Ministry of Transport and Communications
of 2 August 2000
on the maritime register and documents of seagoing vessels
The Ministry of Transport and Communications provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on Maritime Navigation (hereinafter referred to as "the Act ') for the implementation of § 8 (3), § 11 (5), § 20 (7) and § 27 (2) of the Act:
§ 1
Preliminary provisions
This decree provides
(a) the method of keeping records of seagoing vessels;
(b) basic technical data on seagoing vessels entered in the maritime register of the Czech Republic (hereinafter referred to as the maritime register),
(c) the particulars and model of the application for registration of a seagoing vessel in the maritime register and the details of the documents by which the application for registration of a seagoing vessel in the maritime register must be supported;
(d) details of the granting of provisional authorisation for navigation;
(e) the types of paper documents and their particulars.

METHOD OF LEADING THE VESSEL VESSELS 'EVIDENCE
§ 2
The registration of seagoing vessels shall be carried out by entering the data in the maritime register and in the registration document for recording the submission.
§ 3
Breakdown of the register
(1) The register for keeping separate records referred to in Article 7 (3) of the Act shall indicate the number of numbered sheets and the date of the first and last entries.
(2) The register consists of seagoing vessel registers which have the same number as the maritime vessel registration number.
(3) Registers of seagoing vessels are arranged in the sheets of the registers of each seagoing vessel with the following marking and content:
(a) sheet I. with the content of the entry of the particulars referred to in § 8 (1) (a) to (d), (g) and (i) to (l) of the Act;
(b) sheet II. containing the entry of the particulars referred to in § 8 (1) (e) and (f) of the Act;
(c) sheet III containing the entry of the information referred to in Section 8 (1) (h) of the Act.
Type of entry
§ 4
(1) For registration, a register of seagoing vessels shall be established in the register, marked with the relevant maritime vessel registration number. A further entry relating to a seagoing vessel already registered shall not be given a new registration number but shall be added to the seagoing vessel's registration number. The register number under which the seagoing vessel is entered in the maritime register shall be retained by that vessel until its deletion has been registered.
(2) The entries in the register shall be made on the basis of a decision on registration in the maritime register no later than one month after the decision has been taken, without waiting for the decision to be taken, in the order of the entry of the application for transposition into the registration document for the registration of the application for registration in the maritime register (hereinafter referred to as the "register file").
(3) The note column shall record in the ordinary pencil the fact that the decision referred to in paragraph 2 has not yet taken legal authority immediately after the entry. Immediately following the acquisition of the legal power of this Decision, this alert shall be deleted and the note column shall record the fact that the decision referred to in paragraph 2 has acquired legal authority, indicating the date on which the legal authority took place and the number of that decision.
(4) The person responsible for carrying out the entries in the maritime register shall be responsible for the accuracy of the entries.
§ 5
(1) It is entered in the maritime register legibly, without the use of abbreviated words, pen or pencil with ink refill (pen pen). Comments on the movement of a seagoing vessel's registration insert when viewed in the maritime register shall be marked in the notes column with a plain pencil so that they can be removed once they have lost their meaning.
(2) Minutes shall be made in the Czech language.
(3) Empty places to be created during registration shall be crossed after completion of the registration.
(4) Each entry shall be separated by a horizontal line, shall bear the date of registration and be signed by the person responsible for the management of the maritime register.
(5) For data, the day, month, words and year shall be given, with all digits of the year.
§ 6
(1) The new registration in the maritime vessel register shall be accompanied by a reference to the previous entry, which shall be replaced by a new entry; a reference to the new registration shall be made to the previous entries.
(2) An amendment to the registration in the maritime vessel register may be made only by a new entry. The entry must not be crossed, deleted or made illegible.
(3) The correction of the typing error and other obvious inaccuracy of the registration in the registration pad of a seagoing vessel shall be corrected at any time by making the correct registration and underlining the corrected registration.
§ 7
On registration of a parallel registration of a seagoing merchant vessel (hereinafter referred to as "the ship '), each relevant sheet of the ship's registration sheet shall be marked with a marked sign" COMMERCIAL REGISTRATION'. The inscription shall be made in capital letters and shall be placed above the writing text in the upper right of the ship's registration sheet.
§ 8
Where the registration of the deletion of a seagoing vessel from the maritime register is carried out, the relevant register entry shall be closed. All the areas described are crossed with a red cross. The date and reason for the deletion shall be entered in the upper right of the first sheet of the seagoing vessel's registration liner. The undescribed positions on the other sheets of the seagoing vessel registration liner shall be crossed out.
§ 9
The documents referred to in Article 12 (2) shall be entered in a collection of documents kept separately from the registration of the seagoing vessel.
§ 10
(1) Any procedural document giving rise to the initiation of registration proceedings in the maritime register shall be entered in the register of submissions in the register cases, which shall indicate on the first page the number of numbered pages.
(2) The submission shall be entered in the register of entries in the register under the normal serial number in the order of delivery. It shall be common for seagoing vessels.
(3) The registration number shall be entered in the file.
(a) the normal serial number of the submission,
(b) the date of submission; the date indicated in the postmark, if the proceedings are opened on its own motion, shall always be recorded; the submission made by telegraphic or telefax shall be registered only if it is completed in writing within three days within the meaning of Article 11 (3) of the Act,
(c) the name of the applicant; for natural persons, the name, surname, permanent residence, business name (name under which it was established, legal form) and registered office,
(d) the indication of the subject-matter of the application;
(e) the date of completion; the date of registration and the date of the decision on registration shall be indicated,
(f) the number of the case file,
(g) the registration number of the seagoing vessel;
(h) the serial number of the registration in the maritime vessel register.
§ 11
Basic technical details of the seagoing vessel
(1) The basic technical data on a seagoing vessel registered under § 8 (1) (g) of the Act are data and units characterising the seagoing vessel.
(2) The data and units characterising the seagoing vessel are:
(a) gross tonnage, 1)
(b) registration tonnage, which means the total tonnage of the seagoing yacht;
(c) net tonnage, 1)
(d) load capacity,
(e) the largest length,
(f) length of registration;
(g) the largest width,
(h) height to main deck;
(i) displacement;
(j) summer dive, 2)
(k) maximum height;
(l) classification class,
(m) construction material,
(n) method of construction,
(o) location, year of construction and construction manufacturer,
(p) the manufacturer of the propulsion equipment;
(r) type of propulsion equipment;
(s) the type of engine;
(t) the power of the propulsion equipment;
(u) rinse area.

