DECLARATION
of 18 August 2016
on the transmission of data to the register of applications for recognition of foreign higher education and qualifications
According to § 87 (1) (g) (4) and § 90b (3) of Act No. 111 / 1998 Coll., on Higher Education, and amending and supplementing other laws (Act on Higher Education), as amended by Act No. 137 / 2016 Coll.:
Subject matter
This decree regulates
(a) the format and structure of the data report by which, through public higher education institutions, the Ministry of Defence and the Ministry of Interior, they enter into the register the procedures for applications for recognition of foreign higher education and qualifications (hereinafter referred to as "the register") the data relating to each administrative procedure they have conducted on the application for recognition of foreign higher education and qualification in the Czech Republic under Section 89 of the Higher Education Act (hereinafter referred to as "the proceedings");
(b) the technical conditions and deadlines for the transmission of the data referred to in (a).
Data message format and structure
(1) The data in the register are transmitted to the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry") by electronic forms. The permissible data message format is XML.
(2) The structure of the data report to be transmitted to the register of the management data held at first and, where appropriate, second shall consist of the following data which are known at the time of transmission:
(a) the name of the authority which decides on the application for recognition of foreign higher education and qualifications in the Czech Republic (hereinafter referred to as "the application for recognition") in the proceedings at first instance and, where appropriate, the name of the authority which decides on the appeal or decomposition procedure at second instance against the decision of the institution at first instance on the application for recognition;
(b) data identifying applicants (2),
(c) data identifying foreign higher education and qualifications:
1. the name of the foreign educational document (3) (hereinafter referred to as "qualification"), as indicated on the original or an officially certified copy of the original qualification (hereinafter referred to as "authentic version"), and, where appropriate, in the Czech and English translations, if the application for recognition was accompanied by an officially certified translation of the rating text in that language; where the title is not authentic in the Latin language, only its translation shall be indicated, and in the case of bilateral or multilingual qualifications, the authentic language shall preferably be considered to be in the English language or, where appropriate, in another language used in the Latin language,
2. a numerical or other rating sign, if indicated on the rating, including, where appropriate, letters indicating the rating series; if the qualification is not in Latin, the letters shall be translated into Czech or English,
3. the date of issue of the rating,
4. the title of the study programme and the field of study in authentic language, including Czech and English translations, if the application for recognition was accompanied by an officially certified translation of the text of the qualification in that language; If the title is not authentic in Latin, only the translation shall be given,
5. code numbers of the study programme and field of study, if any,
6. the name of the foreign university which issued the qualification (4), in authentic language, including Czech and English translations, if any, if the application for recognition was accompanied by an officially certified translation of the text of the qualification into that language; If the title is not authentic in Latin, only the translation shall be given,
7. address of the head office of a foreign university,
8. the designation of the State under whose legal order the qualification has been issued;
9. place of education, if different from the head office of a foreign university;
(d) data identifying the procedure and its outcome:
1. the file mark under which the proceedings were carried out at first instance and, where appropriate, the file mark under which the proceedings were carried out at second instance;
2. the date of receipt of the request for recognition by the first stage authority; Where an appeal or a breakdown has been lodged against the decision on the application, the date of service of that appeal to the first instance authority and, where appropriate, the date of subsequent service of the file to the second stage authority, if it has been transmitted to it,
3. the outcome of the proceedings;
4. the number of the decision on the application for recognition given in the procedure at first instance and, where appropriate, the number of the decision given in the procedure at second instance;
5. if a request for recognition has been granted, the type of study programme in which equivalent higher education is achieved in the Czech Republic;
6. the date on which the decision on the application for recognition was drawn up in the procedure at first instance and, where appropriate, the date on which the decision was drawn up at second instance;
7. the date of the decision on the application for recognition given in the proceedings at first instance and, where appropriate, the date of the decision taken at second instance;
8. The date on which the decision on the application for recognition was taken in the proceedings at first instance and, where appropriate, the date on which the decision given at second instance was taken in the case of legal power;
9. the name and surname, telephone connection and e-mail address of the public university staff or of the Czech Republic members of the competent central administrative office entering the data in the register or of the civil servants serving in the competent central administrative office entering the data in the register, responsible for entering the data or consulting the register, and the date on which their mandates are established.
Technical conditions and deadlines for data transmission
(1) The data shall be entered in the register within the time limits referred to in paragraph 2 in accordance with descriptions of the structures of individual data published by the Ministry.
(2) The entries shall be entered in the register immediately after the relevant event, no later than 10 working days.
(3) The descriptions of individual data structures are published by the Ministry on the Ministry's website.
Efficacy
This Decision shall enter into force on 1 January 2017.
