DECLARATION
State Arbitration of the Czechoslovak Socialist Republic
of 31 January 1980
on the issue of basic conditions for the supply of printing products
The State Arbitration of the Czechoslovak Socialist Republic after discussion with the participating ministries and other central authorities pursuant to § 392 (1) of Economic Code No. 109 / 1964 Coll., as published under No. 37 / 1971 Coll. ("the Act ') provides:
SUBJECT MATTER AND SCOPE OF THE ADJUSTMENT
(1) This Decree provides
(a) delivery of non-periodical publications (1)
1. carried out by the organisation of the printing production of the publishing organisation (hereinafter referred to as the publishing house),
2. carried out by the publishing house, by the organization of book wholesale (hereinafter referred to as "book wholesale") and by the organisation of book trade (hereinafter referred to as "book trade"),
3. by book wholesale to book trade;
(b) supplies of periodical prints2)
1. carried out by the organisation of the printing works to the publishing organisation (hereinafter referred to as the publishing company),
2. carried out by publishing the organization of connections, which extends the periodical printing,
(c) supplies of economic printed matter, adjust printed matter, printed packaging and special printing products;
(2) This decree does not apply to deliveries for and from imports.
ADJUSTMENTS TO NON-PERIODIC INFORMATION
COMMON PROVISIONS
Guarantee period
(to Section 135 of the Act)
The warranty period shall be for the period during which the book trade corresponds to the consumer, but for a maximum period of 3 years from the delivery.

Consequences of infringement
(1) The rates and reproduction used in the non-periodic publication shall be in accordance with the supporting documents for the correction approved for printing (imprimed). The supplier shall also be responsible for those defects in the supply which are caused by defective printing material provided by the customer in respect of such defects in the printing material which, when the non-periodical publication was properly processed, had or could have been detected and did not inform the customer without undue delay; it does not, however, respond when it is concerned with defects in the printing material which it could not detect.
(2) The supplier is not responsible for the deviations of printing at the rate and reproduction from the draft which the customer has overlooked when approving the documents for proofreading to the printing (imprimator). This is not the case, however, if it is the deviations of the printing, which the supplier had or could have ascertained in the proper processing of the non-periodic publication.

Paragraph 26 (1) shall apply mutatis mutandis to the supplier's responsibility for printing.
FINAL PROVISIONS
Decree No. 147 / 1964 Coll., which issues the basic terms of delivery of non-periodic publications, periodical publications, economic printed matter and special printing products, is hereby repealed.
The Decree shall take effect on 1 April 1980.

11) Shopping meetings shall be conducted according to the instructions of the Ministry of Culture of the Czech Republic or the Ministry of Culture of the SSR.
13) In the production note, the registering authorities guide the material technical conditions for the issue of periodical printing in order to comply with the applicable conditions for the issue of periodical printing, in particular the registration and, where applicable, the authorised changes in registration, in particular pursuant to Sections 4 to 9 of Act No. 81 / 1966 Coll. as amended by Act No. 84 / 1968 Coll., amending Act No. 81 / 1966 Coll. and Act No. 127 / 1968 Coll., on certain transitional measures in the field of printing and other mass information and pursuant to Section 1 of Act No. 127 / 1968 Coll. The production note is valid until a new one is issued.
