THE LAW
of 18 July 2012
amending Act No. 211 / 2000 Coll., on the State Housing Development Fund and amending Act No. 171 / 1991 Coll., on the jurisdiction of the authorities of the Czech Republic in respect of transfers of State property to other persons and on the National Property Fund of the Czech Republic, as amended, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 211 / 2000 Coll., on the State Housing Development Fund and amending Act No. 171 / 1991 Coll., on the Jurisdiction of the Bodies of the Czech Republic on Transfers of State Property to Other Persons and on the National Property Fund of the Czech Republic, as amended, as amended, Act No. 391 / 2002 Coll., Act No. 482 / 2004 Coll., Act No. 61 / 2005 Coll., Act No. 179 / 2005 Coll., Act No. 71 / 2010 Coll. and Act No. 239 / 2012 Coll., is amended as follows:
1. In the first sentence of Article 1 (1), the words "based in Olomouc 'are replaced by the words" based in Prague' and in the second sentence, the words "and its public mission 'are inserted after the words" the purpose of the Fund' and the words "and the sustainable development of municipalities, cities and regions in line with the public interest 'at the end of paragraph 1 are added.
2. Paragraph 1 (3), including footnote 7, reads:
"(3) The Fund shall manage the State-owned property (7), its own property and the property of other persons.
7) Act No. 219 / 2000 Coll., on the property of the Czech Republic and its representation in legal relations, as amended. "
3. In Section 1, paragraphs 4 to 7 are added, including footnote 8:
"(4) The Fund shall acquire its own assets:
(a) acceptance of the designated property from the State or other persons;
(b) from their own activities.
(5) The Fund may be the founder or the founder of legal persons and may acquire ownership.
(6) The Fund's resources to promote sustainable development of municipalities, cities and regions may be transferred by the Fund to urban development funds in accordance with directly applicable European Union8).
(7) The Fund may acquire securities, in particular under the Collective Investment Act.
8) Council Regulation (EC) No 1083 / 2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260 / 1999. Commission Regulation (EC) No 1828 / 2006 of 8 December 2006 laying down detailed rules for the implementation of Council Regulation (EC) No 1083 / 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and Regulation (EC) No 1080 / 2006 of the European Parliament and of the Council on the European Regional Development Fund. ';
4. In Article 2 (1) (i), the word "State 'is deleted and the words" and in urban development funds' are added at the end of the text.
5. In Paragraph 3 (1) of the Introductory Part of the provision, the words "concentrated in the Fund 'are replaced by the words" the State with which the Fund manages it'.
6. In Article 3, at the end of paragraph 1, the dot is replaced by a comma and the following point (h) is added:
"(h) to finance projects to implement public housing policy objectives and the development of municipalities, cities and regions.";
7. In Paragraph 3 (2) of the Introductory Part of the provision, the words "concentrated in the Fund 'are replaced by the words" the State with which the Fund manages it'.
8. In Article 3 (2) (f), the words "and activities' shall be inserted after the words" associated with management '.
9. In Article 3, the following paragraph 3 is inserted after paragraph 2:
"(3) The Fund's own resources and the resources of other persons managed by the Fund may be used in accordance with their designation and purpose."
Paragraphs 3 to 7 shall be renumbered paragraphs 4 to 8.
10. in Article 3 (4), "and (d)" shall be replaced by "(d) and (h)";
Efficacy
This Act shall take effect on the 15th day following its publication.
