determining the amount of compensation for costs incurred in relation to material and financial security of education or training of soldiers in active employment and the conditions for its reduction
In agreement with the Ministry of Finance, the Ministry of Defence sets out, pursuant to § 37a (2) of Act No. 92 / 1949 Coll., the Brandenary Act, as amended by Act No. 164 / 1992 Coll.:
§ 1
(1) In order to compensate for the costs incurred for the material and financial security of education or training of a soldier in active employment (hereinafter referred to as "compensation of costs"), on release before the obligation to continue the service has been fulfilled or before the obligation entered into (hereinafter referred to as "the undertaking"), for the reasons set out in Section 37a (1) of Act No. 92 / 1949 Coll., as amended by Act No. 164 / 1992 Coll., an internal study, including holidays and holidays, is required for each month of internal studies,
a) 1500 CZK in the study of command, economic and social fields of university,
b) 2000 CZK when studying technical fields of university,
c) 2500 CZK in the study of medical and pharmaceutical fields of university or technical fields of university associated with training of pilots and flight ducts,
d) 1000 CZK when studying secondary or other schools or courses lasting 15 calendar days.
(2) For the period of study for which a soldier in active duty has performed a basic service, half of the costs referred to in paragraph 1 shall be required.
(3) No reimbursement of costs shall be required for the calendar month in which the soldier in active employment commences or terminates his / her duties unless the period of study exceeds 15 calendar days.
§ 2
Compensation of costs which a soldier in active duty is obliged to pay (hereinafter "the compulsory ') shall be determined by the department commander of the total amount of costs calculated in accordance with Paragraph 1 by the ratio of the outstanding commitment period to the total commitment period.
§ 3
The head of the department may, at the request of a debtor who has been made redundant on his own request for reasons of special consideration (1), reduce the reimbursement of the costs laid down under Paragraph 2 to half. In doing so, it shall take into account in particular the reasons for the failure to fulfil the undertaking and the property and social circumstances of the debtor and his family. This shall be without prejudice to the right of the debtor to request remission of the claim or part thereof under a special regulation.2)
§ 4
According to this decree, the reimbursement of costs shall be determined if the study was initiated after the entry into force of this decree.
§ 5
This decree shall take effect on the day of its publication.