REQUEST FOR A MARITIME VESSEL TO THE MARITIME REGISTER
§ 12
Forms of application for registration of a seagoing vessel in the maritime register
(1) The application for registration of a seagoing vessel in the maritime register must contain the information referred to in Article 11 (2) of the Act, and
(a) details of the seagoing vessel referred to in § 8 (1) (a) to (d) of the Act;
(b) details of the party to proceedings for the registration of a vessel in a maritime register which is not the owner or operator of a seagoing vessel; the name, surname, place of permanent residence and birth number or, where applicable, date of birth for natural persons or trade name (name under which it was established), registered office, legal form and identification number for legal persons,
(c) an indication of the establishment of a lien and detention right on a seagoing vessel and other facts limiting the handling of a seagoing vessel and indicating the evidence of that fact.
(2) The application for registration of a seagoing vessel in the maritime register must be accompanied by the documents referred to in Article 11 (3) of the Act, and
(a) an extract from the Register of Penalties of a natural person who is the owner of a seagoing vessel authorised to operate a seagoing vessel in his own name and under his own responsibility, unless the owner is at the same time the operator of the seagoing vessel, or an extract from the Register of Penalties of all members of the statutory body of a legal person who is the owner of the seagoing vessel authorised to operate a seagoing vessel in his own name and under his own responsibility, unless the owner of the seagoing vessel is simultaneously its operator; an extract from the criminal record shall not be more than 6 months old;
(b) an affidavit stating that the seagoing vessel is not registered in the maritime register of another State when the seagoing vessel is newly built.
(3) The model of the application for registration of a seagoing vessel in the maritime register is set out in the Annex.
§ 13
(1) The Office will establish whether the documents submitted on the application referred to in Article 11 (3) (c), (d) and (g) of the Act and the application for registration of a seagoing vessel in the maritime register are indeed written declarations of will by the persons listed therein.
(2) The Office considers the expression of the will of persons to be established if:
(a) their own-hand signatures have been officially certified in accordance with specific legislation, 3)
(b) the instrument has been drawn up by notarial entry,
(c) the instrument has been drawn up by a lawyer who expressly confirms that the persons whose identity he has established have signed the instrument before him; or
(d) the person, having established his identity, has recognised the authenticity of his signature before the Office.
In the event that the Office does not find any sign of will in any of these ways, it may find it otherwise appropriately.
(3) The provisions of paragraph 2 shall apply mutatis mutandis to the determination of the authenticity of the signature of the proxy.
§ 14
(1) Documents submitted in a foreign language must include an officially certified translation into the Czech language. 4)
(2) The documents required for the registration procedure must be presented in the original or certified copies. 3)

PROVISIONAL AUTHORITY FOR VESSELS
§ 15
(1) The Authority shall decide on the granting of an interim authorisation for a voyage on the basis of a request from the owner of the seagoing vessel and on the basis of an assessment of the urgency of the case.
(2) The application for an interim authorisation for a voyage must contain the information referred to in Article 11 (1).
(3) The application for provisional authorisation for a voyage must be supported by:
(a) the documents referred to in Article 11 (2) in addition to those certifying the technical competence of a seagoing vessel for navigation under Article 11 (3) (e) of the Act;
(b) documents proving the technical competence of a ship to sail for the purpose of granting an interim authorisation for a voyage pursuant to Article 20 (3) of the Act, in the case of a ship owner's application, or documents demonstrating the technical competence of a seagoing yacht for the purpose of granting an interim authorisation for a voyage pursuant to Article 20 (4) of the Act, in the case of a seagoing yacht owner's application;
(c) evidence showing the urgency of the case.

