implementing Act No. 122 / 2000 Coll., on the Protection of Collections of Museums and on the Change of Certain Other Laws
The Ministry of Culture ("the Ministry ') provides, pursuant to Article 16 of Act No. 122 / 2000 Coll., on the protection of collections of a museum nature and on the amendment of certain other laws (" the Act'):
§ 1
Permanent preservation of collections of museum character and individual collection items
(1) Measures ensuring the protection and sustainable preservation of collections of a museum nature (hereinafter referred to as the "collection") in their integrity and in their individual collection items are:
(a) the storage of collection items in such a way as to prevent their damage or destruction or, where appropriate, the destruction or destruction of other collection items with which they are jointly stored;
(b) the storage of collection items on premises where, according to their nature, adequate physical and chemical conditions are ensured, in particular, the permanent adequate air temperature, the permanent adequate air humidity, minimum dust, protection against light radiation;
(c) protection of collection items from damage;
(d) the storage of collection items in premises secured by mechanical or electronic protection systems or combinations thereof, with a specified entry regime for persons and, where appropriate, on premises under permanent surveillance;
(e) regular treatment of collection items as protection against organisms such as bacteria, fungi, fungi and insects and other biological damage, corrosion and other chemical changes in materials;
(f) ensuring the safety and protection of collection items in the handling and transport, lending and making available to the public.
(2) In order to ensure the measures provided for in paragraph 1, the development of the collection, including the inclusion and disposal of collection items, and to enable it to be made available to the public pursuant to Article 9 (1) (f) of the Act under the specific conditions of the owner of the collection, the collection or individual collection items provided for by the owner of the collection pursuant to Article 9 (1) (g) of the Act and which contains technical procedures and implementing and organisational instructions, in particular:
(a) the depositary Regulations, which shall determine the persons authorised to work with collections and individual collection items, lay down the principles governing the preparation, preservation, restoration and other treatment of collection items, and the method of checking the safety and protection of the collection;
(b) the procedure for detecting the effects of environments threatening collection items or for detecting the safety of the collection;
(c) the procedure for the classification of articles in the collection and for the exclusion of collection items from the collection pursuant to Article 9 (1) (j) of the Act;
(d) the rules of inquiry laying down the procedure for the presentation of collection items to researchers;
(e) the procedure for the transmission of collection items for preparation, preservation or restoration;
(f) the procedure for the temporary transfer of collection items to another legal or natural person;
(g) the procedure for handling applications for export of collection items abroad;
(h) the procedure for determining the parts of collections intended for annual inventory;
(i) the definition of collection items requiring or allowing special treatment, in particular exceptional security measures, storage under exceptional conditions, the prohibition on lending or exporting collection items abroad and the fulfilment of the conditions for demonstrating their appearance or function,
(j) the procedure for evacuating collection items in the event of an emergency, including determining the order of evacuation and the places to store and ensure the protection of collection items.
§ 2
Collection record keeping
(1) Each collection item is recorded in the collection records of the owner of the collection. The collection record shall be a set of records (hereinafter referred to as "the record ') for each collection item under Paragraph 9 (1) (d) of the Act, supplemented by the number of items, if it is a collection item under paragraph 2. In the case of collection items referred to in paragraph 2, where the data are not identical for all parts of the collection article, the record of such collection article shall include additional information to each part of the collection article.
(2) A set of movable goods, including preparations of human and animal bodies or parts thereof and skeletal remains of human and animal beings, or of immovable property, may be registered as a single collection item if:
(a) the nature of one systematic group;
(b) fragmental archaeological material, mass findings of coins and osteological material;
(c) the same thing of one kind;
(d) documents and prints, negatives, photographs, film records, drawings and sketches relating to a single subject or a significant person; or
(e) items which form one functional file or are components of one functional unit.
(3) For collections of more than 3,000 items of movable or more than 11 real estate items, two-stage collection records are always kept. The first step shall be the record of increments (hereinafter referred to as "chronological records'), which shall contain the records referred to in paragraph 1 and shall normally be kept in the book of incremental items, the second step being a catalogue of collection items, which shall normally be kept in the book of inventory or on special catalogs (hereinafter referred to as" systematic records'), which shall also include the data referred to in paragraph 1 and, where appropriate, further specifying data on the collection item. The records in the chronological record shall be made immediately after the decision to include the collection item in the collection; the records in the systematic record shall be made after the technical examination of the collection item, no later than 3 years after the record has been made in the chronological record. For each section of the collection marked in point 4 of the form listed as Annex 1 to this Decree, the systematic records shall be kept separately; the registration numbers form a numerical line. Records in both chronological and systematic records shall be kept only in paper form and shall be made by hand or by printing from auxiliary records kept in electronic form; systematic records may be kept on multiple copies which constitute back-up catalogues. In case of destruction or loss, systematic records shall always be kept separately from the chronological records. The books to which records and special cataloguing sheets are made shall bear the stamp and signature of the responsible person or the register number of the collection under which it is kept in the central register of collections (hereinafter referred to as "the central register '); the sheets of books must be numbered on an ongoing basis.
(4) Only chronological or systematic records may be kept for collections not exceeding 3 001 of movable or 11 of immovable property. After the above figures have been exceeded, systematic records shall be completed for all collection items where only the chronological records have been kept within 1 year at the latest. Each collection item included in the collection above the number specified in the first sentence shall be recorded in both stages of the register.
