amending Decree No. 22 / 1989 Coll., on the safety and health at work and the safety of operations in mining and mining activities, as amended, Decree No. 392 / 2003 Coll., on the safety of the operation of technical equipment and on the requirements for dedicated technical equipment in the event of mining and mining activities, and Decree No. 659 / 2004 Coll., on safety and health at work and safety of operations in mines at the risk of mining shocks
The Czech Mining Authority provides pursuant to § 5 (3), § 6 (6) (a) and § 8a (8) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll. and Act No. 124 / 2000 Coll.:

AMENDMENT OF THE SAFETY AND HEALTH DECLARATION FOR WORK AND SAFETY OF OPERATIONS UNDER HORNIC ACTIVITIES AND THE SUPPORT OF UNRELATED NERTICIES IN THE COUNTRIES
Čl. I
The Decree of the Czech Mining Authority No. 22 / 1989 Coll., on the Safety and Health Protection at Work and the Safety of Operation in Mining Activities and the Conquest of Unreserved Minerals in Underground, as amended by Decree No. 477 / 1991 Coll., Decree No. 340 / 1992 Coll., Decree No. 3 / 1994 Coll., Decree No. 54 / 1996 Coll., Decree No. 109 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 330 / 2002 Coll., Decree No. 141 / 2004 Coll. and Decree No. 298 / 2005 Coll., is amended as follows:
1. In Article 1, the following sentence is added at the end of the paragraph: "This Order was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC. '
2. in Article 2 (1), points (a), (b) and (g) are deleted;
Points (c) to (f) shall be renumbered (a) to (d) and points (h) to (z) shall be renumbered (e) to (w).
3. Paragraph 2 (2) reads as follows:
"(2) For the purposes of this Order, it shall also be considered as:
(a) the burden of excessive weight on an article weighing more than 4000 kg;
(b) the burden of excessive dimensions of an object whose transport or handling is not possible to meet the road gaps laid down in this Decree;
(c) the burden of a non-storage item requiring special security to maintain it in a stable position for its safe loading and transport on a means of transport in terms of stability;
(d) the burden of the special burden of excessive weight, the burden of excessive dimensions or the burden of non-storage;
(e) transport by land road to the load by a transport platform or self-propelled transport chassis situated on the transport line and anchored in the beginning of a mine with a safety against derailment or overturning of the means of transport;
(f) transport by shear to the load on the rock ground either on or without the transport platform or on the transport platform following a special line placed and anchored on the ground of the mine, using a door or other machinery;
(g) the principal ground line by the ground line from the machined grounder to the mine station and the transformation stations;
h) cable hinge for supporting cable attachment on reinforcement or wall of mine works,
(i) tilting moment the sum of the momentary component of the vehicle's gravity and the tangential component of the load relative to the tilting point;
(j) non-ignition electrical circuit electrical circuit which, under normal operating conditions, does not produce sparks or thermal effects which would be capable of igniting the explosive gaseous atmosphere;
k) Current protection over-current (short-circuit), two-stage (time-dependent) or inverse (anti-overload) and ground protection
(l) special transport by transport and handling of a special load using rail, suspension or ground track transport and transport of any load by skid when using devices with a towing force greater than 45 kN;
(m) the stabilised position of the object at which the stabilising moment is greater than the tilting moment;
(n) stabilising moment the sum of the moments of the normal component of the vehicle and of the moments of the normal component of the load relative to the tilting point;
(o) the grounding system a set of connections and elements necessary for the separate or joint grounding of electrical equipment;
(p) a power contactor over 1 kV of an electrical device with one resting position that is not manually operated and is capable of switching on, transmitting and disabling currents under normal conditions, including service overloads;
(q) a power switch over 1 kV of electrical equipment designed to connect and disconnect electrical circuits, lines or devices, even under full load voltage and in fault conditions. '
4. In Paragraph 5 (1), the words "the instructions for use 77) and the instructions for use 78) 'are replaced by the words" the instructions for use 77).
Footnote 77 reads as follows:
"77) Point 1.7.4 of Annex No 2 to Government Decree No. 24 / 2003 Coll., laying down technical requirements for machinery. Section 1.0.6 of Annex 2 to Government Regulation No 23 / 2003 Coll., laying down technical requirements for equipment and protective systems intended for use in potentially explosive atmospheres. '
footnote 78 is deleted.
5. In Article 6, paragraphs 8 and 9 are added:
"(8) The inspection referred to in paragraph 7 shall also determine whether the cover sheets or grill grids of platform floors are secured against accidental displacement, rollover and oblique position and whether the cover sheets or grids are hardwired. For platforms, external defects are detected visually and by tap. In the case of platforms which have welded structures, the condition of the welds of their carrier parts shall also be checked for external defects. When external welds defects are detected, they shall be checked using a defectoscopy (e.g. capillary method) to see if welds show cracks.
(9) The cover sheets shall have a minimum thickness of 5 mm unless the project determines a higher value. The surface of the sheets shall be grooved or otherwise crushed. '
6. Paragraph 7 (4) reads as follows:
"(4) During the inspection of the workplace referred to in points (a) and (b) of paragraph 2, the possession and security of explosives, the records of explosives shall also be checked and, if the shredding work is to be carried out, its preparation and, where appropriate, its execution. ';
7. In Paragraph 8 (1), the last sentence is replaced by the following: "The preliminary examinations shall be carried out by a couple of workers designated by the race mine or by a worker authorised by it. At the same time, workplaces must be designated for each pair to check, access to them and the deadlines and reporting points for the inspection service. ';
8. In Article 8, the following sentence is added at the end of paragraph 3, including footnote 80 (a): "If, in these mining works, the concentration of methane measured by continuous analysers placed under the legislation governing separate ventilation in the fluent doll80a) does not exceed 0,8% during the period of non-occupancy of the mine, it will be sufficient if these works are provisionally inspected after no longer than 2 shifts.

9. The following Section 19a is inserted after Section 19, including the title and footnotes No 10a and 10b:
„§ 19a
Accumulation of functions
In continuous mines, the functions of the race mine, the head of ventilation and the operator for the control of the assembly, operation and maintenance of electrical equipment, neither for more mines nor for other functions, cannot be cumulated; (a) the geomechanica10b function with other functions must not be cumulated.

10. Paragraph 21, including the title and footnote 13, reads as follows:
„§ 21
Reporting of serious accidents at work, serious incidents, serious accidents at work and dangerous conditions
(1) The racing mine shall ensure the immediate reporting of serious accidents at work, major incidents, major accidents and hazardous conditions to the competent district mining authority.
(2) The following serious accidents at work are reported:
(a) fatal injury;
(b) an injury to a life of danger, which is an injury resulting from the loss of an organ (anatomical or functional), life-threatening damage to health, including industrial poisoning, and an accident with the nature of an accident which has occurred as a result of a breach of safety regulations and is indicative of a serious threat to the safety of operations and health at work;
(c) a mass accident where at least 3 persons, at least one of whom has suffered a fatal injury, or more than 10 persons have been injured in the same accident.
(3) Serious events, major accidents and dangerous situations are reported, namely:
(a) ignition and explosion of methane or coal dust;
(b) the mine shock and such a shock phenomenon (13) in which an accident at work occurred;
(c) mine exogenous fire and surface fire within 60 m of the penetration of the pit with the surface;
(d) the presence of carbon monoxide at a concentration higher than 0,013% if the results of the measurements are not affected by processes that are not related to the self-synthesizing process or that do not endanger the safety of work and operation, such as rupture work;
(e) gasification of the mine work for more than 8 hours;
(f) a cave-in in the mine work, the application of which is expected for a longer period of 24 hours;
(g) flow of waters and mud (watered rock);
(k) rupture of rocks, coal or gases;
(l) forfeiting a person, machine or equipment to a mine work or other underground space;
(m) the leakage of radioactive and other industrial waste stored in underground areas, the loss of a radioactive lamp or the demonstrable leakage of a closed lamp;
(n) the search for a missing person;
(o) accident in the transport of persons on a conveyor belt,
(p) the death of a person in the premises or at the workplace of the organisation.
(4) In addition, major events, major accidents and dangerous situations shall be reported if they occur during
(a) the handling of explosives, including accidents, poisoning with crops arising during the explosion, breaking into storage, theft or detection of explosives;
(b) the use of reserved technical equipment, including electrical accidents;
(c) the operation of heavy equipment, including accidents arising from the operation of heavy equipment.
