laying down regulations on habilitation and appointment procedures and the vacancy of university teachers
The Ministry of Education and Culture shall, in agreement with the Central Committee of the Union of Workers of Education and Culture and with the agreement of the Central Council of Unions, determine, pursuant to § 31 (1) of Act No. 19 / 1966 Coll., on Higher Education Institutions (hereinafter referred to as "the Act ') and § 23 (2) of the Labour Code No. 65 / 1965 Coll.:

Oddíl I

Accidental proceedings for university professors
§ 1
(1) Professionals for a particular field may be appointed as assistants, scientific (artistic) staff or practitioners who meet moral policy requirements have demonstrated educational and scientific and, where appropriate, artistic competence in the habilitation proceedings, have the necessary experience and, if not for the appointment of a professor of the arts, have a scientific rank. In exceptional and justified cases, teachers may also be appointed who are not of scientific rank.
(2) The pedagogical capacity of the tenderer referred to in paragraph 1 shall be assessed in accordance with the results of his pedagogical activity.
(3) The scientific capacity referred to in paragraph 1 shall demonstrate the results of its scientific work, in particular scientific files, habilitation work, which shall be either a separate file or a set of works of the applicant and the defence thereof. Work which has not been specifically drawn up for this purpose may also be presented as habilitation work, but must not be work identical to that which was the basis for the award of another title or scientific rank. It must be a work of social importance, such as the implementation of the planned research task. In particular, the applicant shall demonstrate artistic competence by submitting works of art or an overview of performances.
(4) The required practice referred to in paragraph 1 shall, as a general rule, mean several years of professional experience in which the applicant has acquired the practical experience necessary for the teaching activity of the professor in the field concerned; the practice is carried out either in a professional workplace outside a university, in particular in the main fields of technical, economic, agricultural and medical education, or in the professional departments of a university.
§ 2
(1) The infringement procedure shall be initiated at the request of the tenderer. The application shall be submitted to the Dean of the faculty responsible for habilitation proceedings (paragraph 2). The applicant shall indicate in the application the field in which he intends to habilitate. This field is usually one of the sciences *) or the field defined according to the needs of teaching.
(2) Abatement proceedings are held at the Faculty where the proposed field is among the main fields * *) and where there is at least one professor of the relevant field. If there is no professor of the relevant field at any university, the habilitation procedure may take place at the faculty where there is at least one professor of the close field. *) In the event that the habilitation procedure is held at a faculty other than the one where the applicant is to act as a professor, the habilitation also involves a representative of the faculty to which the applicant is to operate.
(3) If it is a new branch or a border branch, the habilitation procedure may take place at one of the faculties whose subject is closest.
§ 3
(1) The request to initiate the habilitation procedure should be supported
(a) evidence of completed higher education, or the award of a degree according to the field of study;
(b) evidence of professional and educational activities.
(2) In addition to the documents referred to in paragraph 1, the application shall be accompanied by:
(a) in the field of art, a set of works of art or an overview of performances with samples and documents according to the nature of the relevant field;
(b) in other fields
(aa) evidence of achievement of scientific rank;
(bb) a list of the scientific and professional work of the candidate, marked as the basis for the habilitation procedure;
cc) habilitation work and several other most important scientific and professional work candidates.
§ 4
