GOVERNMENT REGULATION
of 3 July 2000
amending Government Regulation No. 168 / 1997 Coll., laying down technical requirements for low voltage electrical equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll., ("the Act ') to implement Sections 11, 12 and 13 of the Act:
Government Regulation No. 168 / 1997 Coll., laying down technical requirements for low voltage electrical equipment, is amended as follows:
(1) Paragraph 1, including footnotes 1) and 2) shall read as follows:
(1) This Regulation lays down technical requirements for low-voltage electrical equipment, in accordance with the law of the European Communities (1) and the international contract (2).
(2) For the purposes of this Regulation, any device intended for use in the range of rated voltages from 50 V to 1000 V AC and rated voltages from 75 V to 1500 V DC, with the exception of the equipment and phenomena listed in Annex 1 to this Regulation, shall be regarded as an electrical device.
(3) The specified products under Section 12 (1) of the Act are electrical equipment.
1) Council Directive 73 / 23 / EEC of 19 February 1973 on the harmonisation of the laws of the Member States relating to electrical equipment intended for use within certain voltage limits, as amended by Council Directive 93 / 68 / EEC.
2) Protocol to the Europe Agreement on Conformity Assessment and Acceptance of Industrial Products. '.
2. Paragraph 2 (2) reads as follows:
"(2) Where essential requirements are specified
(a) harmonised Czech technical standards;
(b) specified standards;
(c) technical standards transposing harmonised European standards, foreign technical standards or documents in European Union States;
(d) the safety provisions of the technical standards of the International Organisation for Electrotechnical Standardisation (IEC) or of the International Commission for Regulations for the Approval of Electrical Products (CEE) where the standards referred to in (a), (b) or (c) do not exist or specify all the essential requirements; or
(e) Czech technical standards where there are no technical standards referred to in (d)
and the characteristics of the electrical equipment comply with them, the essential requirements shall be deemed to be met. ';
3. Paragraph 3 (1) reads as follows:
"(1) Before placing electrical equipment on the market, the manufacturer or importer shall carry out or ensure an assessment of the conformity of electrical equipment with all essential requirements (hereinafter referred to as" conformity assessment ') in accordance with the procedure set out in Annex 4 to this Regulation and shall issue a declaration of conformity in accordance with Section 5 or, where appropriate, proceed in accordance with Section 5a.';

The evidence of conformity assessment carried out (Section 13 (8) of the Act) acquired by the manufacturer or importer shall include the technical documentation, the content of which is set out in point 5 of Annex 4 to this Regulation. In cases resulting from Paragraph 13 (8) of the Act, the importer shall submit to the supervisory authority documentation in the official language of the country in which the product originates or in a language agreed with the supervisory authority. '
6. in Article 5 (1) (e):
"(e) the list of technical regulations and documents referred to in Article 2 (2) used in conformity assessment,"
7. in Article 5 (1) (f), a comma is inserted after the figure "2."
8. The following Section 5a is inserted after Section 5, including footnote 3:
(1) For electrical equipment originating in the Czech Republic or in the Member States of the European Community and complying with the requirements of this Regulation, the manufacturer shall not draw up declarations of conformity pursuant to Article 7 but shall place the CE3 marking on the electrical equipment and draw up the EC declaration of conformity in accordance with Annex 3 to this Regulation. The CE marking shall be placed on each electrical device or, if this is not possible, on the packaging, the instructions for use or the warranty sheet in such a way that it is visible, easily legible and indelible.
(2) An electrical device, its packaging, instructions for use or a warranty sheet may be affixed to a marking other than the CE marking only if the visibility and legibility of the CE marking are not thereby reduced.
(3) If electrical equipment is also subject to other government regulations which relate to other requirements and also provide for the location of the CE marking, the CE marking shall also indicate compliance with the provisions of those other government regulations.
(4) However, if one or more of these government regulations allow the manufacturer, for a transitional period, to choose which provisions it will comply with, the CE marking shall only be in conformity with those provisions of the government regulation used by the manufacturer. In this case, the accompanying documentation, warnings or instructions required by the relevant government regulations and attached to electrical equipment shall include a list of the government regulations used.