(5) The registration number of the collection article (hereinafter referred to as the "registration number") is the number which relates to the collection article, the collection item is marked by it and appears in the chronological and, where appropriate, systematic record. For collection items kept in the chronological record, the registration number shall be the incremental number, consisting of a serial number, broken down by a number indicating the year of inclusion in the collection. For collection items kept and in systematic records, the registration number shall be the inventory number, sorted in a continuous numerical series according to the system corresponding to the nature of the collection or its branch part. Records in the chronological record cannot be made illegible; the corrections to the records are carried out in such a way that the contents of the corrected record before and after the correction can be established. This also applies to records in systematic records where chronological records are not kept.
(6) The registration number permanently identifies the collection item and joins the collection item in such a way that the collection item does not degrade but cannot be easily removed or separated during normal treatment of the collection object.
(7) The application for entry in the central register referred to in the second sentence of Article 3 (2) and Article 17 (2) of the Act and the application for the issue of an export permit referred to in Article 11 (2) of the Act shall indicate the registration numbers of the inventory; the incremental numbers can only be provided if there is no systematic record.
§ 3
Inventarisation of collections
(1) In the case of the annual inventory of collections, the designated part of the collection shall be the owner of the collection of the specified number of collection items of each collection. The number of collection items of each collection intended for inventory in a given calendar year shall be determined in such a way that each collection shall be inventoried in full no later than 10 years, for collections of more than 200 000 collection items over 15 years and for collections of more than 500 000 collection items over 20 years. The selection shall be based on the urgency, the history of the inventory of the collection in previous years, or a random file selected by the computer. The designated part of each collection shall be at least 5% of all collection items which are collected each year. The first inventory period shall start on the day of the entry of the collection into the central register and end on the inventory of all collection items registered on that date in the collection records of the collection holder; on the first day of the month following the date of completion of the inventory period, the next inventory period shall begin.
(2) In the case of extraordinary inventory of the collection, the designated part of the collection shall be the Ministry's designated number of collection items of the collection. Exceptional inventory may be ordered in the following cases:
(a) where collection items have been stolen and the extent of the damage is to be determined;
(b) after the transfer of the collection to other premises,
(c) if the collection has been damaged by external influences; or
(d) the inventory referred to in paragraph 1 has not been carried out for any reason during the previous 2 calendar years.
(3) The execution of the inventory shall be recorded in a systematic register. Where systematic records are not kept, the chronological record shall be recorded.
(4) The Ministry shall be notified of the implementation of the inventory and its outcome in the case of:
(a) the annual inventory of the designated part of the collection referred to in paragraph 1 by 28 February of the following year at the latest;
(b) the extraordinary inventory of the designated part of the collection referred to in paragraph 2 no later than 30 days after its completion;
(c) the end of the inventory of the whole collection after the end of the inventory period referred to in paragraph 1 at the latest by the last day of the month following the end of the inventory period.
(5) The notification referred to in paragraph 4 shall be made electronically or in paper form on a form the model of which is set out in Annex 6 to this Order.
§ 4
Removing collection items from collection records
(1) The removal of the collection item from the collection records provided for in Article 9 (1) (j) of the Act is carried out on the basis of the decision of the owner of the collection and after the change in the central records made by the Ministry pursuant to Article 7 (2) of the Act. A copy of the record of the collection item to be discarded shall be attached to the application for a change of registration in the central register of the collection owner and a justification for non-fitness, excess capacity, exchange or circumstances of loss.
(2) The record relating to the collection item excluded from the collection register, as indicated in the chronological and, where applicable, systematic register, shall be clearly marked with the word "ORIGINATED 'with reference to documents justifying the removal from the collection, including the document by which the change of data entered in the central register was notified by the Ministry. This record shall be kept permanently.
§ 5
Exports of collections abroad
In the case of a permit to export a collection or individual collection items abroad, the Ministry shall retain the certified part of: A form, confirmed parts B and C shall be received by the owner of the collection, with the confirmed part C accompanying the collection or individual items.
§ 6
Forms
(1) The model of the application form of the owner of the collection for entry in the central register provided for in Article 4 (1) of the Act is set out in Annex 1 to this Decree. Where the collection for which the applicant applies for entry in the central register contains more than one item of movable property than specified in Annex 4 to this decree, or more than 10 immovable property, the applicant shall indicate this in point 4 of the application by circling the relevant collection description and the characteristics of the collection referred to in point 5 of the application for each collection so marked in a separate annex to the application. In the event that the collection does not reach the number of movable items referred to in Annex 4 to this Decree or the number of 10 immovable items in each field, the applicant may apply a similar procedure or mark "other 'in point 4 of the application.
(2) The model form of the certificate of registration of the collection in the central register referred to in Article 5 (1) of the Act is set out in Annex 2 to this Decree.
(3) The model of the application form of the owner of the collection for the issue of the export permit pursuant to Article 11 (2) of the Act is set out in Annex 3 to this Decree.
§ 7
The organisation of a State or a local authority designated by the Ministry for the provision of professional assistance or services under Paragraph 10 (1) of the Act to collection owners are listed in Annex 5 to this Decree.
§ 8
Efficacy
This decree shall take effect on the day of its publication.