(1) If, after submitting a request to the applicant, the Dean finds such deficiencies or defects for which further proceedings would appear to be inefficient, in particular if the candidate does not comply with moral policy requirements, does not have completed higher education, he may not submit a list of scientific and professional work, habilitation work and other scientific and professional work, a set of works of art or an overview of performance, the Dean shall reject the application with justification.
(2) If the Dean rejects a candidate's request because he does not comply with moral policy requirements, the candidate may appeal within 15 days of receipt of the decision to the Rector. If the rector accepts the appeal of the candidate, he shall order the Dean to conduct the habilitation procedure; If the rector confirms the negative opinion, his decision is final. If the Dean rejects the applicant's application for other reasons referred to in paragraph 1, his decision shall be final.
(3) The Dean may exceptionally, after hearing the Scientific Council, initiate a habilitation procedure even if the candidate who fulfils the other conditions for initiating the habilitation procedure does not have a scientific rank. Following the successful implementation of habilitation, the Rector, acting on a proposal from the Dean, shall submit a proposal for appointment to the Ministry of Education and Culture (hereinafter referred to as "the Ministry ') by a candidate who is not of scientific rank.
§ 5
(1) The basis for habilitation will be prepared by the habilitation committee. The habilitation committee shall be at least three members; it is composed of professors, docents or managers and independent scientists of the relevant or close field. At least one of the members of the committee must be a professor. The Commission shall be appointed by the Dean and, where appropriate, after consulting the Scientific Council of the Faculty; The President shall normally appoint a professor.
(2) The Habitats Committee shall designate at least two opponents who are professors, doctors of science or teachers of the relevant or close field. At least one of the opponents must be a member of another faculty or a post outside the university. Opponents shall evaluate the candidate's scientific (artistic) competence and, if possible, teaching competence and practice in the opinion. Other expert opinions may be requested by the Habitats Committee; in the field of art, it shall also seek the opinion of the relevant artistic association.
(3) If the applicant has not demonstrated sufficient pedagogical competence, the habilitation committee may impose a public habilitation lecture.
§ 6
(1) Abatement shall take place with the participation of the candidate before the Scientific Council of the Faculty or with its approval before its section. Furthermore, members of the habilitation committee and opponents must be invited; in the cases referred to in Paragraph 2 (2), the representative of the faculty to which the applicant is to be a lecturer.
(2) Habitation is the following:
(a) the report of the habilitation committee, containing a brief description of the life and work of the candidate, an analysis of his scientific (artistic) and teaching capacity and his practice, taking into account expert opinions and, where appropriate, the expression of opponents;
(b) a debate with the candidate based on habilitation work or other work (in the art fields of a set of works or performances); the debate shall focus on the whole field;
(c) an overall assessment of the course of habilitation by the Presidents (without the participation of the candidate) and the vote of the Scientific Council or its section, which is secret;
(d) the announcement of the result of the vote with the participation of the tenderer.
§ 7
If the outcome of the vote is positive, the Dean shall submit a proposal to the Rector, who shall forward it with his observations to the Ministry. No appeal shall be admissible against decisions of the Scientific Council or its Section.
§ 8
In a university which is not divided into faculties, the habilitation procedure is conducted mutatis mutandis under the provisions of § 2 to 7; habilitation takes place before or with the agreement of the scientific council of the university. In accordance with the provisions of Paragraph 4 (2), the applicant may appeal to the Ministry against the Rector's decision.

