DECLARATION

laying down the procedure for the processing of final consumer price proposals for cigarettes and amending those prices
The Ministry of Finance provides pursuant to § 139 (1) for the implementation of § 131 (j) of Act No. 353 / 2003 Coll., on Consumer Taxes, as amended by Act No. 217 / 2005 Coll., (hereinafter "the Act '):
Procedure for processing price proposals for final consumers
(1) The manufacturer, importer or person responsible for the submission of a proposal for the fixing of a price for the final consumer pursuant to Article 103 (2) of the Act (hereinafter referred to as "the appellant") shall submit to the customs office of Kolín (hereinafter referred to as "the mandated customs office") a draft price for the final consumer (hereinafter referred to as "the price") by the tenth day of the calendar month preceding the month from which the appellant requests that the proposed price take effect. In the case of a price requirement with a later effective date, the appellant shall indicate that date in the proposal.
(2) The applicant shall process the draft price of each cigarette in accordance with the model set out in the Annex. A description of cigarettes containing:
(a) the exact trade name;
(b) the name appearing on the unit pack intended for direct consumption (hereinafter referred to as "the package") and, where appropriate, additional particulars for a completely unambiguous identification;
(c) the length of the tobacco rope and the total length of the cigarette;
(d) the number of packages; and
(e) the country of origin code according to the directly applicable regulation of European Communities law (1).
(3) The applicant will send or forward a price proposal to the customs office in writing and at the same time on the technical medium (disk) or by e-mail.
(4) Together with the proposal for the price of cigarettes whose price has not yet been determined, the appellant shall submit to the customs office by delegation a sample of such cigarettes or their photodocumentation and the consent of the proprietor of the trade mark to use the trade mark and the sale of cigarettes with that mark, if any.
(5) A similar procedure shall apply to the processing of a proposal to change the price as for cigarettes whose price has not yet been determined. The proposal to change the price shall also specify the price in force and the reason for the change.
Repeal
Decree No. 430 / 2003 Coll., which regulates the method of pricing the final consumer of tobacco products, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
