of 29 August 2016
amending Decree No 14 / 2005 Coll., on pre-school education, as amended, and certain other regulations
The Ministry of Education, Youth and Sports provides, pursuant to § 7 (3), § 23 (3), § 35 (2) and § 123 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll. and Act No. 178 / 2016 Coll.:
Amendment of the pre-school education decree
Decree No. 14 / 2005 Coll., on pre-school education, as amended by Decree No. 43 / 2006 Coll., Decree No. 214 / 2012 Coll. and Decree No. 197 / 2016 Coll., is amended as follows:
1. In Article 1, at the end of the text of paragraph 2, the words "except for forest nursery school, which may only be set up with day-to-day and half-day operations' shall be added.
2. In Paragraph 1, the sentence "Forest nursery school with day-to-day operation shall be added at the end of paragraph 3 to provide education to children for more than 6.5 hours a day, but not more than 9 hours a day."
3. In Paragraph 1, at the end of paragraph 6, the sentence "It is possible to set up classes with semi-day operation in a forest nursery with day-to-day operation."
4. In Section 1, paragraph 7 is added:
"(7) Forest kindergarten is a type of kindergarten."
5. Paragraph 1a (2) is deleted.
Paragraphs 3 to 6 shall become paragraphs 2 to 5.
6. In Paragraph 1a (2), the words "from different years' are replaced by the words" of different ages'.
7. In Paragraph 1a (4), "9 'is replaced by" 10'.
8. Paragraph 1a (5) is deleted.
9. In Paragraph 1b, the following paragraph 4 is added:
"(4) A school of the forest cannot be established as a school of the school of the hospital. '
10. For § 1b, a new § 1c is ruled, which includes the title:
Scope of compulsory preschool education in kindergarten
(1) Compulsory pre-school education is to be established within a continuous period of 4 hours on the days on which pre-school education is required.
(2) The head of the parent school shall determine the beginning of the period referred to in paragraph 1 within a period of 7 hours to 9 hours and shall indicate it in the school rules. ';
13. in § 5 (1), the words "pedagogical worker" are replaced by the words "kindergarten teacher 8);"
footnote 8:
"8) § 6 of Act No. 563 / 2004 Coll., on pedagogic workers and on the amendment of certain laws, as amended."
14. in Article 5 (2), the words "pedagogical staff" shall be replaced by the words "teachers of nursery schools8)" and the words "pedagogical staff" shall be replaced by the words "teacher of nursery schools8)."
15. in Article 5 (2) (b), the words "with disabilities" shall be replaced by the words "with second to fifth degree support measures granted or children under 3 years of age."
16. in Article 5 (5):
"(5) In providing recovery stays and, where appropriate, trips for children, the head of the parent school shall determine the number of teachers of the parent school or other teaching staff to ensure the education of children, including those referred to in Section 16 (9) of the Education Act, their safety and health. '
17. In Article 5, the following paragraph 6 is added:
"(6) In the school of the forest, where more than 8 children are present, a non-educational worker with a professional competence is employed simultaneously.
(a) to pursue the profession of general nurse, pediatric nurse, medical assistant, midwife, medical paramedic,
(b) preschool teachers (8), educations9), or
(c) nannies for children before starting compulsory schools10).

10) Act No. 179 / 2006 Coll., on the verification and recognition of the results of continuing education and on the amendment of certain laws (Act on the Recognition of the Results of Further Education), as amended. '
20. in Article 6 (2), the words "disabled" are replaced by the words "referred to in Article 16 (9) of the Education Act."
21. in Article 6 (3), the second sentence is deleted;
22. in Paragraph 6 (4), "9" is replaced by "10."
23. in Paragraph 6 (7), the word "the following" shall be replaced by the word "the existing."
Transitional provision
Paragraph 2 (4) of Decree No 14 / 2005 Coll., as effective from 1 September 2016, applies to a parent school in which classes are occupied for the school year 2016 / 2017 in such a way that it would be necessary to create a new class only from 1 September 2017.
Amendment of the Decree amending Decree No. 72 / 2005 Coll., on the provision of advisory services in schools and school counselling establishments, as amended, and some other regulations
In Part Four of Decree No 197 / 2016 Coll., amending Decree No 72 / 2005 Coll., on the provision of advisory services in schools and school counselling establishments, as amended, and certain other decrees, the following Article is inserted: The following Article Va is inserted:
Transitional provision
The provisions of § 4 (7), second to fifth sentences and § 5 (6) of Decree No 48 / 2005 Coll., as effective from 1 September 2016, shall apply in a school in which classes or groups are occupied for the school year 2016 / 2017 in such a way that it would be necessary to create a new class or group only from 1 September 2017. '
EFFECTIVE
1. This Decision shall enter into force on 1 September 2016, with the exception of the provisions of Part One, point (b) of Article 4 (1), Article 4 (1) and Article 5 (1), Article 5 (1) and Article 5 (1), Article 5 (1) and Article 5 (2), Article 5 (1) and Article 5 (1), Article 5 (1) and Article 5 (2), Article 5 (1) and Article 5 (2), Article 5 (1) and Article 5 (2), Article 5 (2) and Article 5 (1 (2), Article 5 (2) and Article 5 (2 (2), Article 5 (2), Article 5) and Article 5 (2) of the second subparagraph of the second subparagraph of the second subparagraph of Regulation shall apply. Article 2 (1) (a) This Regulation shall be binding in its entirety and directly applicable in all Member States.
2. Point 11 (i) shall expire on 31 August 2020.
