DECLARATION
of 28 April 2004
on quality and health requirements for packaged waters and their presentation
According to Article 19 (1) (a), (b) and (f) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Acts No. 306 / 2000 Coll. and No. 146 / 2002 Coll., hereinafter referred to as "the Act":
Preliminary provisions
This decree lays down, in accordance with European Community law, microbiological, chemical and physical requirements for packaged natural mineral waters, packaged spring water, packaged infant water and bottled drinking water ("bottled waters') and their presentation, control, evaluation and labelling. The radiological requirements for these waters are laid down in a separate regulatory act. 2)
(1) For the purposes of this decree, the following types of packaged waters shall be distinguished:
(a) packaged natural mineral water - a product of natural mineral water obtained from a source of natural mineral water which has been certified or certified under a specific legislation, 3) or from sources recognised by the responsible authority of a Member State of the European Union or a country of the European Free Trade Association which is declared in the Official Journal of the European Union or a product of natural mineral water obtained from a natural medical source which has been certified; 3) where its characteristics allow use as food;
(b) Packed spring water - a product of quality water from a protected underground source which can only be treated in the manner specified in Section 4. This water is suitable for continuous direct consumption by children and adults,
(c) bottled infant water - a product of quality water from a protected underground source which must not be modified in any way, except for UV radiation as referred to in Article 4 (4). This water is suitable for the preparation of infant food and for permanent direct consumption by all groups of the population,
(d) bottled drinking water - a product meeting the requirements of drinking water under a special legislature.4)
(2) For the purposes of this decree:
(a) the limit value (MH) - the value of the quality indicator of the bottled water, the failure of which loses water complying with the requirements of the indicator whose value has not been respected;
(b) the maximum limit value (hereinafter referred to as "NMH") - the value of the health indicator of the bottled water resulting from excess of which the food is excluded from circulation,
(c) recommended value (hereinafter referred to as "DH") - non-binding value of the quality indicator of packaged water, which means the minimum desired concentration of the substance or its optimal range,
(d) decanting - the procedure for separating the solid component from the liquid component in a mixture consisting of settling solids, e.g. sludge, and draining a clear liquid,
(e) measurement uncertainty - the indication given on the laboratory protocols for the result of the measurements, characterising the dispersion of values that can reasonably be assigned to the measured value.
General requirements for packaged water
(1) Packed waters must be clear and colourless, except for packaged natural mineral water, which may be at the most slightly yellowish or with slight opacity or sediment. Packed waters shall not contain disease agents or organisms indicating their possible presence and shall not show organoleptic defects.
(2) The microbiological, physical and chemical requirements for the quality and health of packaged waters are laid down for:
(a) packaged natural mineral water in Annex 1;
(b) packed spring water in Annex 2,
(c) packed infant water in Annex 2,
(d) bottled drinking water in special legislation.4)
(3) Packed waters, except packaged drinking water, must not contain foreign organic substances in detectable quantities. Failure to comply is considered to exceed the limit with NMH. The requirements for analytical methods demonstrating the absence of foreign organic substances are set out in Annex 3.
(4) Microbiological indicators of bottled waters, with the exception of bottled drinking water listed in Annex 1 and Section 2 A shall be determined using the methods set out in Annex 5, Section A. Any analytical methods may be used to determine the physical and chemical characteristics of the packaged waters, with the exception of the bottled drinking water listed in Annex 1 and Section B 2, provided that they meet the requirements for the methods set out in Annex 5, Section B. When using a method not included in the relevant technical standards, it shall be demonstrated that its use is equivalent to the Czech Technical Standard set out in Annex No 5 in terms of its capture, accuracy and reproducibility.
(5) Only a protected source of groundwater, whose yield, composition, temperature and other essential characteristics must be used to produce packaged spring water and pre-packaged infant water, may be used. 5)
(6) Waters from sources suitable for the production of bottled waters, with the exception of bottled drinking water, can only be transported for packing or other treatment prior to packing by pipeline which protects them from damage to their health.
Treatment methods for packaged waters
(1) Packed natural mineral water can only be treated
(a) removal of unstable substances such as iron and sulphur compounds, filtration or decanting, with any prior oxygenation,
(b) by removing arsenic, manganese, iron or sulphur compounds by means of ozone-enriched air, filtration or decanting;
(c) by removing other undesirable ingredients such as beryllium, nickel compounds;
(d) by complete or partial removal of free carbon dioxide exclusively by physical methods.
