DECLARATION
of 18 August 2016
on the transfer of data to the register of teachers, professors and extraordinary professors of universities
The Ministry of Education, Youth and Sports provides, pursuant to § 87 (1) (g) (2) and § 87b (4) of Act No. 111 / 1998 Coll., on higher education institutions and amending and supplementing other laws (Act on Higher Education), as amended by Act No. 137 / 2016 Coll.:
Subject matter
This decree regulates
(a) the format and structure of the data report by public, private and state higher education institutions and foreign higher education providers in the Czech Republic (hereinafter referred to as "provider"), as referred to in Section 93a of the Higher Education Act, providing for changes in the data relating to their employees to the register of teachers, professors and special professors of higher education institutions (hereinafter referred to as "register");
(b) the technical conditions and deadlines for the transmission of the data referred to in (a).
Data message format and structure
(1) The data in the register are transmitted to the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry") by electronic forms. The permissible data message format is XML.
(2) The structure of the data report to be transmitted by universities to the register consists of the following data which are known at the time of transmission:
(a) the name of the higher education institution and its identifier and, where appropriate, the name of the part of the higher education institution;
(b) if it is a professor or professor,
1. first name and surname and, where appropriate, additional names and maiden name,
2nd year of birth,
3. the municipality where he resides;
4. in the case of foreigners of sex,
5. for foreigners, the address of the registered residence in the Czech Republic and citizenship,
(c) if it is an education or educational, scientific or artistic qualification of the professor or professor;
1. the date of acquisition of higher education;
2. academic degrees and degrees,
3. date of appointment by the associate professor,
4. date of appointment as professor,
including an indication of the programmes and disciplines in which academic degrees and scientific degrees have been obtained and in which the habilitation and appointment procedures have been completed by the professor and an indication of the university at which the habilitation or appointment procedures have been carried out by the professor and the date of appointment by the professor,
(d) if it is an extraordinary professor,
1. the particulars referred to in points (a) and (b);
2. the information referred to in points (c) (1) and (2), where that person has received the title "Docent," also the information referred to in point (c) (3);
3. information on a position comparable to that of a professor or professor abroad,
4. data on the duration of experience in the relevant field of education in which the post of the special professor was established;
(e) if it is a professor, professor or extraordinary professor, or
1. details of the work title,
2. data on the creation of a basic employment relationship between a staff member and a university or, in the case of a public higher education institution, the Czech Republic, including an indication of the extent of work, expressed in terms of the number of hours of work per week or, where applicable, per calendar year or other relevant period, and data on the period of time for which the primary employment relationship with a university or the Czech Republic is agreed, and similar information on the employment relationship, if the place of an academic worker operating in a state university is occupied by a soldier in active service or a member of the Police of the Czech Republic in the service relationship,
3. information on the change in the basic employment relationship of a staff member to a university or, in the case of a state university, to the Czech Republic, including an indication of the extent of the work, expressed in terms of the number of hours of work per week or, where applicable, per calendar year or other relevant period, and information on the period of time for which the basic employment relationship with a university or the Czech Republic is agreed and similar information on the service relationship, if the post of an academic worker operating in a state university is occupied by a soldier in active service or a member of the Police of the Czech Republic in the service relationship,
4. data on the termination of the basic employment relationship of a staff member to a university or, in the case of a state university, to the Czech Republic, and similar data on the termination of service, if the post of an academic staff member working at a state university was filled by a soldier in active service or a member of the Police of the Czech Republic in a service relationship,
(f) if there is a guarantee for the study programme,
1. details of the programme guarantee referred to in points (a) to (c);
2. code and name of the guaranteed study programme;
3. type of guaranteed study programme,
4. the name of the university and its identifier and, where appropriate, the name of the relevant faculty to which the study programme is or is to be carried out on the basis of its accreditation or approval within the framework of the authorisation resulting from institutional accreditation.
(3) In addition to the data transmitted, universities and providers shall attach the name and surname, telephone links and e-mail address of the staff responsible for transmitting or consulting the register and the date on which their mandates are established. Universities and providers shall notify the Ministry without delay of changes to the data.
(4) The provisions of paragraph 2 shall apply mutatis mutandis to the structure of the data report by the provider referred to in Section 93a of the Higher Education Act to the register of docents and professors operating in the Czech Republic with the provider as pedagogic and scientific staff, with similar data on the relevant provider and the relationship of the staff member to the university instead of the data on the higher education institution and the relationship with the university.
Technical conditions and deadlines for data transmission
(1) Descriptions of individual data structures and code lists for the transmission of individual data are published by the Ministry on its website.
(2) Data are to be sent to the registry on an ongoing basis and no later than the 10th day following the end of the calendar month in which the event occurred, in accordance with descriptions of the structures of individual data and the code lists for the transmission of individual data published by the Ministry.
Efficacy
This Decision shall enter into force on 1 January 2017.
