DECLARATION
of 28 April 2004
establishing a list of diseases which could endanger public health and a list of diseases and disabilities which could seriously jeopardise public policy
The Ministry of Health provides pursuant to Section 182a of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 217 / 2002 Coll., hereinafter referred to as "the Act":
The Decree sets out, in accordance with the law of the European Communities (1), a list of diseases which could endanger public health and a list of diseases and disabilities which could seriously jeopardise public order.
The following shall be considered as diseases likely to endanger public health:
(a) diseases reported under the International Health Code and other emerging highly dangerous diseases (e.g. severe acute respiratory syndrome - SARS, smallpox),
(b) tuberculosis of the respiratory tract at an active stage of microscopic or culturally positive, or with a tendency to develop;
(c) syphilis; or
(d) other infectious diseases for which protective measures have been laid down by the competent administrative authority to protect against their introduction.
The following shall be considered as diseases and disabilities which could seriously jeopardise public policy:
(a) mental and behavioural disorders caused by the use of psychoactive substances; and
(b) acute psychotic disorders, delirium or impulsive conditions and other behavioural diseases affecting others, which are manifested by violence or behaviour manifesting destruction, or a reasonable threat thereof.
This Decree shall take effect on 1 May 2004.