(2) The adaptation referred to in paragraph 1 or the addition of carbon dioxide shall not alter the composition of the essential constituents of natural mineral water obtained from a source of natural mineral water or from a natural medical source which confers on it its properties and shall not cause harmful substances. Water cannot be modified by the addition of bacteriostatic substances or by other means that would change the number of colony forming units. Furthermore, other substances other than carbon dioxide may not be added to the water.
(3) Packed spring water can only be adjusted in the ways referred to in paragraphs 1 and 2.
(4) Air-enriched ozone treatment referred to in paragraph 1 (b). (b) the manufacturer of packaged natural mineral water or packaged spring water may continue to use it only under the following conditions:
(a) the need for adjustment results from the composition of the water as regards the iron, manganese, sulphur and arsenic content;
(b) the adaptation does not change the physical-chemical composition of the essential constituents of natural mineral waters;
(c) arrangements must be made to ensure that such arrangements are effective and secure;
(d) the water before treatment must comply with the limits of the microbiological parameters referred to in Annex 1, part And except for indicators, the number of colonies at 22 ° C for which a limit of 20 cfu / ml applies and the number of colonies at 36 ° C for which a limit of 5 cfu / ml applies,
(e) there will be no more ozone, bromates and bromoform in the product after treatment than provided for in Annexes 1 and 2, other substances likely to present a threat to public health.
(5) Packed infant water cannot be treated in any way, except for UV radiation under the conditions laid down in a specific legislation, (6) or the addition to it of other substances other than carbon dioxide. In the case of carbon dioxide saturation, the pH value shall not be less than 5.
(6) Where carbon dioxide is used from a non-natural source for the saturation or descaling of packaged waters, it shall comply with the conditions laid down in the specific legislation. 7)
(7) The authorised treatment methods for bottled drinking water are specified in a separate legislature.8) For the artificial addition of bottled drinking water by mineral substances, calcium, magnesium, potassium and sodium may be used in the forms listed in Annex 8 and in the purity according to a specific legislation. 7)
Requirements for the labelling of packaged natural mineral waters
(1) In terms of the carbon dioxide content, packaged natural mineral water is referred to as:
(a) natural mineral water naturally saturated, containing at least 250 mg / l of carbon dioxide and having, after processing and possible saturation by gas from the same source, the same carbon dioxide content as at source, within the range of periodic natural fluctuations;
(b) natural mineral water enriched which, after processing and saturation with carbon dioxide from the same source, has a carbon dioxide content higher than at source;
(c) natural mineral water saturated, which, after processing and saturation by carbon dioxide, has a carbon dioxide content equal to or greater than that at source,
(d) natural mineral water decarbonated, having a carbon dioxide content lower than at source after processing;
(e) natural mineral water not saturated which comes from a source containing carbon dioxide of not more than 250 mg / l.
(2) The packaging intended for consumers must, in addition to the information provided for by law, indicate:
(a) the designation of the species of packed natural mineral water in the words referred to in paragraph 1;
(b) an indication of the analytical composition indicating the characteristic components of the packaged natural mineral water, the carbon dioxide content in g / l with the designation of the laboratory;
(c) information on the adjustments made pursuant to Article 4 (1) (b) and (c); when treated with ozone-enriched air, the information shall be: "water has been modified by an approved oxidizing technology using ozone-enriched air 'and shall be given in the immediate vicinity of data on the characteristic composition,
(d) the designation "contains more fluorides than 1,5 mg / l - not suitable for regular consumption by infants and children under 7 years of age" if the natural mineral water has a fluoride content of more than 1,5 mg / l, this marking must be made in clearly visible letters and placed in the immediate vicinity of the product name at the same time as the actual content in the analytical composition, indicating the characteristic constituents of the packaged natural mineral water.
Requirements for the labelling of packaged spring waters
The packaging intended for consumers must, in addition to the information provided for by law, indicate:
(a) marking "spring water,"
(b) information on the adjustments made pursuant to Article 4 (1) (b) and (c); and
(c) where packaged spring water is saturated with carbon dioxide, the designation "spring water saturated" and the carbon dioxide content in g / l.
