DECLARATION
of 17 January 2012
on further studies and, where appropriate, teaching which are considered to be secondary school studies for the purposes of State social assistance and pension insurance
The Ministry of Education, Youth and Sports, in agreement with the Ministry of Labour and Social Affairs, provides pursuant to § 15 of Act No. 117 / 1995 Coll., on State Social Support, and § 108 (3) of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 220 / 2011 Coll.:
Recognisable types and forms of study
For the purposes of state social support and pension insurance, secondary school studies, if they are carried out in the Czech Republic, are also considered as secondary school studies.
(a) training in diagnostic classs1),
(b) preparation for admission as a member of the Order or of a similar community of the Church or of a religious society registered under the Act on Churches and Religious Societies (2), which shall last for at least 1 year for a maximum of 2 years;
(c) studies carried out under foreign secondary education programmes by educational institutions operating in the Czech Republic where:
1. an educational institution is a legal person having its registered office, central administration or principal place of business in the territory of a Member State of the European Union, or has been established or constituted under the law of a Member State of the European Union, provided that compulsory education is permitted by the Ministry of Education, Youth and Sports in that educational institution and in that training programme under the Education Act (3);
or
2. takes place in educational institutions established in the Czech Republic in diplomatic missions or consular offices of foreign states.
Transitional provisions
(1) The study in the one-year course of foreign languages with daily teaching provided for in Section 1 (a) of Decree No 322 / 2005 Coll., on further study and, where appropriate, teaching which is considered to be a secondary or higher education for the purposes of State social support and pension insurance, as effective until the date of entry into force of the Decree, initiated in the school year 2012 / 2013, is considered to be a secondary school for the purposes of State social support and pension insurance.
(2) Study at universities under Section 2 of Decree No 322 / 2005 Coll., on further study and, where appropriate, teaching which is considered to be a secondary or higher education for the purposes of State social support and pension insurance, as effective until the date of entry into force of the Decree, which was initiated by 1 September 2012 at the latest, is considered to be a higher education for the purposes of State social support and pension insurance.
Repeal
The following shall be deleted:
1. Decree No 322 / 2005 Coll., on further studies and, where appropriate, teaching which are considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance.
2. Decree No. 167 / 2006 Coll., amending Decree No. 322 / 2005 Coll., on further studies and, where appropriate, teaching which are considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance.
3. Decree No. 423 / 2006 Coll., amending Decree No. 322 / 2005 Coll., on Further Study and, where applicable, Teaching, which are considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance, as amended by Decree No. 167 / 2006 Coll.
4. Decree No. 225 / 2007 Coll., amending Decree No. 322 / 2005 Coll., on further studies and, where appropriate, teaching which are considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance, as amended.
5. Decree No. 325 / 2008 Coll., amending Decree No. 322 / 2005 Coll., on further studies and, where appropriate, teaching which are considered to be secondary or higher education for the purposes of state social support and pension insurance, as amended.
6. Decree No. 249 / 2009 Coll., amending Decree No. 322 / 2005 Coll., on Further Study and, where applicable, Teaching, which is considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance, as amended.
7. Decree No. 252 / 2010 Coll., amending Decree No. 322 / 2005 Coll., on Further Study and, where appropriate, Teaching, which are considered to be secondary or higher education for the purposes of State Social Support and Pension Insurance, as amended.
Efficacy
This Decree shall take effect on 1 September 2012.