Appointment procedure for proper and extraordinary professors of universities
§ 9
(1) Exceptional professors, teachers, scientific (artistic) practitioners or practitioners who meet moral policy requirements, have excellent scientific or artistic work, have educational competence and the necessary practice, and, if not for the appointment of proper professors of the arts, they have the scientific rank of a doctor of science. In exceptional and justified cases, proper professors and those who do not have the scientific rank of doctor of science may be appointed.
(2) Extraordinary professors for a particular field may be appointed as professors, scientific (artistic) practitioners or practitioners who meet moral policy requirements, have created significant scientific or artistic work, have the educational capacity and the necessary practice, and, first, have a scientific rank on the appointment of extraordinary professors of the arts. In exceptional and justified cases, special professors and those who do not have a scientific rank may be appointed.
(3) The pedagogical capacity of the tenderer referred to in paragraphs 1 and 2 shall be assessed in accordance with the results of his pedagogical activity.
(4) The scientific competence referred to in paragraphs 1 and 2 shall be demonstrated by the tenderer by the results of his or her scientific work, in particular by submitting a set of his or her work, corresponding to the scope and level of the required qualifications. The applicant shall demonstrate artistic competence by analogy, in particular by submitting a set of works of art or an overview of performance.
(5) The required practice referred to in paragraphs 1 and 2 shall, as a general rule, mean the many years of professional experience in which the applicant has acquired the practical experience necessary for the teaching activities of the professor in the field concerned; practice shall be carried out either at a professional place of work outside a university, in particular in the main fields of technical, economic, agricultural and medical sciences, or at university workplaces.
§ 10
Paragraph 2 shall apply mutatis mutandis to the initiation of the appointment procedure.
§ 11
(1) The request to initiate the appointment procedure should be supported by:
(a) evidence of completed higher education and, where appropriate, of the award of a degree according to the relevant field of study;
(b) evidence of professional and educational activities.
(2) In addition to the documents referred to in paragraph 1, the application shall be accompanied by:
(a) in the field of art, a set of works of art or an overview of performances with samples and documents according to the nature of the relevant field;
(b) in other fields
(aa) evidence of achievement of scientific rank;
(bb) a list of scientific and professional work;
(cc) the most important scientific and professional work.
§ 12
(1) If, after submitting a request to the tenderer, the Dean finds such deficiencies or defects as would appear to be inefficient for which the proceedings would appear to be inefficient, the provisions of Paragraph 4 (1) and (2) shall apply mutatis mutandis to the next procedure.
(2) Paragraph 4 (3) shall apply mutatis mutandis to the opening of the appointment procedure with a non-scientific tenderer.
§ 13
(1) The documents for the meetings of the Scientific Council on the nomination proposal shall be prepared by the draft committee. The design committee shall be at least three members. It consists of:
(a) for the appointment of regular professors from ordinary professors, doctors of science and senior scientists of the relevant or close field; the chair shall always be a full professor;
(b) for the appointment of extraordinary professors from ordinary professors or special professors, doctors of science and senior scientists of the relevant or close field; the chair is always a proper or extraordinary professor.
The nominee committee and its chairman shall be appointed by the Dean after consulting the Scientific Council of the Faculty.
(2) The design committee shall identify three opponents; two of them must be professors or doctors of the sciences of the relevant or close field. At least one of the opponents must be from another faculty or a workplace outside the university. Opponents shall evaluate the candidate's scientific (artistic) competence and, if possible, educational competence and practice in the assessment. In particular, it shall assess the level and importance of the main work of the tenderer. The design committee may also request further expert opinions; in the fields of art it shall also seek the opinion of the relevant artistic association.
(3) If the applicant has not demonstrated sufficient pedagogical competence, the draft committee may order a public lecture.
§ 14
(1) The proposal to appoint an ordinary or extraordinary professor shall be discussed before the Scientific Council of the Faculty with the participation of the candidate. In addition, members of the design committee, opponents and, where the appointment procedure is held at a faculty other than the one where the candidate is to be a full or extraordinary professor, the representative of the faculty to which the candidate is to be active shall be invited.
(2) The negotiations shall take place as follows:
(a) a report by the draft committee containing a brief description of the life and work of the candidate, an analysis of his scientific (artistic) and teaching capacity and practice, in particular an evaluation of his main scientific work, their importance and contribution to the development of the field;
(b) the voice of the opponents and the debate with the applicant on the importance of his work in social practice;
(c) an overall assessment of the conduct of the appointment procedure by the Presidents (without the participation of the candidate) and the vote of the Scientific Council of the Faculty, which is secret,
(d) the announcement of the results of the vote with the participation of the tenderer.
§ 15
(1) If the outcome of the vote is positive, the Dean shall submit a proposal to the Rector for consideration in the Scientific Council of the College. If the Scientific Council of the College approves the proposal by secret ballot, the Rector shall send it to the Ministry.
(2) The provisions of paragraph 1 shall not apply where it is provided in the Statute of the College that proposals for the appointment of ordinary and extraordinary professors shall be discussed only in the Scientific Council of the Faculty. In this case, the Dean shall submit the proposal discussed in the Scientific Council to the faculty, the rector, who shall forward it with his observations to the Ministry.
(3) No appeal shall be admissible against decisions of the Scientific Council of the Faculty and against decisions of the Scientific Council of the College or its Section.
§ 16
In a university which is not divided into faculties, the appointment procedure is conducted mutatis mutandis in accordance with § 10-15; the appointment procedure shall be held before the Scientific Council of the College. The applicant may appeal to the Ministry, mutatis mutandis, in accordance with the provisions of Paragraph 12 (1).