Requirements for the labelling of packed infant water
The packaging intended for consumers shall, in addition to the information provided for by law, indicate:
(a) the words "infant's water,"
(b) the characteristic composition of packed infant water, indicating at least the content of dissolved solids, calcium, magnesium, sodium, potassium, nitrate, sulphates, chlorides, fluoride, bicarbonates, with the designation of the laboratory and the date of analysis, not more than three years old;
(c) where packed infant water is saturated with carbon dioxide, the designation "infant water saturated" indicating the carbon dioxide content in g / l and the warning of the need to remove carbon dioxide by boiling if it is saturated to a value higher than 0,5 g / l and is used for infants;
(d) information on the use of UV radiation, if this method has been applied.
Requirements for the labelling of packaged natural mineral, spring and infant waters
(1) The packaging of packaged natural mineral, spring and infant water intended for consumers shall be accompanied by:
(a) the location (municipality or place) where the source is used and the name of the source; and
(b) an indication of how to store: "Store refrigerated and protect from direct sunlight."
(2) Where the water is distributed in packs of more than 5 litres, storage conditions and consumption times after opening shall be indicated on the packaging.
(3) Allowed negative mass and volume deviations:

(4) The name of the site (municipality or place) may be given as part of the name of the product, provided that it is packed water referred to in paragraph 1 coming from a water source from the site referred to in that name of the product. The name of the product shall not be misleading or misleading as regards the place where the source is used.
(5) The provisions of paragraph 4 shall apply mutatis mutandis as regards the importance of the name of the source or site (municipality or place) where the source is used in relation to the name of the product used in any way of offering it for sale.
(6) The bottled water referred to in paragraph 1 produced from the same water source may not be put into circulation under different product names.
(7) Where the packaging of the packaged waters referred to in paragraph 1 intended for consumers indicates the name of the product different from the name of the source or place of use, the place or name of that source shall be indicated in a font size such that the height and width are at least 1,5 times the largest font used for the name of the product.
(8) The packaging of the bottled waters referred to in paragraph 1 intended for consumers and any marketing for sale shall not be used in the form of symbols or any other form which:
(a) indicate a property which the water does not have, in particular as regards its origin, use for the preparation of infant formulae, results of water analyses or similar references guaranteeing authenticity; or
(b) may cause confusion with other bottled waters, in particular as regards the designation "mineral water," "mineral water."
(9) Any information attributable to the bottled waters referred to in paragraph 1 may not appear on the consumer packaging and in any way offered for sale in relation to the prevention, treatment or treatment of human diseases. The additional indications of these packaged waters are given in Annexes 6 and 7. This marking may be used if these bottled waters comply with the requirements set out in those Annexes.
(10) Packed natural mineral water and packaged spring water can only be put into circulation as "suitable for the preparation of infant foods" if it meets all the parameters for infant water listed in Annex 2. Where the water is saturated with carbon dioxide to a value greater than 0,5 g / l, the consumer shall be warned of the need to remove carbon dioxide by boiling if the water is used for infants.
Requirements for the labelling of bottled drinking water
(1) The packaging intended for consumers must, in addition to the information provided for by law, indicate:
(a) the words "drinking water,"
(b) where the bottled drinking water is saturated with carbon dioxide, the carbon dioxide content in g / l;
(c) an indication of how to store: "Store refrigerated and protect from direct sunlight"; and
(d) where the water is distributed in consumer packages of more than 5 litres, storage conditions and consumption times after opening must be indicated on the packaging.

(3) In the case of the addition of bottled drinking water by mineral substances, the packaging intended for the consumer must contain a list of the added substances and their content in the water after addition and the word "artificially supplemented by minerals - mineralised drinking water '.
(4) The labelling, protected names, trade marks, trade marks, pictures or other marks in the form of symbols or other forms which could indicate a property which this water does not possess and thus cause confusion with natural mineral water, infant or spring water, in particular as regards the designation of "mineral water," "mineral water, spring water, natural water" or geographical names, shall not be used on the packaging intended for consumers and in any way for the sale of bottled drinking water.