3) Government Decree No 291 / 2000 Coll., laying down the graphic form of the CE marking. '
9. In Annex No 1, the words "ELECTRIC 'shall be deleted from the heading, after the words" EQUIPMENT', the words "AND NEVY 'and the words" WHICH' shall be replaced by the words "WHICH '.
10. In Annex 1, the words "in explosive atmospheres' are replaced by the words" in potentially explosive atmospheres'.
11. In Annex 1, the words "Radio and electrical interference 'are inserted after the words" Power supply equipment'.
12. In Annex No 2, point 1 (b), a comma is inserted after the words "which is the manufacturer," and a comma is inserted after the word.
13. In Annex 2, point 2 (a), the words "domestic and 'shall be inserted after the words" persons and'.
14. In Annex 2, point 2 (b), the word "electrical 'is deleted.
15. In Annex No 2 (2) (c), the words "domestic and farm animals' and the words" as experienced 'are inserted after the words "persons'.
16. in Annex 2 (2) (d):
"(d) insulation shall comply with foreseeable conditions."
17. in Annex No 2, point 3 (a), the comma and the words "domestic and farm animals" shall be inserted after the word "persons."
18. In Annex 2, point 3 (b), a comma is inserted after the word "persons' and the words" domestic and farm animals' and the words "except for electromagnetic interference which is assessed in accordance with a special Regulation, 1) ', including footnote 1, are deleted.
19. In Annex 2, point 3 (c), the word "presumed 'is replaced by the word" foreseeable' and the words "domestic and farm animals' are inserted after the word" persons'.
20. the following Annexes 3 and 4 are inserted after Annex 2:
"Annex 3 to Government Decree No. 168 / 1997 Coll.
EC CONFORMITY DECLARATION
The EC declaration of conformity shall include:
(a) identification of the electrical equipment manufacturer;
(b) identification details of the authorised representative, if any;
(c) a description of the electrical equipment;
(d) a reference to harmonised standards;
(e) where applicable, references to technical specifications [Paragraph 2 (f) (1) of the Act] with which conformity is declared;
(f) identification details of the signatory who is authorised to accept commitments on behalf of the manufacturer or authorised representative;
(g) the last two digits of the year in which the CE marking was affixed to the product.

INTERNAL CONTROL OF PRODUCTION
1. Internal control of production is a conformity assessment procedure whereby a manufacturer who fulfils the obligations referred to in points 2 and 3 ensures and declares that the electrical equipment complies with the requirements of this Regulation which apply to it.
2. The manufacturer shall draw up the technical documentation described in point 5.
3. The manufacturer shall keep the technical documentation available to the supervisory authority for surveillance purposes for at least 10 years after the end of the production of the electrical equipment.
5. The technical documentation shall make it possible to assess the conformity of electrical equipment with the requirements of this Regulation. It shall include, to the extent necessary for this assessment, data on the design, manufacture and functioning of the electrical equipment. It shall contain:
(a) a general description of the electrical equipment;
(b) conceptual design and manufacturing drawings and diagrams of components, sub-assemblies, circuits and the like,
(c) descriptions and comments necessary for the clarity of drawings and diagrams and functions of electrical equipment;
(d) the list of documents referred to in Article 2 (2) which have been used in whole or in part and, where such documents have not been used, the descriptions of the solutions adopted to meet the essential requirements shall be given;
(e) the results of the design calculations carried out, tests carried out, etc.,
(f) test reports.
6. The manufacturer shall keep with the technical documentation a copy of the certificate of conformity or the EC declaration of conformity.
7. The manufacturer shall take all necessary measures to ensure that the production process ensures compliance of the electrical equipment produced with the technical documentation referred to in point 2 and with the requirements of this Regulation which apply to it. ';
For products not intended for placing on the market in the European Community, instead of marking appliances referred to in Article 5a (1), declarations of conformity may be issued in accordance with Article 5 for a period of one year after the entry into force of this Regulation.
This Regulation shall enter into force on the day of the publication of the Protocol to the Europe Agreement on Conformity Assessment and Acceptance of Industrial Products in the Collection of International Contracts, with the exception of Paragraph 3 (3) and point 4 of Annex No 4, which shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
