DECLARATION
Ministry of Defence
of 15 November 1999
determining the categories of military vessels, the approval of technical competence and the conduct of technical inspections of military vessels and the testing of technical equipment of military vessels
In agreement with the Ministry of Transport and Communications, the Ministry of Defence provides in accordance with § 34 paragraph 6 of Act No. 219 / 1999 Coll., on the armed forces of the Czech Republic:
MILITARY VESSELS AND THEIR CATEGORY
Military vessels
(1) Military vessels are all types of vessels, floating machinery, floating equipment and combat vehicles which are introduced and used in the armed forces of the Czech Republic (hereinafter referred to as "the armed forces") and are designed to overcome water flows, to move or work on water flow or to perform specific tasks of the armed forces on water flows.
(2) Military vessels are subdivided into categories
(a) military ships;
(b) military floating machines;
(c) military floating equipment;
(d) amphibious military combat vehicles.
(3) Military navigation means the operation of military vessels on a waterway. 1)
Military vessels
(1) Military vessels are vessels introduced into the armaments and intended for use in the armed forces for the carriage of persons, cargo or handling of military floating equipment or machinery without self-propulsion and for the performance of specific tasks of the armed forces.
(2) Military ships are classified into categories
(a) self-propelled ships;
(b) small craft (1) with a self-propelled engine of up to 150 kW;
(c) small craft (1) without self-propelled.
Military floating machines
(1) Military floating machines are vessels introduced into the armaments and intended for use in the armed forces and equipped with mechanical equipment and designed to carry out specific military work on waterways.
(2) Military floating machines are divided into categories
(a) self-propelled;
(b) without self-propelled.
Military floating equipment
(1) Military floating equipment is mainly platforms, pontoon bridges and similar self-propelled floating equipment which are used in military technology by the armed forces to perform specific military tasks. In order to ensure their movement along the waterway, military ships are used and the movement of these devices is carried out by means of a frontal shift, lateral slip or pull, or by mutual combination of these methods, as appropriate.
(2) Military floating equipment is divided into categories
(a) pontoon bridges;
(b) pontoon coitus,
(c) floating rafts;
(d) floating bridge.
Amphibious military fighting vehicles
(1) Amphibious military combat vehicles are military combat vehicles designed to conduct combat activities or to transport persons or military material, capable of self-propelled on water.
(2) Amphibious military combat vehicles are divided into categories
(a) amphibious military combat vehicles on a belt chassis;
(b) amphibious military combat vehicles on wheeled chassis;
(c) other amphibious military vehicles.
MILITARY SHIPS
(1) Military vessels shall be subject to registration and shall be equipped with military ship lists with the exception of military vessels referred to in Sections 2 (2) (c) and 5.
(2) The military charter shall be:
(a) a driving order from a military vessel;
(b) a ship's certificate for a military vessel;
(c) logbook - only for military vessels referred to in § 2 (2) (a) and § 3,
(d) special permit for the operation of a military vessel;
(e) an amphibious military combat vehicle certificate.
(3) The scope of the equipment for each category of military vessel is determined by the Ministry of Defence (hereinafter referred to as "Ministry") in the registration of a military navigation register when issuing a military vessel certificate.
(4) The master of the military department shall notify the Ministry without delay of the loss or deterioration of the charter.
APPROVAL OF TECHNICAL ELIGIBILITY, IMPLEMENTATION OF TECHNICAL EXAMINATION OF MILITARY VESSELS AND IMPLEMENTATION OF TECHNICAL INSTALLATIONS FOR MILITARY VESSELS
The approval of the technical competence of military vessels shall be carried out by the Ministry when they are introduced into the armed forces to the extent provided for in specific legislation.2)
(1) The technical condition of a military vessel shall always be checked before operating on a waterway. The result of the check shall be recorded in the driving order of the military vessel.
(2) The commander of the military unit shall be responsible for the proper technical condition and safety of the vessels in operation.
Tests on technical equipment of military vessels shall be carried out in accordance with a specific regulatory regulation.3)
Technical conditions for conversion of already approved military vessels
The conversion of military vessels for purposes other than those for which their technical capacity has been approved shall not be permitted except for military vessels referred to in Section 2.
PROVISIONS COMMON AND FINAL
Military vessels which have been put into service in the armed forces in force by this Order shall be considered as military vessels referred to in Section 1 from the date of application of this Order.
Efficacy
This Decree shall take effect on 1 December 1999.