(5) Additional labelling of bottled drinking water is given in Annex 7. This marking may be used if this bottled water complies with the requirements set out in this Annex.
Control and evaluation of packaged waters
(1) The microbiological safety requirements for bottled waters, with the exception of bottled drinking water, are satisfied unless the limits laid down in Annexes 1 and 2 are exceeded in the sample taken.
(2) In the case where no more than two colonies forming units per 250 ml of coliform bacteria, enterococci, Pseudomonas aeruginosa or no more than two colonies forming units per 50 ml of intestinal sporulating anaerobic bacteria reducing sulphites are detected, a further four samples from the same batch of production shall be re-tested. For all four samples, the microbiological safety requirements laid down in paragraph 1 shall be met during the repeated test.
(1) The quality and health check of packaged natural mineral waters provided by the manufacturer shall be carried out at least once a year for the characteristics listed in Annexes 1 and 3. Specific legislation shall apply to the control of the source. 3) The daily production check shall be carried out at least within the scope of the List of Indicators set out in Annex 4.
(2) The quality and health check of packed spring water and packed infant water provided by the manufacturer shall be carried out at least three times in the calendar year for all the characteristics listed in Annex 2 and at least twice in the calendar year for all the characteristics listed in Annex 3. The daily production check shall be carried out at least within the scope of the list set out in Annex 4. The daily production of packed infant water shall be checked before dispatch.
(3) The quality and health check of bottled drinking water provided by the manufacturer shall be carried out in accordance with a specific regulatory regulation.4)
(4) If it is found during the inspection of packaged waters that the result of the individual determination of the indicator with MH or NMH is greater than the limit value reduced by measurement uncertainty, the cause shall be immediately examined and corrective measures taken.
Transitional and final provisions
(1) The labelling of bottled waters, the production of which began before the date of application of this Decree, must be brought into line with the provisions of Sections 5 (2) (a) and (b) and 6 to 9 by 1 July 2005 and with the provisions of Section 5 (2) (c) and (d) by 1 July 2004. Packed waters packed and labelled before the dates indicated may be sold out until stocks are sold out.
(2) In natural mineral waters, the limit of the fluoride indicator shall be respected as from 1 January 2008; the limits of the arsenic, manganese and selenium indicators shall be respected as from 1 January 2006. Until then, for natural mineral waters the following limit values shall apply: arsenic 0,05 mg / l, manganese 2,0 mg / l, selenium 0,05 mg / l.
(3) For natural mineral waters packaged and labelled in other Member States of the European Union, the limits set out in Annex No 1 shall apply from 1 January 2006, except for the limit for the nickel indicator applicable from 1 January 2008. Natural mineral waters packed and labelled before the dates indicated may be sold out until stocks are sold out.
The following shall be deleted:
1. Decree No. 292 / 1997 Coll., on the health requirements for packaged waters and on how they are treated.
2. Decree No. 241 / 1998 Coll., amending Decree No. 292 / 1997 Coll., on health requirements for packaged waters and on how to adapt them.
3. Decree No. 465 / 2000 Coll., amending Decree No. 292 / 1997 Coll., on the health requirements of packaged waters and their presentation, as amended by Decree No. 241 / 1998 Coll.
Efficacy
This Decree shall take effect on 1 May 2004.

Explanatory notes:
1. the reference value - the value adopted for the purpose of determining the performance characteristics of the methods used for measuring the concentrations of the constituents listed in Annexes 1 and 2.
2. Accuracy is the tightness of the agreement between the result of the measurement and the actual value of the measured variable.
3. precision expresses the degree of dispersion around the mean value. Accuracy depends only on the distribution of random errors and does not relate to the actual value. It is usually expressed as a standard deviation of the sample results from the mean. Allowed accuracy is equal to twice the relative standard deviation.
4. the limit of detection is either three times the relative standard deviation for a natural sample containing a low concentration of a given parameter, or five times the relative standard deviation of a blank.
5. the reference value applies to each of the following substances: bromoform, dibromochloromethane and dichlorbromomethane.
6. the method should allow the determination of the total quantity of cyanide in all its forms.
7. the method used shall be able to measure the concentration at the limit value of the indicator with a trueness of 0,2 units of pH and a precision of 0,2 units of pH.
