THE LAW
of 26 March 2004
amending Act No. 90 / 1995 Coll., on the Rules of Procedure of the Chamber of Deputies, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 90 / 1995 Coll., on Rules of Procedure of the Chamber of Deputies, as amended by Act No. 47 / 2000 Coll., Act No. 39 / 2001 Coll., Act No. 78 / 2002 Coll. and Act No. 192 / 2002 Coll., is amended as follows:
1. In Paragraph 32 (1), a comma and the words "the Committee on European Affairs' are inserted after the words" the Election Committee '.
2. In Paragraph 41 (2), the words "if it does not comply with Paragraph 109a (3) 'shall be inserted after the words" the Committee'.
3. In Paragraph 50 (1), the dot at the end of point (z) is replaced by a comma and the following point (after) is added:
"(za) to make a resolution on the draft acts and documents of the European Communities and of the European Union."
4. In the third sentence of Paragraph 86 (3), the words ", budgets of regions and municipalities' shall be inserted after the words" entitlements to the State budget '.
5. the following Part 15 A is inserted after Part 15:
INVESTIGATION OF THE INTEREST OF THE EUROPEAN UNION
(1) The Government shall submit draft acts of the European Communities and of the European Union to the House through the Committee on European Affairs. The Government shall give its preliminary opinion on the proposals referred to in the previous sentence. The Government is obliged to submit to the House legal acts of the European Communities and of the European Union at the same time as they are submitted to the Council of the European Union (hereinafter referred to as the Council). The Government shall also submit other draft acts and documents of the European Communities and of the European Union if it so decides or if the House or its institutions so request.
(2) The draft acts and other documents of the European Communities and of the European Union shall be discussed without undue delay by the Committee on European Affairs on the basis of a preliminary opinion of the Government. The Committee on European Affairs may refer such a proposal to another committee of substance and may at the same time specify the date by which the proposal is to be discussed.
(3) The President of the European Committee on European Affairs or the President of the Committee in question shall forward a resolution on the draft acts, personnel nominations to the institutions of the European Union and other documents referred to in paragraph 2 to the President of the House, and may, within 8 days of the adoption of this resolution, request the President of the House to be placed on the agenda of the next meeting of the House. The Government may also request the inclusion of this resolution on the agenda of the House meeting. The resolution according to the previous sentences shall be delivered to all Members at least 24 hours before its hearing in the House.
(4) If the resolution is not included on the agenda of the next meeting in accordance with paragraph 3 or Paragraph 46 (4) (c), or if the House has not decided on such inclusion in accordance with Rule 54 (4) to (6), it shall be deemed to be a statement by the House.
(5) The resolution of the House or the resolution of the committees, in the cases referred to in paragraph 4, on the draft acts and other documents of the European Communities and of the European Union, shall be sent to the Government, which shall take them into account when formulating its position for negotiations in the institutions of the European Communities and the European Union.
(6) The meetings of the Committee on European Affairs or of the Committee which is discussing the proposals referred to in paragraphs 1 and 2 may be attended by all Members of the European Parliament elected for the Czech Republic. Paragraph 39 shall apply mutatis mutandis.
(1) Before the Council's deliberations on whose agenda the draft acts or other documents referred to in Article 109a are included, a member of the Government shall be required to appear at the meetings of the Committee on European Affairs if the Committee so requests and to provide information on the position taken on the matter in question within the Council by the Czech Republic. A member of the Government at the Committee's meeting shall also add information or provide explanations on the draft acts or other documents of the European Communities and of the European Union if the Government has been called upon to do so by a previous resolution of that Committee. The Government may request that a meeting of the Committee on European Affairs, or part thereof, at which cases are to be heard under the previous sentences be declared non-public; Paragraph 37 shall apply mutatis mutandis.
(2) The Government or its Member in-kind shall send a report to the Committee on European Affairs from the Council meeting without delay after the report has been approved or taken into account by the Government.
(3) Except for acts or other documents of considerable urgency, the Government shall not deliver a final opinion in its deliberations in the Council until the procedure in the House under the previous paragraphs has been completed.
(1) The Government submits to the Committee on European Affairs a staff nomination for the European Commissioner, a judge of the European Court of Justice and a nomination for the EIB and the EBRD for the Czech Republic.
(2) Staff nominations to the institutions of the European Union shall be discussed by the Committee on European Affairs before the Government takes a final decision on them. "
This Act shall take effect on the day of its publication.
