the relevant specialisation field do not provide the same organisation or its medical faculty in two consecutive periods in one calendar year, if the mandated organisation has multiple medical faculties. The mandated organisation or its medical faculty, if the mandated organisation has multiple medical faculties, shall determine for the relevant calendar year the number of dates and testing tests for each field of specialisation training according to the expected number of candidates for the test examination, based on the data of the Administration system. The mandated organisation or medical faculty, if the mandated organisation has more than one medical faculty, shall set in total at least 2 dates for the tests in each specialisation field during one calendar year.
(2) The dates and places of the tests for the following calendar year will be published by the Ministry on its website by 31 December. The dates and places of the tests are published in the Administration system within the same time limit. Where the Ministry has not received a list of test dates for the following calendar year in accordance with paragraph 1 by 30 November, it shall set the dates in accordance with the conditions referred to in paragraph 1.
(3) The Ministry or, where appropriate, the designated organisation, shall determine the place of the test and confirm it together with the date of its performance or parts thereof, at least 30 calendar days before the date of the test or the first part thereof, to all tenderers who have submitted an application pursuant to § 8 and have complied with the requirements laid down in the Ordinance governing education in the basic2) and the relevant training programme. Candidates who have fulfilled the requirements laid down in the Ordinance governing basic education and the relevant training programme only after the application for an attestation test referred to in Section 8 no later than 30 calendar days before the date of the test examination or parts thereof, the Ministry, or the designated organisation or its medical faculty, if any, if the approved organisation has more than one medical faculty, shall determine the place of the test examination and confirm it together with the date of its performance or parts of it at least 20 calendar days before the date of the test. Confirmation of the date and place of the test, including compliance with all requirements, shall be recorded by the Ministry or, where appropriate, by an authorised organisation electronically via the Administration system.
(4) The Ministry or, where appropriate, the designated organisation shall inform the members of the Technical Attestation Committee of the date and place of the test or parts thereof. The Ministry shall cancel the examination if, within 60 calendar days of the date of the examination, at least 1 candidate in the relevant field does not apply.
Content and course of the test
(1) The Ministry or, where appropriate, the designated organisation shall publish on its website a list of test questions and recommended literature for the test in each field in force for the following calendar year by 31 December. The Ministry shall also make available the list of test questions and recommended literature for the test test within the same time limit in the Administration system.
(2) The test shall be accessible to health practitioners (3), to the staff of the Ministry and to the staff of the competent bodies responsible for the administrative conduct of the examination, with the exception of advice on the outcome of the examination or part thereof, which is non-public and which are only attended by members of the committee of inquiry and staff of the organisation responsible for the administrative conduct of the examination and, where appropriate, by the staff of the Ministry. The Chairman of the Commission may refer the medical practitioner who is interfering with the proper conduct of the test.
(3) Before starting the test, the tenderer shall demonstrate his identity before the test committee and shall provide proof of payment of the costs associated with the organisation of the relevant part of the test. An entry in the test report shall be made on the presentation of the identity document and the proof of payment of the costs associated with the organisation of the relevant part of the test. If a multi-part test is carried out, identification may be required for each part.
(4) The test consists of a part theoretical and, if provided for in the curriculum, a part practical. Where the training programme provides that a test is part of the theoretical part of the test, the theoretical part of the test and oral part shall be composed of the test and the test shall be preceded by the oral part. The test is not attended by a trainer or a designated doctor, dentist or pharmacist.
(5) No more than 1 member of the examination committee may participate in the oral part of the theoretical part of the testing examination in a distance using teleconferencing services. A member of the test committee participating in the distance shall not be chairman of the test committee and his signature on the test report shall be ensured retrospectively, by sending through the postal operator or by electronic means after the test.
Practical part of the test
(1) If the testing test includes a practical part, its content is determined by the training programme of the specialisation and testing tests.
(2) The practical part of the test shall be held in an accredited establishment designated by the Ministry or by an authorised organisation and shall be preceded by theoretical parts of the test.
(3) For the practical part of the test, at least 1 member of the test committee and the instructor of the accredited establishment in which the practical part of the test test is carried out shall be present.
Theoretical part of the test
(1) The theoretical part of the test test shall be treated by the tenderer within 60 calendar days of the practical part of the test test, unless the practical part is part of the test examination, unless the training programme provides otherwise.
