DECLARATION
of 2 February 2007
amending Decree No. 232 / 2004 Coll., implementing certain provisions of the Act on Chemicals and Chemicals and amending certain laws concerning the classification, packaging and labelling of dangerous chemicals and chemical preparations, as amended by Decree No. 369 / 2005 Coll.
The Ministry of Industry and Trade provides pursuant to Sections 3 (7), 19 (3) and 20 (7) of Act No. 356 / 2003 Coll., on Chemicals and Chemical Products and on the amendment of certain laws:
Čl. I
Decree No. 232 / 2004 Coll., implementing certain provisions of the Act on Chemicals and Chemicals and amending certain laws concerning the classification, packaging and labelling of dangerous chemicals and chemical products, as amended by Decree No. 369 / 2005 Coll., is hereby amended as follows:
1. footnote 1 shall read:

2. in Paragraph 4 (2) (b), the following point 5 is inserted after point 4:
"5. flammable."
Points 5 and 6 shall become points 6 and 7.
3. In Article 7, the sentence "In the event that the choice of S-phrases made precisely in accordance with the criteria set out in point 6.2 of Annex No 2 leads to overcapacity or ambiguity, or if S-phrases are clearly not necessary in respect of a specific product or packaging, certain S-phrases may be deleted. '
4. In Annex No 1, Table C, in the column Identification of a dangerous substance, the words "3,5-dimethylhexahydro-1,3,5-thiadiazin-2thione (index number 613-008-00-X) 'for the entry Dazomet (ISO) are replaced by the words" 3,5- dimethyltetrahydro-1,3,5- thiadiazin-2thione'.
5. In Annex No 1, Table C, in the column Identification of a dangerous substance, the CAS number "2312-76-7 [1] 'is replaced by" 5787-96-2 [1]' for the entry 4,6-Dinitro-o-potassium cresolate [1], in the column Identification of the dangerous substance.
6. In Annex No 1, Table C, in the column Identification of a dangerous substance, the CAS number "5787-96-2 [2] 'is replaced by the number" 2312-76-7 [2]' in the column "Identification of a dangerous substance '.
7. In Annex No 1, Table C, in the column for labelling information, entry 4-Phenylbut-1-en (index number 601-051-00-7), the words "Xi R38-51 / 53 S (2-) 37-61 'are replaced by the words" Xi; N R38-51 / 53 S (2-) 37-61'.
8. In Annex No 1, Table C, in the column Identification of a dangerous substance, the words "Ioxynil (ISO) 3,5- dibromo-4- hydroxybenzonitrile '(index number 608- 007- 00-6)" Ioxynil (ISO) 3,5- dibromo-4- hydroxybenzonitrile' are replaced by the words "Ioxynil (ISO) and its salts 4- hydroxy- 3,5- diiodobenzonitrile '.
9. In Annex No 1, Table C, in the column Identification of a dangerous substance, the words "Mecoprop P (ISO) (R) -2- (4-chloro-2-methylphenoxy) propionic acid (index number 607-434-00-5) 'are replaced by the words" Mecoprop P (ISO)'.
10. In Annex No 1, Table C, in the column Identification of a dangerous substance, the words "E; Xi; R36 / 37 / 38 'are replaced by the words" Xi; R36 / 37 / 38' in the entry "4-Methylbenzenesulfonic acid, H2SO4 ≤ 5% p-toluenesulfonic acid, H2SO4 ≤ 5% (index number 016-030-00-2).
11. In Annex No 1, Table C, in the column Identification of a dangerous substance, the word "Trioctylstannane 'is replaced by the words" Trioctylstannane, compounds, with the exception of the compounds listed in that Annex', for the entry "Trioctylstannane '.
12. In Annex No 1, Table C, in the column Identification of a dangerous substance, the entry for Distillates (petroleum), light naphthenic, unrefined or mildly refined base oil (index number 649-052-00-1) is replaced by "647-41-52-2 'by" 64741-52-2'.
13. in Annex 2, point 4.2.2.3, on the methods used to classify a substance in Category 2, the sentence "These tests actually show foetal or defect in the developing embryo shall be added to the new line at the end of point (a)."
14. In Annex No 2, at the end of clause 4.2.3.1, the text after "Category 3 'is replaced by the following:
"Substances that cause concern about human fertility
Usually based on
- the results of relevant animal studies which provide sufficient evidence to seriously suspect damage to fertility, without any significant toxic effects being observed, or evidence of fertility damage, at approximately the same doses as for other toxic effects, but which are not a secondary non-specific consequence of these toxic effects, but the evidence is not sufficient to qualify for Category 2;
- other relevant information.
Substances that cause concern about possible foetal development
Usually based on
- the results of relevant animal studies which provide sufficient evidence to seriously suspect harm to the development of the foetus, without significant maternal toxicity being observed, at approximately the same doses as for other toxic effects, but which are not a secondary non-specific consequence of these toxic effects, but the evidence is not sufficient to qualify as Category 2;
- other relevant information. ';
15. In Annex 3, Part B, Table VI reads as follows:

21. in Annex 7, point 1.2:
"1.2. Where these products are classified as highly toxic, toxic or corrosive, they shall be provided with precise and easily understandable instructions for use, which shall also include, where appropriate, instructions for the disposal of empty packaging. If this information cannot be placed on the package leaflet or on the label it must be provided. '
22. In Annex 10, point 2.1:
"2.1. Glues
The following shall be indicated on the packaging of cyanide acrylate adhesives:
"Cyanoacrylate. Danger. It immediately blinds the skin and eyes. Keep out of the reach and sight of children. '
The packaging shall be accompanied by precautionary instructions. ';

Efficacy
This Decree shall take effect on 1 March 2007.
