DECLARATION
of 12 October 2007
amending Decree No. 451 / 2000 Coll., implementing Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 244 / 2000 Coll., as amended
The Ministry of Agriculture provides pursuant to § 3 paragraphs 11 and 13 of Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 244 / 2000 Coll. and Act No. 21 / 2004 Coll.:
Decree No. 451 / 2000 Coll., implementing Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 244 / 2000 Coll., as amended by Decree No. 343 / 2001 Coll., Decree No. 472 / 2001 Coll., Decree No. 169 / 2002 Coll., Decree No. 544 / 2002 Coll., Decree No. 284 / 2003 Coll., Decree No. 434 / 2003 Coll., Decree No. 184 / 2004 Coll., Decree No. 77 / 2005 Coll. and Decree No. 84 / 2006 Coll., is amended as follows:
1. In footnote 1b, the sentence "Commission Directive 2006 / 77 / EC of 29 September 2006 amending Annex I to Directive 2002 / 32 / EC of the European Parliament and of the Council as regards maximum levels of organochlor compounds in feedingstuffs' is added at the end of the text.
2. Paragraph 4 (2) reads as follows:
"(2) In feed additives containing additives classified in the category of growth promoters, coccidiostats and histomonostats or vitamins A, vitamin D2 or D3, copper, selenium or zinc, classified in the category of nutritional additives, the proportion of the dosage of the complementary feed in complete feed shall be determined by the concentration factor of the additive in the feed additive (the concentration factor). The maximum levels of the concentration factor for each additive shall be those for the composition and dosage of the complementary feed in complete feed. ';
3. In Article 4, paragraphs 3 to 5 are added, including footnote 2b:
"(3) The concentration factor of the additive in feed additive is the ratio of the feed additive content in 1 kg of feed additive and the maximum content of the additive authorised by the relevant legislation2b) in 1 kg of complete feedingstuff with a moisture content of 12%.
(4) The method of calculation of the concentration factor and the maximum concentration factor value for the specified additives are set out in Annex No 8A for additional feedingstuffs for the relevant species and categories of animals.
(5) The provisions of paragraph 2 shall not apply to complementary feed supplied in blocks or in the form of a lick and to complementary feed for non-food producing animals.
(2b) Regulation (EC) No 1831 / 2003 of the European Parliament and of the Council on additives in animal nutrition. "
4. In Annex 3, Part I, points 17 to 26 read:

"(14) Maximum aldrin and dieldrin content, individually or in combination, expressed as dieldrin.
15) Numbering system according to Parlar, with a prefix, CHB 'or, Parlar':
CHB 26: 2-endo, 3-exo, 5-endo, 6-exo, 8,8,10,10-octochlorbornan,
CHB 50: 2-endo, 3-exo, 5-endo, 6-exo 8,8,9,10,10-nonachlorobornan
CHB 62: 2,2,5,5,8,9,9,10,10-nonachlorobornan. '
7. the following Annex 8A is inserted after Annex 8:
"Annex No 8A to Decree No 451 / 2000 Coll.
1. For the calculation of the concentration factor (CF), the levels of the additive (LA) content in kg of complementary feed and the maximum content of the additive (MCA) authorised in kg of complete feedingstuff with a moisture content of 12% shall be used according to the formula:

2. The limit values for concentration factors authorised for additives in feed additives are:

Efficacy
This Decree shall take effect on the date of its publication, with the exception of Article I (2), (3) and (7), which shall take effect on 19 June 2008.