(2) If the theoretical part of the test involves the test, the test shall be performed on the day of the theoretical part of the test.
(3) The content of the test is determined by an educational programme for the relevant field of specialisation and testing tests.
(4) The oral part of the theoretical part of the testation examination consists in answering 3 professional questions, 1 of which is replaced by the defence of written work if written work on the basis of the curriculum is part of the theoretical part of the testation examination. Written work may be replaced by an expert article published in a reviewed journal, if the candidate is the first or the corresponding author; in that case, no expert opinion under this decree shall be drawn up for written work.
(5) Questions from the oral part of the theoretical part of the test run shall be drawn up by the candidate and recorded in the test report. Once the questions have been drawn, the testing committee shall give the candidate a reasonable time to prepare the answers, but at least 30 minutes.
(6) The subject of written work shall be awarded to the applicant by the instructor from an accredited establishment in which the applicant has carried out specialist training in the field of examination at the time of inclusion in the field or in which he has carried out specialist training in the field of examination as the first one, unless at the time of inclusion in the field of examination he has carried out specialist training in the field of examination. The written work produced will be approved by the instructor from an accredited establishment in which the candidate has carried out specialist training in the field of examination as last.
(7) In the event that, in the oral part of the theoretical part of the test, the answer to one of the winning questions or the defence of the written work was insufficient, but the applicant failed to demonstrate the essential ignorance, the test committee may ask the applicant a supplementary question for which the time for preparing the answer is not provided. The additional question can only be asked once throughout the oral part of the theoretical part of the test. The text of the supplementary question shall be entered in the test report.
(8) The candidate is familiar with the opponent's assessment prior to the theoretical part of the test. The test shall be carried out even if the opponent has reservations about the written work or does not recommend its defence.
Evaluation of the test procedure
(1) The individual parts of the test and its overall result are assessed by the result of "benefit" or "benefit".
(2) If the practical part of the test test is evaluated by the result "failed ', the theoretical part of the test test is not accepted, and the test is evaluated by the result" failed'.
(3) If the test is part of the theoretical part of the test and the candidate does not get at least 70% of the possible maximum points in the test, the test shall be assessed as "failed 'and the oral part shall not be accepted. The theoretical part is evaluated by the result" failed' and the test is evaluated by the result "failed '.
(4) If the theoretical part of the test report or the oral part of the test report is evaluated by the result "failed ', the test report shall be evaluated by the result" failed'.
(5) Successfully composed practical part of the test or test, if part of the theoretical part, the tenderers shall be recognised if the theoretical part of the test or test is successfully carried out within 2 years of the date of completion of the practical part.
(6) The Commission shall decide on the result of the test or part thereof by voting. In the event of a decisive vote, the President of the Commission shall vote.
(7) After consulting the Committee on Attestation on the result of the test, it will declare its overall evaluation of the test. The evaluation of individual parts of the test and the overall evaluation of the test shall be recorded in the test report. The Chairman of the Committee on Attestation, or a member of the Committee appointed by him, shall only record the successfully completed test on the expert certificate.
Non-participation in the test and withdrawal from the test
(1) If the candidate cannot attend the test or part of the test within the time limit for which he was invited, the Ministry or, where appropriate, the entrusted organisation may excuse its non-participation. An apology is considered
(a) a written apology received by the Ministry or, where appropriate, by an authorised organisation before the date of the test or part thereof; or
(b) in the case of a serious reason, a written apology sent to the Ministry or, where appropriate, to the entrusted organisation within 5 working days of the date of the test or part thereof.
(2) Apology shall be made electronically through the Administration system.
(3) If the candidate has apologized or has withdrawn from the practical part or theoretical part of the test and, where applicable, from the test or oral part, if they are part of the theoretical part before the start of the test, he may apply for the test test as soon as possible for organisational reasons; the period referred to in Article 8 (1) does not apply.
(4) If the tenderer withdraws from the practical part or theoretical part of the test or, where appropriate, from the test or oral part of the theoretical part after they have begun or continue, that part shall be assessed as having "failed 'and the test shall be assessed as" failed'.
(5) Candidates who have successfully performed a practical part of the test or test if they are part of the theoretical part of the test and have apologized from the theoretical part of the test or oral part of the test or oral part of the test are recognised if the theoretical part of the test or test test is performed within 2 years from the date of the practical part of the test.
