GOVERNMENT REGULATION
of 19 July 2021
amending Government Regulation No 257 / 2021 Coll., on the use of the funds of the State Investment Support Fund in the form of a grant and a loan for the renewal of dwellings affected by a natural disaster on 24 June 2021, as amended by Government Regulation No 262 / 2021 Coll.
The Government orders the implementation of Act No. 211 / 2000 Coll., on the State Fund for Investment Support, as amended by Act No. 391 / 2002 Coll., Act No. 482 / 2004 Coll., Act No. 61 / 2005 Coll., Act No. 179 / 2005 Coll., Act No. 71 / 2010 Coll., Act No. 239 / 2012 Coll., Act No. 276 / 2012 Coll., Act No. 111 / 2018 Coll., Act No. 307 / 2018 Coll. and Act No. 113 / 2020 Coll.:
Government Decree No 257 / 2021 Coll., on the use of the funds of the State Investment Support Fund in the form of a grant and a loan for the renewal of dwellings affected by a natural disaster on 24 June 2021, as amended by Government Decree No 262 / 2021 Coll., is amended as follows:
1. In Article 2, the words "; a built-up dwelling, which is a built-in housing building which has been affected by a natural disaster, shall also be added at the end of the text (b)."
2. in Article 2 (e), the following point 4 is added:
"4. in the case of a built-up dwelling, repair or construction into a state prior to damage by a natural disaster,"
3. In Article 3 (2), the word "or 'shall be deleted at the end of point (b).
4. In Paragraph 3 (2), at the end of point (c), the dot is replaced by "or 'and the following point (d) is added:
"(d) has been a building builder for housing which has not been completed on the day of the natural disaster."
5. In Article 3 (6) (c), the words "in such a way that the approval takes place 'are deleted.
6. In Article 3, the following paragraph 8 is inserted after paragraph 7:
"(8) Paragraph 3 (5) and (6) shall apply mutatis mutandis to the grant of the recovery aid referred to in Article 2 (e) (4). '
Paragraph 8 shall become paragraph 9.
7. In Paragraph 4 (1), the words "; in the case of a built-up dwelling, identification according to a building permit or other procedure under a building law shall be added at the end of the text in point (e), unless they can be identified by a property register '.
8. in Paragraph 4, the following paragraph 5 is inserted after paragraph 4:
"(5) The applicant shall accompany the aid application for the renewal of the built-in housing referred to in Article 2 (e) (4):
(a) an authentic building permit, a valid and effective public contract for the execution of the construction, a notified certificate of an authorised inspector to the competent construction office under which the construction company is authorised to carry out the construction or consent to the implementation of the notified construction;
(b) project documentation of the dwelling;
(c) a building log recording the course of works on the dwelling;
(d) photo documentation of the dwelling before the date of the natural disaster, indicating the date of acquisition, if available;
(e) photodocumentation of homes damaged by a natural disaster;
(f) proof of the estimated cost of compensation for damage to the dwelling; and
(g) in the case of construction, proof that the dwelling has been destroyed or irreparably damaged as a result of a natural disaster. "
Paragraphs 5 to 7 shall be renumbered paragraphs 6 to 8.
9. In Article 4 (6), "4 'is replaced by" 5'.
10. in Paragraph 4 (6) (b), the words "and for the 3 years preceding the application is and has not been" shall be replaced by the words "not" and the words "not" shall be deleted;
11. in Article 5, at the end of paragraph 3, the dot is replaced by a comma and the following point (c) is added:
"(c) the built-up construction costs of putting into place before the disaster."
12. in Article 5 (4), the words "or, in the case of a built-up dwelling, shall not exceed the area according to the design documentation of the built-up dwelling" shall be added at the end of the text of point (a).
13. in Article 5 (5), "8" is replaced by "9."
14. in § 7 (5) (b) (3):
'3. a final building permit, a valid and effective public contract for the execution of the construction, a notified certificate of an authorised inspector to the competent building office under which the builder is authorised to carry out the construction or consent to the implementation of the notified construction, '.
15. in Article 7 (6) (a), "or 2" is replaced by "2 or 4."
16. in Paragraph 9 (2):
"(2) For the period from the acquisition of a new dwelling, the termination of the construction of a new dwelling, the termination of the repair of the dwelling, or the completion of the building for housing in the case of a built-up dwelling until the repayment of the loan or for a period of 10 years, the dwelling or new dwelling for which the aid has been granted must serve as a dwelling '.
Transitional provision
Aid applications submitted pursuant to Government Regulation No 257 / 2021 Coll., as effective until the date of entry into force of this Regulation, shall be assessed in accordance with Government Regulation No 257 / 2021 Coll., as effective from the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on the day following that of its publication.
