amending Act No. 102 / 2001 Coll., on general product safety and amending certain laws (Act on general product safety), as amended by Act No. 146 / 2002 Coll., Act No. 22 / 1997 Coll., on technical requirements for products and amending and supplementing certain laws, as amended, and Act No. 634 / 1992 Coll., on consumer protection, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Act on Technical Requirements for Products
In Article 4a of Act No. 22 / 1997 Coll., on technical requirements for products and amending and supplementing certain laws, as amended by Act No. 205 / 2002 Coll., the following paragraph 4 is added:
"(4) The Office shall publish in the Bulletin of the Office a reference to a European standard published under the law of the European Communities (1b) by the Commission of the European Community in the Official Journal of the European Communities which satisfies the conditions of this Directive.
(1b) Article 4 of Directive 2001 / 95 / EC of the European Parliament and of the Council on general product safety. ';
Amendment to the Consumer Protection Act
Act No. 634 / 1992 Coll., on Consumer Protection, as amended by Act No. 217 / 1993 Coll., Act No. 40 / 1995 Coll., Act No. 104 / 1995 Coll., Act No. 110 / 1997 Coll., Act No. 356 / 1999 Coll., Act No. 64 / 2000 Coll., Act No. 145 / 2000 Coll., Act No. 258 / 2000 Coll., Act No. 102 / 2001 Coll., Act No. 452 / 2001 Coll., Act No. 477 / 2001 Coll., Act No. 151 / 2002 Coll., Act No. 320 / 2002 Coll., is amended as follows:
1. in Article 2 (1) (d):
"(d) an importer who places on the market a product from a Member State other than the European Union,"
2. in Article 2 (1) (m) (2):
"2. the sole and lining which are the assembly of the sole and lining of the upper, forming the inner part of the footwear,."
3. In Article 3, at the end of point (c), the dot is replaced by a semicolon and the words, including footnote (6a), are added: "in the final accounting of the products and services sold in cash, the total amount shall be rounded to the nearest valid nominal value of the legal money in circulation. 6a)

4. Paragraph 10 (9) is deleted.
5. Article 10a, including footnote 9b, reads:
The manufacturer or his authorised representative (9b) shall be responsible for marking the materials used in the main parts of the footwear in accordance with the implementing legislation and for the accuracy of the information contained in the markings. This information shall be provided to the supplier and to the seller. Where neither the manufacturer nor his authorised representative is established in a Member State of the European Union, that obligation shall pass on to the person responsible for the first placing of the footwear on the market of the European Community.
9b) § 5 (1) (b) of Act No. 102 / 2001 Coll., as amended by Act No. 277 / 2003. '
EFFECTIVE
This Act shall take effect on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union, with the exception of point 3 of Part Three, which shall take effect on the date of its publication.