(6) If the candidate does not show up for the test test or part thereof without an apology, the test test shall be assessed as a result of "failed '.
FINAL TESTING OF THE CONFORMITY
Test panel for final test of superstructure
(1) The examination committee for a given term of the final examination of the superstructure shall have at least three members selected by the designated organisation from the list of examiners for the final examination of the superstructure, one of which shall always be a member of the relevant accreditation committee. A maximum of 1 member of the examination committee according to the first sentence may participate in the final examination of the superstructure in a distance manner using teleconferencing services. A member of the test committee participating in the distance shall not be chairman of the test committee and his signature on the test report shall be ensured retrospectively, by sending through the postal operator or by electronic means after the test. Where the training programme provides that the final examination of the superstructure also includes a practical part, at least 1 of the members of the examination committee shall not be in the employment relationship with the health service provider for which the practical part of the final examination of the superstructure is carried out and at the same time not in the employment relationship with the entrusted organisation.
(2) The examiner appoints and discloses the Minister of Health on a proposal from the Czech Medical Chamber, the Czech Dentist Chamber or the Czech Pharmacy Chamber, professional companies and entrusted organizations and on a proposal from the Ministry of Labour and Social Affairs and the Czech Social Security Administration. The Minister for Health shall always appoint as examiner at least one person who is also a member of the relevant accreditation committee. The Ministry shall publish on its website a list of examiners for the following calendar year by 1 December. In case of appointment or removal of the examiner during the calendar year, the Ministry shall publish an updated list of examiners without undue delay. The list of investigators and its updated texts shall also be made available by the Ministry within the same time limit in the Administration system.
(3) The members of the examination committee shall elect the chairman of the panel, who shall direct the hearing and be responsible for its activities, for the term of the final examination of the superstructure. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
Application for the final test of the superstructure
(1) The applicant shall submit an application for the final test of the superstructure industry to the Ministry or, where appropriate, to the organisation, no later than 60 days before the date of its performance. The applicant submits an application for the final test of the superstructure industry electronically through the Administration system.
(2) The statutory body of the accredited establishment or employer may, in doubt of the course of training in the superstructure sector, request the opinion of all trainers in the relevant field who participated in the training of the tenderer.
(3) Where the applicant has been counted as a professional practice, or part thereof, in the field of specialisation education, in another superstructure or, abroad, or in an unaccredited workplace or part of the study period completed in the doctoral study1), the Ministry or the entrusted organisation shall enter this information electronically into the Administration system.
(4) Where the training programme provides that a written work is to be carried out as part of the final examination of the superstructure, the applicant shall add a copy of the written work to application 2. The Ministry and, where appropriate, the designated organisation shall ensure that an opposing opinion is drawn up. The written work and its assessment shall be filed together with the protocol on the final test of the superstructure.
Date and place of the final examination of the superstructure
(1) The final test of the superstructure shall take place at the dates set by the designated organisation for each superstructure; the designated organisation shall set at least two dates for each extension in the relevant calendar year.
(2) The dates and places of the final tests of the superstructure for the following calendar year will be published by the Ministry on its website by 31 December. If the Ministry does not receive the test dates by 30 November, it shall set the dates on its own initiative in accordance with the conditions referred to in paragraph 1. The dates and places of the final tests of the superstructure are available in the Administration system.
(3) The Ministry or, where appropriate, the designated organisation shall determine the place of the final examination of the superstructure and, together with the date of the performance, confirm them at least 30 calendar days before the date of the final examination of the superstructure, to all tenderers who have submitted an application pursuant to Article 16 and have complied with the requirements of the relevant training programme. A candidate who has fulfilled the requirements of the relevant training programme only after filing an application for the final test of the superstructure in accordance with Section 16 no later than 30 calendar days before the date of the final examination of the superstructure, the Ministry or the designated organisation, shall determine the place of the final examination of the superstructure and confirm it together with the date of its completion at least 20 calendar days before the date of the final examination of the superstructure. Confirmation of the date and place of the final examination of the superstructure, including compliance with all requirements, shall be recorded by the Ministry or, where appropriate, by an authorised organisation electronically through the Administration system.
