DECLARATION
Ministry of Transport and Communications
of 2 August 2000
amending Decree No. 100 / 1995 Coll., laying down the conditions for the operation, construction and production of designated technical installations and their specification (Order of designated technical installations)
The Ministry of Transport and Communications provides pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., for implementation of § 47 (2) and § 48 (1):
Decree No. 100 / 1995 Coll., laying down the conditions for the operation, construction and manufacture and specification of designated technical equipment (Order of designated technical equipment), is amended as follows:
1. in Paragraph 1 (2) (b):
"(b) steam generators on railway vehicles, as well as steam and hot water boilers with a working pressure greater than 0,05 MPa or a permissible temperature greater than 110 ° C."
2. In Paragraph 1 (4) (g), the word "force 'is replaced by" heavy current'.
3. in Article 1 (5) (e), the words "container cranes," shall be inserted before the word "frontal";

"Conditions for operation of equipment
Only equipment having a valid licence issued by the railway authority may be used in the operation of the runway and railway transport and provided that the following operational conditions are met:
(a) carrying out regular revisions, inspections and tests;
(b) ensuring proper and safe operation of the equipment by the operator;
(c) continued compliance with operational technical parameters as specified in the technical documentation. ';
5. In Article 3, at the end of paragraph 1, the dot is replaced by a comma and the following point (e) is added:
"(e) prevent the release of residual vapours resulting from the filling and emptying of pressure vessels of railway tanks and tank containers of petrol and other volatile organic substances in service stations and terminals, using intermediate vapour storage.";

The technical documentation of the equipment shall include:
(a) the name of the device, the type designation and the manufacturer;
(b) the technical conditions of the installation;
(c) a technical description of the equipment, including a description of the functions of each part of the safety and safety features;
(d) drawings and diagrams of the equipment,
(e) technical calculations,
(f) instructions for the operation and maintenance of equipment, inspection and assessment of operational competence. ';
7. in Article 5 (2) (b):
"(b) in the case of gas equipment, by visual inspection, inspection of leakage, ventilation function, sealing function, regulatory, safety and measuring equipment and compliance with technical parameters,"
8. in Article 5 (2) (c):
"(c) in the case of electrical equipment, by visual inspection of the equipment, by measuring the electrical parameters and by testing the function, check the overall condition of the equipment with a focus on its safety;"
9. in Article 5 (2), the following point (d) is inserted after point (c):
"(d) for lifting and transport equipment:
1. visual inspection of the condition of the equipment and control of the operation of the equipment without load (operational revision),
2. control in the scope of the operational revision supplemented by a functional test with operational load (revision), ';
Point (d) shall be renumbered as point (e).
10. In Article 5, the following paragraph 3 is added:
"(3) The revision report drawn up by the revision technician shall always contain the precise identification of the equipment, the focus of the revision, the business name of the operator, the location of the installation, the established status of the installation, the expression on the operational capability of the installation, the name, surname and signature of the inspection technician, the number of its certificate and the date on which the revision was carried out. ';
11.
(1) The inspections and tests of installations in operation2) shall be carried out at the intervals specified in Annex 3.
(2) The inspection and test referred to in paragraph 1 shall check the documents, the conformity of the equipment with the technical documentation and shall be carried out:
(a) pressure equipment
1. visual inspection of the pressure equipment and its equipment, focusing on the state of the external and internal surface of walls and welds (inspection),
2. test of pressure equipment equipped with a test or working substance with the highest working pressure to check the leakage of the pressure component (leak test);
3. pressure equipment test with a liquid test pressure to check the leakage and strength of the pressure unit (pressure test);
4. after the pressure test inspection, operational revisions shall be carried out for the equipment referred to in paragraph 4, 5, 6 of Annex 3,
(b) gas installations
visual inspection of equipment, leak check of equipment, ventilation function, lock function, regulatory, safety and measuring equipment, compliance with technical parameters of equipment, equipment with safety marks, tables and fire protection equipment,
(c) electrical equipment
visual inspection of the overall condition and equipment, control of the main parameters of the equipment by measuring and functional testing of the equipment (inspection and test),
(d) for lifting appliances:
Control of equipment and equipment status, control of operational parameters by measurement, functional test without load and functional test with maximum operational load (inspection and test),
(e) for transport facilities:
Check the condition of the equipment and equipment, check the operational parameters by measuring, functional test without load and functional test with maximum operational load (inspection and test). The maximum operational load test shall not be carried out on moving steps, moving pavements and cableways.
(3) The entry of the inspection carried out and the examination carried out by the inspector (hereinafter referred to as the "Protocol") always contains the precise identification of the establishment, the business name of the operator, the location of the establishment, the description of the inspection and the tests carried out, the state of the establishment established, the expression of the operational capacity of the establishment and the determination of its time, the name, surname and signature of the inspector, the number of its certificate and the date on which the inspection and test were carried out.
(4) The Protocol shall be drawn up in triplicate; one shall be received by the operator of the installation, one by the Railway Authority and one shall be retained by the inspector who carried out the inspection and test.
(5) The revision reports and inspection and test reports must be accompanied by an installation licence with the operator.
(6) The inspection and test outside the time interval set out in Annex 3 shall be subject to the equipment:
(a) after removal, if disassembly has taken place;
(b) has not been in service for more than two years;
(c) following an emergency affecting the operational capacity and safety of the installation.
(7) A technical inspection and examination by a legal person designated by the Ministry of Transport and Communications (3) will be carried out following an intervention in the equipment by welding (repair, reconstruction) or an intervention in the equipment which means a derogation from the technical documentation.