HLAVA I

SPECIES OF LISTS OF MARITIME VESSELS
§ 16
Ship's paper documents
The paper documents of the ship are:
(a) paper documents of the ship issued by the Office referred to in § 25 (1) (a), (b) and (d) of the Act;
(b) documentary evidence of a ship approved by the Office referred to in § 25 (1) (h) to (p) of the Act;
(c) other paper documents of the ship referred to in § 25 (1) (c), (e) to (g), (r) and (s) of the Act.
§ 17
Charter documents for sea yachts
The paper documents of the sea yacht are:
(a) a paper document of a sea yacht issued by the Office referred to in Article 26 (1) (a) of the Act;
(b) other documentary documents of the seagoing yacht referred to in § 26 (1) (b), (c) and (d) of the Act.

COORDINATION OF THE LISTS
Forms of ship's paper documents
§ 18
Register sheet
The ship's register sheet shall contain the following elements:
(a) the name of the authority which issued the ship's register,
(b) the information referred to in § 8 (1) (a) and (c) to (f) of the Act;
(c) the particulars referred to in § 11 (2) (a), (c) to (e), (g), (h) and (o) to (r);
(d) the ship's register number;
(e) the name of the ship's port of registry;
(f) the place and date of issue of the ship's registration sheet;
(g) the stamp of the Office and the name, surname and signature of the person authorised to issue the ship's register.
§ 19
Certificate of safe manning by crew
The crew certificate of safe boarding shall include the following elements:
(a) the designation of the Office which issued the certificate of safe manning;
(b) the information referred to in § 8 (1) (a), (c) and (d) of the Act;
(c) the information referred to in § 11 (2) (a) to (s);
(d) the ship's register number;
(e) the name of the ship's port of registry;
(f) data on the number of crew members in each function;
(g) the period of validity of the certificate of safe manning;
(h) the place and date of issue of the certificate of safe manning;
(i) the stamp of the Office and the name, surname and signature of the person authorised to issue the certificate of safe boarding by the crew.
§ 20
International standard sheet
The international standard sheet shall contain the following elements:
(a) the designation of the Office which issued the international standard sheet;
(b) the information referred to in § 8 (1) (a) and (d) of the Act;
(c) the information referred to in § 11 (2) (a), (c), (e), (g) and (h);
(d) the name of the ship's register port;
(e) the place and date of issue of the international standard sheet;
(f) the stamp of the Office and the name, surname and signature of the person authorised to issue the international instrument of measurement.
§ 21
Ship's log
The ship's logbook shall contain the following elements:
(a) the designation of the Office which approved the logbook;
(b) the information referred to in § 8 (1) (a), (d), (e) and (f) of the Act;
(c) the information referred to in Article 11 (2) (a) and (c);
(d) the name of the ship's register port;
(e) an indication of the number of numbered sheets of the logbook,
(f) the place and date of approval of the logbook;
(g) the stamp of the Office and the name, surname and signature of the person authorised to approve the logbook.
§ 22
Engine log
The machine log shall contain the following elements:
(a) the designation of the Office which approved the machinery logbook;
(b) the information referred to in § 8 (1) (a), (d), (e) and (f) of the Act;
(c) the information referred to in Article 11 (2) (a), (c), (e), (g), (h) and (p);
(d) the name of the ship's register port;
(e) details of the number and content of each cargo hold of the ship;
(f) details of the number and content of the ship's tanks;
(g) an indication of the number of numbered sheets of the machinery logbook,
(h) the place and date of approval of the machinery logbook;
(i) the stamp of the Office and the name, surname and signature of the person authorised to approve the logbook.
§ 23
Maneuver Log
The Maneuver Log shall contain the following elements:
(a) the sign of the Office which approved the manoeuvre log;
(b) the information referred to in § 8 (1) (a), (d), (e) and (f) of the Act;
(c) the information referred to in Article 11 (2) (a) and (c);
(d) the name of the ship's register port;
(e) an indication of the number of numbered sheets of the manoeuvre log,
(f) the place and date of approval of the manoeuvre log;
