amending Decree No. 79 / 2022 Coll., on Technical and Economic Parameters for the Determination of Reference Fees and Green Bonus and implementing certain other provisions of the Act on Supported Energy Sources (Technical and Economic Parameters)
According to Article 53 (2) (a), (b) and (l) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll. and Act No. 382 / 2021 Coll.:
Decree No 79 / 2022 Coll., on technical and economic parameters for the determination of reference ransom prices and green bonuses and for the implementation of certain other provisions of the Act on Supported Energy Sources (Order on Technical and Economic Parameters) is amended as follows:
1. In Annex 1, Table 1, the words "less than 1 MWe 'in rows 21 to 24 are replaced by the words" without restriction'.
2. In Annex 1, Table 1, in row 19, the words "conversion, cleaning 'are deleted.
3. In Annex 1, Table 1, the following row 19a is inserted after row 19:

Explanatory notes:
1 A new production plant means a production plant put into service from 1 January 2024 (also applicable to the conversion and purification of biomethane). For the purposes of this Regulation, the following definitions apply:
2 X ′ is the price of natural gas in calorific value, which is set for 20YY as the arithmetic average of the final prices of EEX-THE Cal-YY European Energy Exchange (EEX) for the period January to June in the previous year (Y-1); prices are converted from EUR / MWh to CZK / MWh according to exchange rates announced by the Czech National Bank for the relevant dates.
3 The remuneration shall be the price of natural gas in calorific value, including regulated payments, determined in accordance with the calculation set out in Annex 3 to this Regulation.
4 Biogas Station.
5 High efficiency combined electricity and heat production.
6 New heat plant burning unsorted municipal waste (destined for biodegradable).
7 In the case of conversion, the biomethane production plants are the ones created by the conversion of electricity production (conversion of electricity production into biomethane production plants). In the case of cleaning, the biomethane production plants shall include only biogas treatment plants for biomethane. ';
5. In Annex 1, Table 2, in row 1, the words "Photovoltaic Power Plant 'are deleted.
6. In Annex 1, Table 2, in row 2, the words "Mining gas' are deleted.
7. In Annex 2, the table, including the title, reads:

8. At the end of the title of Annex 3, the words "using geothermal energy 'are added.
9. In Annex 3, "20 Kč / GJ 'is replaced by" 25 Kč / GJ'.
Transitional provision
For electricity, heat and biomethane plants put into service or upgraded from 1 January 2022 to 31 December 2023, with the exception of generation of electricity with installed power from 1 MWe using mining gas for the production of electricity, the technical and economic parameters referred to in Decree No 79 / 2022 Coll., as effective before the date of entry into force of that decree, shall be used.
Efficacy
This Regulation shall enter into force on 1 January 2024, with the exception of Article I (1) to (3) and (6), which shall take effect on the day following that of its publication.
