DECLARATION
of 21 October 2019
amending Decree No. 36 / 2006 Coll., on the verification of the conformity of a copy or a copy with the instrument and on the verification of the authenticity of the signature, as amended
The Ministry of the Interior provides pursuant to Section 21 of Act No. 21 / 2006 Coll., on the Verification of the Compliance of a Copy or Copy with the Charter and on the Verification of the Authenticity of Signature and on the Amendment of Certain Laws (Act on Verification), as amended by Act No. 279 / 2019 Coll.:
Decree No. 36 / 2006 Coll., on the verification of the conformity of the copy or copy with the instrument and on the verification of the authenticity of the signature, as amended by Decree No. 331 / 2006 Coll., Decree No. 390 / 2007 Coll., Decree No. 194 / 2008 Coll., Decree No. 15 / 2009 Coll., Decree No. 484 / 2009 Coll., Decree No. 384 / 2010 Coll., Decree No. 441 / 2011 Coll., Decree No. 456 / 2012 Coll., Decree No. 401 / 2013 Coll., Decree No. 265 / 2014 Coll., Decree No. 389 / 2015 Coll., Decree No. 411 / 2016 Coll., Decree No. 409 / 2017 Coll. and Decree No. 265 / 2018 Coll., is amended as follows:
1. In Article 2, the following paragraph 5 is added:
"(5) Where the document submitted is an output from an authorized conversion of documents carried out in an automated manner and the instrument being made out of multiple sheets is composed, the validator shall bring all the sheets of documents to a fixed volume as specified in paragraph 1. ';
2. in Article 5 (1) (a) and (2) (a), the word "or" shall be deleted;
3. In Article 5, at the end of paragraph 1, the dot is replaced by "or 'and the following point (c) is added:
"(c) a copy with the help of computer technology, with the manual listing of the data referred to in Section 8 of the law by the verifying person."
4. In Article 5, at the end of paragraph 2, the dot is replaced by "or 'and the following point (c) is added:
"(c) a copy with the help of computer technology, with the manual listing of the data referred to in Article 12 of the Act by the verifying person."
5. In Article 5, paragraphs 4 and 5 are added:
"(4) The verification clause shall be marked on the instrument so as not to interfere with its contents.
(5) In the event of an error in the verification clause prior to the conclusion of the vision or legalisation, Article 6c (1) shall apply mutatis mutandis, unless a new verification clause is possible to provide the instrument. ';

Model verification book
(1) The model of the initial certificate sheet is set out in Annex 6 to this order.
(2) The model of the signature model sheet is set out in Annex 7 to this Decree.
(3) The model form of the verification book is set out in Annex 8 to this Regulation. "
7. After Paragraph 6, the following Sections 6a to 6d are inserted:
Identification of the verification book
(1) The verification book shall bear the name "Verification book" on the front of the binding.
(2) Where the Office has in parallel more than one volume of the verification book, each volume of the verification book shall be marked on the front of the bond and on the opening sheet so that the individual volumes are distinguished from each other. The indication of the volume of the verification book is part of the serial number of the vision or legalization in the verification clause.
Implementation of entries in the verification book
(1) Registration in the verification book shall be carried out by the verifier in the form of:
(a) a manual listing of the prescribed sections of the certificate form; or
(b) the affixing of a self-adhesive label, equipped with computer technology, in the form of a verification book; the applicant for legalisation, the witness and the verifiers are not signed on the label.
(2) If it is not apparent from a document which is visible or on which the signature is legalized, what type of document it is, the verifier shall enter this entry in the relevant section of the verification book on the basis of the applicant's declaration and shall at the same time add a note to this section that the information has been completed on the basis of the applicant's declaration.
(3) The entry in the certificate shall be deemed to be closed at the time of the signature of the certifying person in the relevant section.
(4) The section of the form of the verification book, which will remain blank after the entry, shall be crossed out by the certifying person.
Implementation of corrections in the verification book
(1) In the event of an error in the verification record, the validator shall cross that figure out in such a way that it remains legible, indicate the correct figure and attach to the correction made the "opr 'clause, or" corrected / a', followed by his signature, date and print of the official stamp.
(2) The blank entry in the verification book may be deleted by crossing out the original entry so that it remains legible. The date and imprint of the official stamp shall be indicated on the cancellation of the registration in the certificate, indicating the reason for the cancellation of the registration, to which the certifying person shall attach his signature, the date and the stamp.
(3) The serial number of the cancelled registration shall be used for the following entry in the verification book.
Use of abbreviations
The abbreviation can only be used in the minutes if it is common and does not affect the completeness and clarity of the minutes made. However, the names, surnames, street names and municipalities cannot be shortened. '
8. In Annex 2, the words "which are part of the content of the legal meaning of this Charter 'are deleted.
9. the following Annexes 6 and 7 are inserted after Annex 5:

Annex 6 is renumbered Annex 8.
10. In column 8 of Annex 8, the words "The Visioned Charter is literally in agreement with the instrument from which it was taken (Sections 8 (c) of the Verification Act) 'are replaced by the words" The Visioned Charter is literally in line with the instrument from which it was drawn [Notes under Sections 8 (c), (d), (e) and (f) of the Verification Act]'.
11. In Annex No 8, column 10, the words "the amount of the fee and 'shall be inserted after the word" indication'.
Transitional provisions
1. Verification books bearing on the front of the bond a name other than that referred to in § 6a (1) of Decree No. 36 / 2006 Coll., as effective from the date of entry into force of this Order, may be used until 31 December 2023.
2. Authentication books which do not contain an introductory sheet and a copy of the signatures in accordance with Annexes 6 and 7 to Decree No. 36 / 2006 Coll., as effective from the date of entry into force of this Order, may be used until 31 December 2023, provided that the particulars referred to in Annexes 6 and 7 to Decree No. 36 / 2006 Coll., as effective from the date of entry into force of this Order have been supplemented.
3. Verification clauses in accordance with the model in Annex No 2 to Decree No. 36 / 2006 Coll., as effective before the date of entry into force of this Order, may be used until 31 December 2023, provided that the verification clause for vision is crossed out in the sentence "which is part of the content of the legal meaning of this Charter '.
Efficacy
This decree shall take effect on the 15th day following its publication.