13) § 2 (b) of Decree No 659 / 2004 Coll. '.
11. Paragraph 22, including the title, reads:
„§ 22
Maintaining the status of the site of a serious occupational accident, a serious event, a dangerous condition and a serious accident (accident)
(1) Where a serious accident at work or a serious event, a dangerous condition or a serious operating accident (accident) has occurred, nothing shall be changed until the district mining office has carried out an examination of the site or has decided otherwise, except in cases where the rescue of the affected or other rescue work or safety of the operation is concerned. Amendments necessary for other serious reasons may be made only with the consent of the Circular Mining Office.
(2) The organisation shall draw up documentation on the location of the serious accident at work, the serious event, the hazardous condition and the serious operational accident, in particular a sketch, plan, photographs, etc. ';
12. Sections 74 and 75 are deleted, including the title.
13. Paragraph 82, including the title and footnotes 24a, 24b and 24c, reads:
„§ 82
Relations with neighbouring mines
(1) In mining works connecting flowing mines, dam objects24a must be built to isolate wind systems. If the dam objects are equipped with a dam door, they shall be constructed in such a number and distance from each other that at least one is always closed. On continuous mines it is sufficient to isolate wind object24b).
(2) It is only possible to connect down wind systems without isolation, under the conditions laid down by the Regional Mining Authority on the basis of the design of the mines, supported by the necessary measures to ensure the safety of work and operation, in particular for the disposal of coal dust, the setting of blast caps, the reduction of methane concentration, the stability of ventilation and the possibility of rapidly closing the wind connection in question.
(3) When connecting several mines to a single wind system, the workers concerned shall be obliged to discuss without delay changes and events which may affect ventilation, in particular the composition of the mine air, and to combat accidents that threaten the neighbouring mine or require synergies linked to the mines. The planned changes must be discussed in good time. Such discussions shall be recorded.
(4) The creation of a new wind connection down or the change of its connection in the wind system down is considered a substantial change in ventilation.
(5) When connecting several mines to a single wind system without isolation, the organisation shall designate a competent person, 24c) responsible for coordinating the activities of the leading ventilation of individual connected mines.

14. In Paragraph 86, the following sentence is added at the end of paragraph 5: "The operational characteristics must also be verified at least every 7 years. '
15. Paragraph 89, including the title, shall be deleted.
16. In Paragraph 90, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The inclusion of the auxiliary fan in the wind network, its decommissioning and the change in its technical parameters shall be considered as a material change in ventilation."
17. in Paragraph 93 (3), the words "barrier doors or explosive resistant closing barriers" are replaced by the words "dam objects."
18. In Paragraph 94 (1), the word "dam 'is replaced by" dam' and the words "wind doors' are replaced by" wind objects'.
19. in Paragraph 94 (3), the words "explosive barrier or barrier door" are replaced by the words "dam objects" and the words "wind doors" are replaced by "wind objects."
20. Paragraph 94 (5) is deleted.
21. Paragraph 96 (3) reads:
"(3) A crash object with a conveyor pass can only be used in exceptional cases with the consent of a racing mine. When giving consent, the factory mine shall determine measures to ensure the safety of the work and operation of the maintenance of this object and to dispose of the coal dust in its vicinity and its control. ';
22. Paragraph 99 (6) is deleted.
23. In Article 103 (1), the words "including emergency storage of flammable liquids and solid lubricants' shall be inserted after the words" lubricants'.
24. in Paragraph 103 (2), "10" is replaced by "15."
25. in Article 103 (4), the words "including emergency storage of flammable liquids and solid lubricants," shall be inserted after the words "lubricants."
26. In Article 103 (6), the words "including emergency storage of flammable liquids and solid lubricants," shall be inserted after the words "lubricants."
27. In Article 103 (7), the words "including emergency storage of flammable liquids and solid lubricants," shall be inserted after the words "lubricants."
28. Paragraph 106 (3), including footnote 20a, reads as follows:
"(3) On the fluent mines of the 2nd hazard class, samples of mining air shall be taken from the space behind the dam, their technical analyses shall be carried out on oxygen, methane and carbon monoxide, and the air pressure shall be measured at least once every 3 months behind the dam, the wind closures 20a) at least once a month. On other mines, they shall determine the frequency of air sampling and the measurement of air pressure beyond the dam and wind closures of the racing mine.
