DECLARATION
of 24 August 2017
amending Decree No. 109 / 1994 of the Ministry of Justice Coll., laying down the rules governing the exercise of custody, as amended
The Ministry of Justice provides, pursuant to Article 31 of Act No. 293 / 1993 Coll., for the exercise of custody:
Decree No. 109 / 1994 Coll., laying down the rules for the exercise of custody, as amended by Decree No. 292 / 2001 Coll., Decree No. 377 / 2004 Coll., Decree No. 242 / 2006 Coll. and Decree No. 18 / 2015 Coll., is amended as follows:
1. In Articles 4 and 11 (2), the word "separation 'is replaced by" section'.
2. In Paragraph 11 (1), the words "crisis department 'are replaced by the words" crisis section'.
3. In Paragraph 15, the words "at the end of the text of paragraph 2, the accommodation area per defendant may not be less than 3 m2 'shall be added.
4. In Article 16 (3), the words "or to a lawyer representing him in another case 'are deleted.
5. At the end of paragraph 2, the sentence "The release of the accused from custody shall be accompanied by the sentence" The administration of the prison shall immediately send the report to the guardian, if the defendant has been restricted in his capacity, to the social curator responsible for the place of residence of the defendant and, if it is a juvenile, his legal representative or guardian and to the competent social protection authority of the children '.
6. In Paragraph 57, the following paragraph 3 is inserted after paragraph 2:
"(3) He shall immediately send the report to the guardian, if the defendant has been restricted in his capacity, to the social curator responsible for the place of residence of the defendant and, if he is a juvenile, his legal representative or guardian, and to the competent body of the social protection of children, for a period of more than 7 days. '
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
7. In Paragraph 57 (5), "3 'is replaced by" 4'.
8. In Sections 78a (4) and (8), the words "established separation 'are replaced by the words" established section'.
Efficacy
This Decision shall enter into force on 1 October 2017.
