on the registration of geological works
According to § 26 (1) of Act No. 62 / 1988 Coll., on Geological Works, as amended by Act No. 366 / 2000 Coll., ("the Act '), the Ministry of the Environment provides for the implementation of § 7 (4) of the Act:
Subject matter
This decree sets out the scope of the recorded data and the procedure for recording geological works.
Scope of the registered data
(1) The register of geological work (hereinafter referred to as "the register") contains basic data on organisations carrying out geological work1) (hereinafter referred to as "the organisation") according to the project of geological works.2)
(2) The records shall contain the following information:
(a) a firm or name and registered office with legal persons; business name and forename and place of business of natural persons,
(b) the identification number, if assigned to the organisation;
(c) the name of the geological task;
(d) identification of the type and stage of geological work, 3)
(e) the objective of geological work;
(f) the main types of work proposed,
(g) the name and code of the cadastral territory on which or part of which the geological task will be addressed; does not apply to tasks addressed in more than five cadastral territories,
(h) the name of the region in whose territory the geological task will be addressed;
(i) the date of commencement and planned termination of geological work;
j) the aggregate cost of the works, with a rounding up to thousands of CZK for works paid entirely from the State budget; for other geological works, the financial margin under which the budget of the geological task falls, at intervals of up to 10 000 CZK, from 10 000 CZK to 100 000 CZK, from 100 000 CZK to 1 000 000 CZK, from 1 000 000 CZK to 5 000 000 CZK and over 5 000 000 CZK,
(k) a distinction between the source of funding for the geological task on the state budget and other resources.
Registration procedure
(1) Registration is carried out by the Czech Geological Service (4)
(2) The evidence for registration (hereinafter referred to as "supporting documents") shall be processed by the organisation according to the project of geological work on the form of the registration sheet set out in the Annex to this decree.
(3) In the case of geological work of geological research which is not carried out by business or is not financed by the State budget, and in the case of geological work which is part of the teaching in secondary schools, higher vocational schools and universities, the organisation shall, on a one-off basis, enter in the register the data referred to in Article 2 (2) (a).
(4) The organisation's record sheet will include a definition of the area under examination on the cut-off of the map with an appropriate scale, but not more than 1: 10 000.
(5) The register is signed by the responsible surveyor (1) (hereinafter referred to as the "responsible investigator"). If the geological task does not need to be addressed through the responsible solver (5), the record sheet shall be signed by the responsible solver from whose professional competence the organisation is authorised to design, perform and evaluate geological work.
(6) The supporting documents will be delivered by the organisation in duplicate to the Czech Geological Service within 30 days before the beginning of the geological work by post, in electronic form or directly entrusted to the employees at the Czech Geological Service.
(7) If the data in the submitted supporting documents are incomplete, the Czech Geological Service will require them to be supplemented. Geological work will not be registered until completion.
(8) The Czech Geological Service records the geological work on the day of the submission of the complete supporting documents and gives confirmation to the organisation within 14 days.
Change of registration
(1) If the registered geological task is changed, the organisation will deliver the necessary documentation for changing the registered data within 30 days of the change to the Czech Geological Service, if:
(a) be substantially extended or relocated to the territory of the geological task;
(b) the objective of the geological task or the type and stage of geological work is changed;
(c) the geological work shall not end within one year of the expiry of the planned date of its conclusion on the record sheet;
(d) the geological task has been abolished;
(e) the information referred to in Article 2 (2) (a) shall be amended.
(2) The Czech Geological Service will indicate the notified changes in the register and issue a confirmation thereof to the organisation.
(3) If the registered geological work is not carried out, the organisation shall notify the Czech Geological Service within 30 days of the decision not to implement it.
Disclosure
The Czech Geological Service makes annual aggregated data on registered geological works available via the Internet.
Transitional provision
Geological works registered by the Geofund of the Czech Republic before the beginning of the validity of this decree are still considered to be registered.
Efficacy
This Decree shall take effect on 1 September 2001.
