DECLARATION
of 23 August 2017
on the progress of the village in ensuring decent burial
The Ministry of Local Development provides pursuant to Section 31 of Act No. 256 / 2001 Coll., on Funeral Matters and on the amendment of certain laws, as amended by Act No. 193 / 2017 Coll., ("the Act ') for the implementation of Section 5 (4) of the Act:
Subject matter
This decree regulates the practice of the municipality in ensuring that the deceased's body is buried in a decent manner in accordance with local practice ("decent burial ').
Progress of the municipality before ensuring decent burial
(1) Upon receipt of the information provided for in Article 5 (6) of the Act, the municipality shall request from the health service provider or funeral service where the deceased's body is stored, part B2 of the Charter of the examination of the deceased (hereinafter referred to as "Part B2 of the Charter") and verify its local jurisdiction to ensure decent burial.
(2) If the municipality finds that it is not locally competent to ensure burial, it shall immediately transmit the information, together with Part B2 of the List, to the locally competent municipality and inform the person with whom the deceased's body is stored.
(3) The municipality shall verify whether the deadline laid down in Article 5 (1) of the Act has elapsed since the notification of death to a person close to the deceased; where there is doubt as to whether the notification has taken place, it shall notify the person close to the deceased, if known.
Ensuring decent burial
(1) The municipality shall ensure that the deceased's body is properly buried without undue delay. It follows the decision of the deceased, if known.
(2) When ensuring decent burial, the village progresses in such a way as not to incur unnecessary costs and to minimise burden on the person with whom the deceased's body is stored.
(3) The municipality shall inform of the proper burial of the matrix office which entered the death of the natural person in the book of death.
(1) In the event of a decent burial in a grave or tomb at a public burial site, the municipality shall proceed in such a way that the related costs are made up of at least the following items:
(a) grave work;
(b) the lease of the burial site for the period of the fencing period; and
(c) arrangements for the grave site, including the grave plate.
(2) In the event of a decent burial in the crematorium, the municipality shall proceed in such a way that the related costs, depending on the way in which human remains are stored on the burial site, consist of at least the following items:
(a) cremation;
(b) the hire of a grave site for 10 years;
(c) arrangements for the grave site, including the grave plate;
(d) the urn,
(e) the placing of ash in a firmly closed urn marked,
(f) transport of an urn with human remains to a public burial site; and
(g) the storage of an urn with human remains in the storage of individual Urenes in a public burial site, the storage of an urn with human remains in a grave or a tomb in a public burial site, the dispersion of cremated human remains in a public burial site, or in a incinerated human remains in a public burial site.
(3) When ensuring decent burial as referred to in paragraph 1 or 2, the municipality shall proceed in such a way that, depending on the manner of burial, the related costs are further composed of at least the following items:
(a) remuneration for funeral service operators;
(b) the use of refrigerating equipment;
(c) the use of freezing equipment;
(d) the final coffin,
(e) insert into the final coffin,
(f) bedding for the final coffin,
(g) transport bag,
(h) treatment of the deceased's body
1. undress,
2. washing,
3rd shaving,
4. cutting,
5. cosmetic treatments,
(i) shroud,
(j) foot covers,
(k) dress or shroud,
(l) placing the body of the deceased in the coffin,
(m) handling of the coffin, other similar container or carrier; and
(n) transport of the deceased's body, except transport to and from the autopsy, to the place of burial.
Efficacy
This Regulation shall enter into force on 1 September 2017.