(4) The Ministry or, where appropriate, the designated organisation shall inform the members of the examination committee of the date and place of the final examination of the superstructure. The Ministry shall cancel the examination if, within 60 calendar days before the date of the final examination of the superstructure field, at least 1 candidate in the respective superstructure field does not apply.
Content and course of the final test of the superstructure
(1) The Ministry or, where appropriate, the designated organisation shall publish on its website a list of test questions and recommended literature for the final test of the superstructure for each superstructure in force for the following calendar year by 31 December. The Ministry shall also make available the list of test questions and recommended literature for the final test of the superstructure within the same time limit in the Administration system.
(2) The final examination of the superstructure is accessible to healthcare professionals (3), to the staff of the Ministry, and to the staff of the entrusted organisation which administratively carry out the examination, with the exception of a consultation on the outcome of the examination or part thereof, which is not public and which is attended only by members of the examination committee and by the staff of the entrusted organisation which administratively carry out the examination and, where appropriate, by the staff of the Ministry. The chairman of the panel may refer to a medical worker who is disrupting the proper conduct of the final examination of the superstructure after prior notice from the place where the test is conducted.
(3) Before the beginning of the final examination of the superstructure, the applicant shall demonstrate his identity before the examination committee and provide proof of payment of the costs associated with the organisation of the relevant part of the final examination of the superstructure. An entry in the test report shall be made on the submission of the identity document and the proof of payment of the costs associated with the organisation of the relevant part of the final test of the superstructure. If the final test of the superstructure is composed of several parts, identification may be required for each part of the superstructure.
(4) The final test of the superstructure is made up of a theoretical part and, if provided for in the curriculum, a practical part. If a test is part of the final test of the superstructure, the theoretical part of the final test of the superstructure shall consist of the test and the oral part, the test being preceded by the oral part. The test is not attended by a trainer or a designated doctor, dentist or pharmacist.
Practical part of the final test of the superstructure
(1) If the final test of the superstructure involves the practical part, its content is determined by the training programme of the superstructure of the test.
(2) The practical part of the final examination of the superstructure shall be held in an accredited establishment designated by the Ministry or by an authorised organisation and shall be preceded by theoretical parts of the final examination of the superstructure.
Theoretical part of the final test of the superstructure
(1) The theoretical part of the test shall be approached by the tenderer no later than 60 calendar days after the practical part of the test is passed, if the practical part is part of the final test of the superstructure.
(2) If the theoretical part of the test involves the test, the theoretical part of the final test of the superstructure shall be carried out on the day of the theoretical part of the test.
(3) The content of the test is determined by the training programme for the respective extension.
(4) The oral part of the final examination of the superstructure is the answer to 3 professional questions, 1 of which is replaced by the defence of written work if written work on the basis of the curriculum is part of the examination. Written work may be replaced by an expert article published in an impacted journal, if the candidate is his only or first author.
(5) Questions from the oral part of the theoretical part of the test shall be drawn up by the candidate and recorded in the report on the final test of the superstructure. Once the questions have been drawn, the examination committee shall give the candidate a reasonable time to prepare the answers, but at least 30 minutes.
(6) The subject of the written work shall be awarded to the applicant by the instructor from an accredited establishment in which the applicant has carried out the training in the superstructure field of the examination at the time of inclusion in the superstructure or, as the first one, has carried out the training in the superstructure field of the examination, unless at the time of inclusion in the superstructure field of the test. The written work carried out must be agreed by the instructor from the accredited establishment in which the candidate has completed the training in the extension field as last.
(7) If, in the oral part of the theoretical part of the final examination of the superstructure, the answer to any of the questions submitted or the defence of the written work was not sufficient, but the candidate has not demonstrated the essential ignorance, the examination committee may ask the candidate a supplementary question, which is not the time for preparing the reply. The additional question may be asked only once throughout the oral part of the final examination of the superstructure. The text of the supplementary question shall be recorded in the test report.
(8) The candidate is familiar with the opponent's assessment prior to the theoretical part of the final test of the superstructure. The final test of the superstructure shall be carried out even if the opponent has reservations about the written work or does not recommend its defence.
Evaluation of the final test of the superstructure
(1) The individual parts of the final test of the superstructure and its overall result are assessed by the result of "benefit" or "benefit".
(2) If the practical part of the final test of the superstructure is evaluated by the result "failed ', the theoretical part of the final test of the superstructure is not accepted and the final test of the superstructure is evaluated by the result" failed'.