20a) § 2 (b) of Decree No. 4 / 1994 Coll. '
29. In Paragraph 106, paragraphs 4 to 6 are added:
"(4) The provisions of paragraph 3 shall not apply to quarries for which a closed space is demonstrated to be filled and to quarries closing the breach corridors during chamber conquest. The fact that the enclosed space behind the dam is filled shall be recorded in the book of the dam (§ 188).
(5) The state and tightness of the dams and wind caps should be checked at least once every 14 days. The controls also include measuring the concentrations of oxygen, methane and carbon monoxide in front of them.
(6) The results of the checks on dykes and windlocks and the results of the analyses of the air and the measurement of the air pressure behind them are entered in the dam book. "
30. in Article 109a (1), point (f) is deleted;
Points (g) and (h) shall be renumbered as points (f) and (g).
31. in Article 109a (1) (f), "(SNM 0)" is replaced by "(BNM)" and "(SNM 2)" is replaced by "(SNM)."
32. In Paragraph 109a (6), "30 days' is replaced by" 1 year ';
33.Paragraph 110 (9) reads as follows:
"(9) Mining air sampling shall be carried out according to ČSN 83 0050. Only an ejector or suction pump may be used to overcome the vacuum when sampling for wind caps and ditches and for remote sampling for mine air; Before sampling, the air must be extracted from the sample tube and sample panel at least five times the internal volume of the tube and sample panel. ';
34. in Article 114 (1), the second sentence is deleted;
35. Paragraph 126, including the title, shall be deleted.
36. In Paragraph 127, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The inclusion of the auxiliary fan in the wind network, its decommissioning and the change in its technical parameters are considered to be a material change in ventilation."
37.In Paragraph 139 (6), "10" is replaced by "15."
38. In Paragraph 150 (1), the second sentence is deleted. The numbering of the paragraph shall be deleted at the same time.
39. in Paragraph 155 (1), at the end of (c), the dot is replaced by a comma and the following point (d) is added:
"(d) in the places referred to in points (a) to (c) for which approval of the race mine is given with an increase in the concentration of methane referred to in Article 83 (5), one sample per 14 days."
40. In Article 159 (1), the words "after prior approval of the Circular Mining Office 'are deleted.
(41) In Paragraph 182 (3), the words "stores of flammable liquids and solid lubricants, including emergency warehouses of flammable liquids and solid lubricants," shall be inserted after the words "premises."
42. After Paragraph 184a, the following Section 184b is inserted:
„§ 184b
Emergency storage of flammable liquids and solid lubricants
(1) The emergency storage of flammable liquids and solid lubricants is established only according to a project approved by the factory mine. The use of emergency storage permits a racing mine.
(2) Only one emergency storage of flammable liquids and solid lubricants may be set up in a separate wind compartment. The entrance to the emergency storage of flammable liquids and solid lubricants can only be from the transit wind current. A permanent check on the concentration of carbon monoxide by continuous analyser shall be carried out behind the emergency storage of flammable liquids and solid lubricants in the unaffected windstream.
(3) The fire protection of the emergency storage of flammable liquids and solid lubricants shall be provided by at least two airtight or similar hand-held fire extinguishers and at least 50 kg of sand or powder placed in a case with a shovel. Fire extinguishers shall be placed at the entrance to the warehouse. There shall also be at least 20 kg of absorbent substance in the emergency storage of flammable liquids and solid lubricants intended for the recovery of losses of stored materials.
(4) A maximum of 800 litres of flammable liquid and 175 kg solid lubricant may be retained in the emergency storage of flammable liquids and lubricants.
(5) For the storage of flammable liquid, a closed mobile tank shall be used to ensure against misuse. A double-shell container, or a barrel inserted into a metal container or for storage of a modified mining wagon, shall be regarded as a mobile tank; the free volume of the metal container and the mining wagon shall be at least 15% greater than the volume of the stored flammable liquid.
(6) Electrical equipment and cables, with the exception of telecommunications cables, communication equipment and lighting units and their controls, shall not be placed in and within 10 m of the emergency storage of flammable liquids and lubricants.
