GOVERNMENT REGULATION
of 22 January 2025
amending Government Regulation No 74 / 2017 Coll., laying down certain conditions for granting aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 382 / 2022 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2017 Coll., laying down certain conditions for the grant of aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, as amended by Government Regulation No. 128 / 2018 Coll., Government Regulation No. 190 / 2019 Coll., Government Regulation No. 228 / 2021 Coll. and Government Regulation No. 210 / 2022 Coll., are amended as follows:
1. in Article 1 (a) and (b), the words "primary school pupils" are replaced by the words "primary school pupils under the directly applicable European Union19";
Footnote 19:
"(19) Article 23 (8) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended. ';
2. In footnote 13, the words "Article 29 of Council Regulation (EC) No 834 / 2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2092 / 91. Annex XII to Commission Regulation (EC) No 889 / 2008 laying down detailed rules for the application of Council Regulation (EC) No 834 / 2007 on organic production and labelling of organic products as regards organic production, labelling and control" shall be replaced by "Article 35 and Annex VI to Regulation (EU) 2018 / 848 of the European Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation (EC) No 834 / 2007, as amended."
3. In Article 6 (2), "31 March 'is replaced by" 28 February' and "starting 'is deleted.
4. In the first sentence of Article 6 (3), the word 'whole' is deleted and at the end of the sentence the words' pursuant to Article 7 (2) 'are added.
5. in Article 6 (4) (b), including footnote 20:
"(b) from mandatory food information 20),
1. name of the food,
2. the list of ingredients; and
3. nutrition information,
20) Article 9 of Regulation (EU) No 1169 / 2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924 / 2006 and (EC) No 1925 / 2006 of the European Parliament and of the Council and repealing Commission Directive 87 / 250 / EEC, Council Directive 90 / 496 / EEC, Commission Directive 1999 / 10 / EC, Directive 2000 / 13 / EC of the European Parliament and of the Council, Commission Directives 2002 / 67 / EC and 2008 / 5 / EC and Commission Regulation (EC) No 608 / 2004, as amended. '.
6. in Article 6 (4) (e), the words "or fruit and vegetable products 17), 18)" shall be inserted after the word "chain" and the words "which includes not more than one intermediary between the manufacturer of the approved product and the school" shall be inserted.
7. footnote 16 reads as follows:
"(16) Regulation (EU) 2024 / 1143 of the European Parliament and of the Council of 11 April 2024 on geographical indications for wine, spirits and agricultural products as well as traditional specialities guaranteed and on optional quality data for agricultural products amending Regulations (EU) No 1308 / 2013, (EU) 2019 / 787 and (EU) 2019 / 1753 and repealing Regulation (EU) No 1151 / 2012."
8. In Article 6 (5), the first sentence is replaced by the following: "In the case of milk products, the applicant shall accompany the application with a protocol from an accredited laboratory containing an analysis of the salt and fat content of the milk product."
9. In Article 6, the following paragraph 6 is inserted after paragraph 5:
"(6) Each product included in the application for approval referred to in paragraph 4 shall be accompanied by a preview of the packaging of the product. ';
Paragraph 6 shall become paragraph 7.
10. in Article 6 (7), "5" is replaced by "6."
11. in Article 7 (2), the words "from 1 November of the relevant school year" shall be inserted after the word "schools."
12. in Article 7 (3), "31" is replaced by "15."
13. in Article 7 (4), the words "and 5" are replaced by the words "to 6."
14. in Article 7, paragraph 6 is deleted;
Paragraph 7 shall become paragraph 6.
15. in Paragraph 8 (1), the first sentence is deleted;
16. In the first sentence of Article 8 (1), the words "from 1 November 'shall be inserted after the words" after the month'.
17. in Article 8 (3), "1 September" is replaced by "15 August" and "total number of pupils in schools" is replaced by "number of pupils enrolled in the project."
18. in Paragraph 9 (3), the word "a" shall be deleted at the end of point (a);
19. In Article 9, at the end of paragraph 3, the dot is replaced by a comma and the following points (c) and (d) are added:
"(c) a certificate of taking over the product by the school during the delivery period concerned; that certificate is submitted in electronic form; and
(d) a notice of withdrawal from the contract for the supply of products where the school concerned has decided to terminate the procurement during the school year; that notification is submitted in electronic form. ';
20. Paragraph 9 (4) is deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
21. in Paragraph 10 (2) (d), "(b) and" shall be replaced by "(b),"
22. in Article 10 (2) (e), the words "unless they are applicants pursuant to Article 7 (6)" shall be deleted;
23. In Article 10, at the end of paragraph 2, the dot is replaced by "a 'and the following point (f) is added:
"(f) for products which are not approved in the decision approving the applicant pursuant to Article 6 (7) or in a decision made following an application pursuant to Article 7 (4), the technical documentation, including a view of the packaging of the product; in the case of milk products, the applicant shall also attach to the application a protocol from an accredited laboratory containing an analysis of the salt and fat content of the milk product and, in the case of flavoured milk products, an analysis of the added sugar content of the milk product. ';
24. Annexes 1 and 2 shall read as follows:

Transitional provisions
1. The application for aid for products for the school year 2024 / 2025 submitted pursuant to Article 6 of the Government Regulation No 74 / 2017 Coll., as effective before the date of application of this Regulation, shall be subject to Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation.
2. The application for aid for accompanying educational measures for the school year 2024 / 2025 submitted pursuant to Article 9 of Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation, shall be subject to Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 15 February 2025.