Oddíl III

Employment of professors and university teachers
§ 17
The vacancies of professors and teachers in higher education institutions in a particular field are usually filled within the limits set by the Ministry on the basis of bankruptcy by persons who have obtained a scientific or artistic degree under Sections I and II of this Decree.
§ 18
Application for bankruptcy must be supported
(a) proof of Czechoslovak citizenship, unless they are workers under Section 30 of the Act,
(b) evidence of completed higher education and title according to the relevant field of study;
(c) evidence of achievement of scientific rank,
(d) evidence of the acquisition of a scientific degree;
(e) evidence of scientific (artistic) and educational activities.
§ 19
(1) The documents for the bankruptcy proceedings shall be prepared by the bankruptcy committee at the faculty, for which the provisions of Section 5 (1) apply mutatis mutandis, and for the professors, Section 13 (1).
(2) The competition committee will discuss the applications received and propose the ranking of candidates.
(3) If appropriate, the habilitation or design committee may also perform the functions of the bankruptcy committee or that committee may perform the functions of the habilitation or design committee.
§ 20
After consulting and examining the applicant's application by the bankruptcy committee, the Dean shall, after consulting the Faculty's Scientific Council or its section, select the most suitable candidate and take the necessary steps to negotiate the employment contract.
§ 21
Where habilitation or appointment procedures are being conducted at the same time to fill the vacancies of professors and teachers, vacancy shall only take place when the candidate has obtained a scientific degree.
§ 22
If the filing of the bankruptcy would appear to be inefficient, especially for the exceptional level of the applicant, the Rector or Dean (§ 28 (1) of the Act) may waive it. In this case, the provisions of Sections 18 and 20 shall apply mutatis mutandis to the filling of the vacancy of professors and teachers.
§ 23
In a university which is not divided into faculties, proceedings are conducted before the Scientific Council of the University or its Section.

Oddíl IV

Support expenditure for operations and programmes in the "Agriculture and rural development 'policy area
§ 24
(1) The vacancies of professional assistants and lecturers shall be filled on the basis of bankruptcy where appropriate.
(2) The vacancies of assistants and training instructors are usually filled without bankruptcy.
§ 25
The vacancy may be filled:
(a) if he / she is a vocational assistant, a graduate of the relevant or related field of higher education, which meets the moral and political requirements, he / she is entitled to scientific (artistic) and pedagogical work and to at least three years' experience in the field after reaching university education;
(b) if he / she is a lecturer, a graduate of the relevant or close field of higher education, which meets the moral and political requirements, he / she has the qualifications for teaching work mainly from a methodological point of view and has at least five years of experience in the relevant field, usually at a school providing secondary education;
(c) if he / she is an assistant, a graduate of the relevant or close field of higher education, which meets the moral and political requirements and is eligible for scientific and educational (artistic) activities;
(d) if he / she is a vocational instructor, a graduate of a four-year vocational school which meets moral and political requirements and has such working experience and skill as to assist in teaching and scientific research activities of teachers, prepare, where appropriate, practical workshops or laboratory exercises, etc.; the conditions of vocational education may be waived in art and technology.

Oddíl V

Common, transitional and final provisions
§ 26
The provisions of Sections I and II of this Decree shall apply mutatis mutandis to the examination of a university proposal if a proper professor, an extraordinary professor or a lecturer is to be withdrawn (Sections 24 (2) and 29 (2) of the Act).
§ 27
In universities which are not divided into faculties, the Rector performs the duties of the Dean under this decree.
§ 28
In particular justified cases, the Minister may allow exceptions as regards the requirements for tenderers and the method of habilitation and appointment.
§ 29
This decree shall also apply to the examination of applications to initiate the habilitation procedure for professors or appointment procedures for university professors submitted before 1 May 1966. Proposals for appointments already approved by the Scientific Council of the College before that date will be assessed according to existing regulations.
§ 30
The competence of the Minister or, where applicable, of the Ministry pursuant to § 4 (3), § 8, § 15 (1) and (2), § 17 and § 28 shall be exercised in Slovakia by the delegate or, where appropriate, the delegate of the Slovak National Council for Education and Culture.
§ 31
The Directives on habilitation and bankruptcy proceedings at universities of 8 August 1958, Nos 35 975 / 58 - III / 1 (MŠK Bulletin, in 1958, paragraphs 23 and 24, p. 244), as amended by the Directives of 8 March 1962 No 11 014 / 62 - L (MŠK Bulletin, in 1962, p. 9, p. 101), are hereby repealed.
§ 32
This Decree shall take effect on 1 May 1966.