12. in Article 7 (1):
"(1) Revisions, inspections and tests shall be carried out at the latest at the time intervals set out in Annexes 1, 2 and 3. ';
13. in Paragraph 8 (1):
"(1) The service, maintenance and repair of the equipment may be entrusted only to a person who has been properly informed, practically trained and tested on the equipment. Only a person with an electrical qualification as referred to in Annex 4 may be entrusted with the operation of an electrical installation. ';
14. In Article 8, the following paragraph 3 is added:
"(3) The service of the locomotive boiler may be entrusted only to a person who has been properly informed of the operation on the equipment, has been practically practised and its competence demonstrated by an examination carried out by the pressure equipment inspector. ';
15. in Article 9, the following paragraph 3 is added:
"(3) The conditions for the construction and manufacture referred to in Section 3 shall not apply to products which are specified products under a specific legislature.4)

16. In Annex 1, the words "and steam generators' in point 3 of the entry for pressure equipment are replaced by" on track vehicles'.
17. In Annex 1, the pressure equipment item 5 reads:

18. In Annex 1, the words "and container containers' shall be deleted from the item Pressure equipment item 11.
19. In Annex 1, Pressure equipment, the following point 17 is added:

When carrying out regular revisions, the shortest of the time intervals determined according to external influences (Part I of this Annex) and according to the type of area with increased risk to persons (Part II of this Annex) shall always apply. ';
24. In Annex 3, pressure equipment item 1, the number "5 'is replaced by" 6'.
25. In Annex 3, pressure equipment of point 4, the number "10 'is replaced by" 6'.
26. In Annex 3, Pressure equipment, the following point 16 is added:

"Annex No 4 to Decree No 100 / 1995 Coll.
Electrotechnical qualification in activities on designated technical installations
1. The activities (operation, inspection, repair, maintenance, assembly and testing) on technical electrical equipment, equipment for protection against atmospheric and static effects, equipment for protection against the negative effects of back traction currents, if these are designated technical installations (hereinafter referred to as "electrical equipment"), may only be carried out by persons who meet professional qualifications in electrical equipment under the conditions set out in this Annex.
2. In order to ensure professional qualifications in electrical engineering, three degrees are established, namely "person trained '," person trained' and "person trained with higher qualifications'.
3. A person who has been proven to have been familiar with the technical standards related to the activity on electrical equipment of the type concerned and the voltage to be exercised and, where appropriate, to be controlled, the instructions of the electrical equipment manufacturer, the instructions of the electrical equipment operator, the principles of first aid for electrical accidents, the warning of potential hazards to electrical equipment and practically being trained shall be considered to be "the person who has been instructed '.
4. A person shall be considered as "a person of knowledge '.
(a) with secondary vocational training acquired in the field of education classified in the group of disciplines 26 according to the Single Classification of the fields of education and, where applicable, the Classification of tribal fields of education, 1)
(b) with full secondary vocational training acquired in the field of education classified in the group of disciplines 26 according to the Single Classification of fields of education and, where appropriate, the Classification of tribal fields of education, 1)
(c) higher vocational education obtained in the field of education, classified in the group of disciplines 26, according to the Single Classification of fields of education and, where applicable, the Classification of tribal fields of education, 1); or
(d) with higher education achieved in study programmes of the group of disciplines 26 Classification of tribal fields of education, 1)
which has been trained to the extent of its working on an electrical installation and its knowledge has been verified by a test carried out by the electrical equipment operator and carried out by a person with a higher qualification for activity on the electrical equipment of the relevant type and voltage.
5. A "person with a higher qualification 'shall be considered as" a person who fulfils the qualifications of a person with a higher qualification and has professional experience in the length of:
(a) at least two years if they have a higher education;
(b) at least two and a half years if they have higher vocational education;
(c) at least three years if they have full secondary vocational training; or
(d) at least four years if they have a secondary vocational education;
of which at least one year on electrical equipment of the relevant type and voltage and its knowledge have been verified by a test provided by the electrical equipment operator. The test shall be carried out in front of at least two members of the panel, with at least one member of the panel qualified at the level of a person with a higher qualification for the management or operation of electrical equipment of the relevant type and voltage.
6. The person instructed may carry out the following activities:
(a) to operate electrical equipment;
(b) perform the other activities referred to in point 1, except for operators, on a low voltage electrical device without voltage;
(c) carry out, under the supervision of a person with an electrical qualification of a higher degree who is satisfied that the necessary safety measures are implemented, more detailed instructions for the operation and, where appropriate, occasionally checks on compliance with safety regulations, other activities as referred to in point 1, excluding operators, on electrical equipment of high and very high voltage without voltage and near live parts of low voltage electrical equipment, while respecting the minimum distances specified by the relevant safety regulations;
(d) carry out, under the supervision of a person with a superior qualification, responsible for compliance with the relevant safety regulations, other activities as referred to in point 1, excluding operators, near live parts of high and very high voltage electrical equipment, with minimum distances specified by the relevant safety regulations;
(e) to manage or carry out activities on railway superstructure and substructure, including stowage on electrified lines and lines whose tracks form part of circuits for electrical heating of trains;
(f) to operate electrical pre-heating devices, including the handling of connections for the supply of electric power to the train vehicles;
(g) to operate section disconnect and cut-off line.
7. The person known may carry out all the activities of the person instructed; and
(a) carry out the activities referred to in point 1 on an electrical device without voltage;
(b) work under the supervision of a person with a higher qualification in the vicinity of live parts of high and very high voltage, while respecting the minimum distances given by the relevant safety regulations and on those parts under voltage;
(c) work separately in the vicinity of live parts of low voltage, while respecting the minimum distances specified by the relevant safety regulations;
(d) to work separately on live parts of low voltage except in cases covered by the relevant safety regulations.
8. A person with higher qualifications may carry out all the activities of a person with higher qualifications, and
(a) carry out the activities referred to in point 1 on electrical equipment without restriction, except in the cases provided for in the relevant safety regulations;
(b) direct the operation of persons on electrical equipment or the operation of electrical equipment;
(c) design electrical equipment.
9. Knowledge, warnings, practical training and verification of the knowledge of the person instructed will be provided by the operator of the electrical equipment and performed
(a) for the operation of electrical equipment, a person with an electrical qualification appropriate to the nature of the work, but not less than the person instructed;
(b) for other work activities as referred to in point 1, except for operators, a person with knowledge.
10. Practical training of the person instructed shall be carried out to the extent of the work that the person will perform.
11. The subjects of the tests and examinations referred to in paragraphs 4 and 5 shall be:
(a) the technical standards related to the working activity of the electrical equipment of the type concerned and the voltage to be exercised by the tested worker, where appropriate;
(b) rules to ensure safety and health at work relating to work on electrical equipment of the type concerned and to manage, where appropriate, the stress to be exercised by the tested worker;
(c) local work and safety regulations, orders, directives and instructions relating to the working activity of the electrical equipment of the type concerned and the voltage to be exercised and, where appropriate, managed by the tested worker;
(d) theoretical and practical knowledge of the provision of first aid, in particular in electrical accidents.
12. The certificate shall be issued by the person who carried out the verification.
13. A written report annexed to the examination shall be drawn up by the examination panel on the performance of the "persons with higher qualifications' test, accompanied by documentary evidence of the knowledge of the tested person. The content of the protocol signed by all members of the Commission, together with the subject, is the evaluation of the test carried out according to the scale
(a) "benefit,"
(b) "failed."
14. The electrical equipment operator responsible for the tests of persons referred to in point 5 shall notify the date and place of the tests at least four weeks in advance to the Dresden Office.
15. The examination committee shall issue a certificate of verification of the electrical qualification "of a person with a higher qualification '. The certificate shall indicate what activity on the electrical equipment can be performed by a person, that is, whether he can perform only a separate activity, whether he can direct the activity of persons, whether he can control the operation of the electrical equipment, or whether he can design the electrical equipment. If the activity under this certificate is not carried out by its holder for more than three years, the holder shall be considered as having no such electrical qualification.
16. Operator of electrical equipment
(a) stores test reports;
(b) keep a register of the documents issued concerning the relevant electrical qualification;
(c) keep a record of the certificates issued for the respective electrical qualifications.
17. If the railway administration finds that an electrotechnical qualified person under this Annex has deficiencies in his activities which substantially affect the correct functioning and safe operation of the electrical equipment, it may order an extraordinary examination to the extent necessary. ';
This Decree shall take effect on 1 September 2000.