(3) If a test is part of the theoretical part of the final test of the superstructure, and the candidate does not obtain at least 70% of the possible maximum points in the test, the test shall be assessed as a result of "failed 'and the oral part shall not be accepted. The theoretical part is evaluated by the result of" failed' and the final test of the superstructure is evaluated by the result of "failed '.
(4) If the theoretical part of the final test of the superstructure or its oral part is evaluated by the result "failed ', the final test of the superstructure is evaluated by the result" failed'.
(5) Successfully composed practical part of the final test of the superstructure or test, if it is part of a theoretical part, shall be recognised if the successful completion of the theoretical part of the final test of the superstructure occurs within 2 years from the date of the practical part.
(6) The examination committee shall decide on the outcome of the final examination of the superstructure or part thereof by voting. In the event of a decisive vote, the President of the Commission shall vote.
(7) After consulting on the outcome of the final examination of the superstructure, the panel will announce an overall evaluation of the final examination of the superstructure. The evaluation of each part of the final test of the superstructure and the overall evaluation of the final test of the superstructure shall be recorded in the test report. The chairman of the examination committee or the committee member appointed by him shall only record the successful completion of the final examination of the superstructure.
Non-participation in the final test of the superstructure and withdrawal from the final test of the superstructure
(1) If the applicant cannot attend the final test of the superstructure or part of the superstructure within the time limit for which he was invited, the Ministry or, where appropriate, the entrusted organisation may excuse his non-participation. An apology is considered
(a) a written apology received by the Ministry or, where appropriate, by an authorised organisation before the date of the final examination of the superstructure or part thereof; or
(b) in the case of a serious reason, a written apology sent to the Ministry or, where appropriate, to the organisation, within 5 working days of the date of the final examination of the superstructure or part thereof.
(2) Apology shall be made electronically through the Administration system.
(3) If the tenderer has apologized or has withdrawn from the practical part or theoretical part of the final test of the superstructure or, where applicable, the oral part, if they are part of the theoretical part, before their start, he may apply for the final test of the superstructure within the following time limit, if possible for organisational reasons; the period referred to in Article 16 (1) does not apply.
(4) If the tenderer withdraws from the practical part or theoretical part of the final examination of the superstructure or, where applicable, from the test or oral part of the theoretical part after they have begun or continue, the latter shall be assessed as having "failed 'and the final test of the superstructure shall be evaluated as" failed'.
(5) Candidates who have successfully completed the practical part of the final test of the superstructure or test if they are part of the theoretical part of the final test of the superstructure and have apologized from the theoretical part of the final test of the superstructure or its oral part, the practical part or test is recognised if the theoretical part of the final test of the superstructure is performed within 2 years of the practical part of the final test of the superstructure.
(6) If the candidate does not show up for the final test of the superstructure or part of it without an apology, the final test of the superstructure or part of it shall be assessed as having "failed '.
FINAL TEST OF THE FUNCTION KURSE
Test panel for the final test of the functional course
(1) The examination committee for the date of the final examination of the functional course shall have at least three members selected by the designated organisation from the list of examiners for the final examination of the functional course. A maximum of 1 member of the examination committee, according to the first sentence, may attend the final examination of the functional course in a distance using teleconferencing services. A member of the test committee participating in the distance shall not be chairman of the test committee and his signature on the test report shall be ensured retrospectively, by sending through the postal operator or by electronic means after the test. Where the training programme provides that the final examination of the functional course also includes a practical part, at least 1 of the members of the examination committee shall not be in employment relationship with the health service provider for which the practical part of the final examination of the functional course is conducted, and at the same time not in employment relationship with the entrusted organisation which provides the final examination of the functional course.
(2) For the final examination of the functional course, the examiner appoints and rescues the Minister of Health on a proposal from the Czech Medical Chamber, the Czech Dental Chamber or the Czech Pharmacy Chamber, professional companies and entrusted organisations, and is a condition of inclusion in the functional course of a special specialised competence in the field of assessment medicine or of the content of the educational programme of the extension field of assessment medicine, also on the proposal of the Ministry of Labour and Social Affairs and the Czech Social Security Administration. By 1 December, the Ministry shall publish on its website a list of investigators for the final examination of the functional course for the following calendar year. In case of appointment or removal of the examiner during the calendar year, the Ministry shall publish an updated list of examiners without undue delay. The list of investigators and its updated texts shall also be made available by the Ministry within the same time limit in the Administration system.
