DECLARATION
Ministry of Defence
of 15 November 1999
on the approval of the technical competence of military aircraft, the conduct of periodic technical inspections of military aircraft and the testing of technical equipment of military aircraft
In agreement with the Ministry of Transport and Communications, the Ministry of Defence provides in accordance with § 35 paragraph 5 of Act No. 219 / 1999 Coll., on the armed forces of the Czech Republic:
MILITARY AIRCRAFT AND THEIR CATEGORIES
Military aircraft
Military aircraft are divided into:
(a) military aeroplanes;
(b) military helicopters;
(c) military unmanned;
(d) military ultra-light aircraft;
(e) lighter air military aircraft.
Military aeroplanes
(1) Military aeroplanes shall, as determined, be divided into:
(a) multipurpose tactical;
(b) special.
(2) Multi-purpose tactical aeroplanes are intended for the performance of airspace defence combat tasks, direct support for the activities of other types of troops and special tasks.
(3) Special military aeroplanes shall, as determined, be divided into:
(a) transport;
(b) training;
(c) a special destination.
(4) Transport aeroplanes are designed to carry passengers and military equipment.
(5) Training aeroplanes are designed to train and improve aircraft crews.
(6) Special designation aeroplanes perform special tasks for:
(a) photographic imaging;
(b) a radiotech survey;
(c) radiation and chemical surveys.
Military helicopters
(1) Military helicopters are divided into:
(a) striking;
(b) combat support;
(c) special and transport.
(2) Helicopters are designed to destroy small-scale, resistant and mobile targets, to support the activities of other types of troops, to perform transport tasks and to conduct research. They are equipped with weapons systems to perform their tasks.
(3) Helicopters for combat support are intended for the transport and disembarkation of aeromobile units and materials, for the pursuit of the task of exploration, for the retardation and guidance of other types of aircraft, for the performance of rescue tasks.
(4) Special and transport helicopters are intended for the transport of persons and material, training and improvement of helicopter crews, surveying and carrying out special tasks.
Military unmanned aircraft
Military unmanned aerial vehicles are flying aids designed to carry out combat tasks that are controlled remotely or autonomously.
Military ultra-light aircraft
Military ultra-light aircraft are flying vehicles designed to perform special combat tasks.
Military lighter-air aircraft
Military airplanes are flying vehicles designed to perform special combat tasks.
APPROVAL OF THE TECHNICAL ELIGIBILITY OF MILITARY AIRCRAFT
Method of type-approval of aircraft or aeronautical technical equipment
(1) The type of military aircraft or military aviation technology (hereinafter referred to as "military aviation technology") introduced into use by the armed forces of the Czech Republic (hereinafter referred to as "armed forces") is approved by the Ministry of Defence (hereinafter referred to as "Ministry") on the basis of the results of the assessment and verification of compliance of the characteristics of the aviation technology with the requirements laid down in the technical standards on aviation safety.
(2) The Ministry may entrust the assessment and verification of the conformity of the characteristics of the aviation technology to a legal person fulfilling the conditions set out in Section 10.
(3) The categories of products of military aviation technology subject to approval are set out in Annex 1.
Documents submitted at the time of approval of military aviation equipment
For the purposes of the approval of military aviation equipment, the manufacturer or importer shall provide the following documents:
(a) documentation of compliance with the requirements laid down by technical regulations or standards on the safety of military aviation technology and on environmental protection;
(b) proof of compliance with the technical regulations or standards according to which the construction of military aviation equipment or parts thereof has been carried out;
(c) technical details of military aviation technology or parts thereof required for the issue of an airworthiness certificate;
(d) a certificate of approval of military aviation equipment or parts thereof issued by an approval authority pursuant to a special legislation (1) or by another State for aviation technology or for aviation technology put into use in the armed forces of the civil sector, including documentation for the approval of military aviation technology or part thereof with the provision of a change service;
(e) full operational documentation of military aviation equipment or parts thereof introduced into use in the armed forces.
Deciding on the technical competence of military aviation technology
(1) The Ministry shall decide on the eligibility of military aviation equipment upon request
(a) the manufacturer or importer, in the case of newly manufactured military aviation equipment;
(b) the operator, in the case of military aviation equipment already operated.
(2) The Ministry shall issue a certificate of airworthiness approval for military aviation equipment. The model certificate is set out in Annex 2.
(3) The approval of airworthiness shall be subject to compliance of military aviation technology with the type of aircraft or technology already approved and the airworthiness verification of the military aircraft.
(4) The assessment and verification of the conformity of military aviation technology and airworthiness of military aircraft are carried out by the Ministry.
(5) The airworthiness verification shall be carried out by the manufacturer or importer at the Ministry for his cargo.
A legal person meeting the following requirements may be entrusted with the assessment and verification of the conformity of the characteristics of military aviation technology and airworthiness of military aircraft:
(a) be technically and constructively equipped to assess and verify the conformity of characteristics or to assess and verify the airworthiness of military aviation equipment or parts thereof or to check the airworthiness of military aircraft or parts thereof;
(b) has the technical equipment necessary to assess and verify the conformity of the characteristics of military aviation equipment or parts thereof and to check the airworthiness of a military aircraft or parts thereof;
(c) ensure that the work carried out in the assessment and verification of the conformity of characteristics or in the assessment and verification of the airworthiness of military aviation equipment or in the airworthiness review of military aircraft is carried out by natural persons who are competent and who are required to comply with the protection of classified information.
Test military aircraft
A test military aircraft for which a certificate has not yet been issued, or a military aircraft which does not meet the airworthiness requirements as a result of a change in the purpose of its use, or a military aircraft which has ceased airworthiness by rebuilding or rebuilding may be used for testing under the conditions laid down by the Ministry.
Rebuilding and installation of approved military aviation technology
(1) The reconstruction of approved military aviation equipment shall be carried out at the request of the armed forces. The Ministry will ensure the processing of technical requirements for the study of the conversion of military aviation technology and the processing of the study will entrust the legal person with the appropriate authority. The study submitted shall be subject to opposition proceedings upon completion.
(2) After the approval of the study by the Ministry, the project documentation is processed, on the basis of which the prototype installation is carried out on military aviation technology. After verification of the airworthiness of military aviation equipment, serial installation is carried out.
IMPLEMENTATION OF TECHNICAL EXAMINATIONS OF MILITARY AIRCRAFT AND TESTS OF TECHNICAL INSTALLATIONS OF MILITARY AIRCRAFT
Implementation of technical inspections of military aircraft
(1) Military aircraft shall be subject to the technical inspections and inspections necessary to restore airworthiness within the time limits and scope set by the Ministry.
(2) If the Ministry finds, during the airworthiness review, that a military aircraft does not meet the airworthiness requirements, it shall cease to operate until it again meets the airworthiness requirements.
(3) In the event of the detection of permanent airworthiness of a military aircraft, the Ministry shall withdraw the certificate.
Testing of military aircraft technical equipment
Tests on technical equipment of military aircraft and technology shall be carried out in accordance with a specific regulatory regulation.2)
PROVISIONS COMMON AND FINAL
(1) Mixtures which are subject to military aircraft fire protection systems are subject to specific legislation (3).
(2) All meters used in military aviation technology which affect flight safety, health protection, lives of persons and the environment are subject to specific legislation. 4)
Efficacy
This Decree shall take effect on 1 December 1999.

Products which may be used in military aviation technology and are subject to approval or recognition of competence shall be:
