THE LAW
of 5 November 1997
amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 455 / 1991 Coll., on Business Business Act (Trade Code Act), as amended by Act No. 231 / 1992 Coll., Act No. 591 / 1992 Coll., Act No. 273 / 1993 Coll., Act No. 303 / 1993 Coll., Act No. 38 / 1994 Coll., Act No. 42 / 1994 Coll., Act No. 136 / 1994 Coll., Act No. 200 / 1994 Coll., Act No. 237 / 1995 Coll., Act No. 49 / 1997 Coll., Act No. 61 / 1997 Coll., Act No. 79 / 1997 Coll., and Act No. 217 / 1997 Coll.
1. after Paragraph 17, the following Section 18 is inserted:
(1) The municipality may issue a market order in the form of a generally binding decree. For the sale of goods and the provision of services outside the establishment designated for this purpose by the approval decision under the Special Law 29b), the market rules shall define:
(a) the places of sale and provision of services, in particular market and market markets (hereinafter referred to as "marketplaces") and their distribution;
(b) the determination of capacity and adequate market facilities;
(c) the period of sale of goods and services in the marketplace;
(d) rules for maintaining purity and safety in the marketplace;
(e) the rules to be followed by the market operator to ensure its proper operation.
(2) The market rules, with the exception of paragraph 1 (a), (b) and (c), also apply to the sale of goods and the provision of services in markets having the character of construction under a special law. 29b)

2. In Paragraph 58, the following paragraph 5 is inserted after paragraph 4:
"(5) If a natural or legal person infringes the market rules issued pursuant to Paragraph 18, the municipality shall invite it to remedy the deficiency within the prescribed time limit. The Trade Office competent according to the registered office or place of business shall, on the initiative of the municipality, impose a natural or legal person who has infringed the market rules and has not, within the prescribed period, removed the detected deficiency, fine up to CZK 20 000 or suspend the operation of the trade or cancel the business licence."
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
3. In Paragraph 58 (7), "2 to 4 'is replaced by" 2 to 5';
4. In Annex 2 to GROUP 213: Construction in column 2, in business Project activity under construction, the following words are added at the end: "or compliance with the conditions laid down in § 34 of the same Act '.
5. In Annex 2, in GROUP 213: Construction, in column 2, in the business of the Implementation of Buildings, including their amendments, maintenance and disposal, the following words are added at the end: "or compliance with the conditions laid down in § 34 of the same Act '.
This Act shall take effect on the day of its publication.