(3) The members of the examination committee shall elect the chairman of the panel for the term of the final examination of the functional course and shall be responsible for its activities. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
Application for the final test of the functional course
(1) The applicant shall submit an application for the final examination of the functional course to the Ministry or, where appropriate, to the entrusted organisation, not later than 60 days before the date of its performance. The applicant shall submit an application for the final test of the functional course electronically via the Administration system.
(2) The statutory body of an accredited establishment or an employer may, in doubt about the course of training in the functional course, request the opinion of all trainers in the relevant functional course who participated in the training of the candidate.
(3) Where the applicant has been counted as a professional practice or part thereof, which has been completed in the field of specialisation training, in the superstructure sector or in another functional course, the Ministry or the entrusted organisation shall enter this information electronically into the Administration system.
(4) Where the training programme of the functional course provides that a written work is to be carried out in the theoretical part of the final examination of the functional course, the applicant shall add a written work to the application for the final examination of the functional course 2. The Ministry and, where appropriate, the designated organisation shall ensure that an opposing opinion is drawn up. The written work and its assessment shall be filed together with the Protocol on the final test of the functional course.
Deadline and place of the final examination of the functional course
(1) The final test of the functional course shall take place at the dates specified by the designated organisation for each functional course; the designated organisation shall set at least two dates for each functional course in the relevant calendar year.
(2) The dates and places of the final tests of the functional course for the following calendar year will always be published by the Ministry on its website by 31 December. If the Ministry has not received the draft test dates for the following calendar year referred to in paragraph 1 by 30 November, it shall set the dates on its own initiative in accordance with the conditions referred to in paragraph 1. The dates and places of the final tests of the functional course shall be published in the Administration system within the same time limit.
(3) The Ministry or, where appropriate, the designated organisation, shall determine the place of the final examination of the functional course and confirm them together with the date of the final examination of the functional course at least 30 calendar days before the date of the final examination of the functional course to all applicants who submitted an application for the final test of the functional course in accordance with § 24 and who fulfilled the conditions for applying under § 21l (3) of the Act. Confirmation of the date and place of the final examination of the functional course, including compliance with all requirements, shall be recorded by the Ministry or, where appropriate, by an authorised organisation electronically via the Administration system.
(4) The Ministry or, where appropriate, the designated organisation shall inform the members of the Examination Committee of the date and place of the final examination of the functional course. The Ministry shall cancel the examination if, within 60 calendar days of the date of the examination, at least 1 candidate is not registered in the relevant functional course.
Content and course of the final test of the functional course
(1) The Ministry or, where appropriate, the designated organisation shall publish on its website a list of test questions and recommended literature for the final test of the functional course for each functional course valid for the following calendar year by 31 December. The Ministry shall make available the list of test questions and recommended literature for the final test of the functional course within the same time limit in the Administration system.
(2) The final test of the functional course is accessible to healthworkers (3), to the staff of the Ministry as well as to the staff of the entrusted organisation which administratively ensure its conduct, with the exception of advice on the outcome of the examination or part thereof, which is non-public and which only members of the examination committee and the staff of the entrusted organisation which are responsible for carrying out the examination, as appropriate, to the staff of the Ministry. The Chairman of the Examination Board may refer to a health professional who is interfering with the proper conduct of the final examination of the functional course, after prior notice, from the place where the test is conducted.
(3) Before the start of the final examination of the functional course, the tenderer shall demonstrate his identity before the examination committee and provide proof of payment of the costs associated with the organisation of the relevant part of the final examination of the functional course. An entry in the test report shall be made on the submission of the identity document and the proof of payment of the costs associated with the organisation of the relevant part of the final test of the functional course. If the final test of the functional course is composed of several parts, identification may be required for each part of the course.
(4) The final test of the functional course shall consist of a theoretical part and, if provided for in the curriculum, a practical part. If the final test is a functional course, the theoretical part of the final test of the functional course shall consist of the test and oral part, the test being preceded by the oral part. The test is not attended by a trainer or a guarantor or guarantor designated by another doctor, dentist or pharmacist.