(7) The continuous analyser referred to in paragraph 2 shall also be subject to the requirements of Paragraph 109a (4), (5) and (6). The requirements of Section 184a (2), (5) and (7) shall also apply to the storage of flammable liquid in the emergency storage of flammable liquids and solid lubricants; the provisions of Section 184 (2) to (8) and Section 184a (9) shall also apply to the handling of flammable liquids and solid lubricants. '
43. Paragraph 186, including the title, shall be deleted.
Article 44 (187), including the title:
„§ 187
Self-ignition
(1) The coal compounds are divided into those susceptible to self-ignition and those free of self-ignition. Before commencing the conquest, the susceptibility to self-igniting of the verse shall be verified. According to the result of the verification, the district mining office shall include the composition in the relevant category.
(2) At a mine with an appearance of a compound susceptible to self-ignition, conditions must be created for nitrogen inert air.
(3) The organisation shall ensure a uniform procedure and management of the prevention of self-combustion on mines by issuing guidelines (working rules), which lay down in particular the principles for the development of a self-ignition prevention project for the management of mining works in compositions prone to self-ignition, the method of determining the level of risk of self-combustion of coal in compositions and the necessary measures.
(4) The coal self-ignition project and its changes are approved by the factory mine. The measures provided for therein are part of the technological process for the management of mining works.
(5) When conducting mining works in compositions susceptible to spontaneous combustion,
(a) the passage of the mine winds through the cut-out spaces, old age and pillars between the mine parts without delay by sealing the sinkhole, in particular at the point of the initial breach during the encircling of the walls, in the corridors following the failure procedure and at the point of end of the break, including with regard to the temporal and spatial management of the mining works;
(b) immediate closure of the completed premises of the finished breaks and of the mine-keeping operations;
(c) measures are identified and implemented to reduce wind falls, based on an analysis of the wind pressure picture;
(d) the minimum daily failure procedure is determined taking into account the expected incubation period and measures to be taken in the event of cessation or deceleration of the failure procedure;
(e) conditions have been created to limit the accumulation of heat;
(f) free space for reinforcement in mining works is immediately filled in;
(g) preventing endogenous fires from occurring by appropriate technical means, in particular by injecting, flooding in old age, building flood cuffs or inert processes;
(h) such a conquest method has been chosen and, in the case of walls, such reinforcement so that the losses of coal mass in the cave-in are as small as possible. The map documentation of the operation of the failure shall indicate the location and power of the layer of coal material left in the veil.
(6) For early detection of the self-ignition process, the organisation shall identify and evaluate the development of carbon monoxide at appropriate locations.
(7) A component prone to self-ignition can only be taken into the field when it is being taken to full base, or if, in the top five times the power of the component is not uncleaned or unbroken. Base belts or ribs shall be established in contact with the cut-out space with the draw-in and exhaling the blast of the mine winds through the cut-out spaces. ';
45. in Paragraph 188 (1), the words "and other dykes and barrier doors" shall be replaced by the words "dykes, dykes and wind caps."
46. in Paragraph 190 (2), the word "region" shall be replaced by "main."
47. in Section 216, the words "Manual of operation and maintenance" are replaced by the words "Instructions for use";
48. in Article 222 (3), the dot at the end of point (c) is replaced by a comma and the following point (d) is added:
"(d) for pipes distributing green nitrogen (May green)."
49. In Article 231, the following paragraph 5 is added:
"(5) All lines and protective wires, with the exception of the main earth line (Paragraph 231b (2)), must be copper. Protective wires not mechanically protected, unless otherwise specified, shall have a cross-section of at least 6 mm2. ';
50. in Article 231a (2) and (3):
"(2) The electricity network referred to in paragraph 1 (a) with a power input of more than 1 kVA, for lignite mines with a power input of more than 3 kVA, may be operated only if the isolation resistance of the network is reduced below 15 Hz / V and the self-disconnection of the network is ensured in the continuous mines.
(3) The electricity network referred to in paragraph 1 (a) with a power input of less than 1 kVA, for lignite mines with a power input of less than 3 kVA, may be operated only provided that:
(a) operate as a network as referred to in paragraph 2;
(b) cable with armor, metal shielding or semiconductor short-circuit protection is used for cable wiring to disconnect the electrical circuit from the power supply in time up to 0,1 s in short circuit; or
(c) the net complies with the requirements of the non-ignition electrical circuit. ';
51. in Article 231a, the following paragraph 4 is added:
