DECLARATION
of 8 September 2011
amending Decree No. 177 / 2009 Coll., on the Closer Conditions for Termination of Education in Secondary Schools by Graduate Examination, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 81 (11), § 91 (1) and § 113a (2) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 242 / 2008 Coll. and Act No. 49 / 2009 Coll.:
Decree No. 177 / 2009 Coll., on the Closer Conditions of Termination of Education in Secondary Schools, as amended by Decree No. 90 / 2010 Coll., Decree No. 274 / 2010 Coll. and Decree No. 54 / 2011 Coll., is amended as follows:
1. In Section 1 (b), the word "successful 'shall be inserted after the words" post-graduate examinations'.
2. Paragraph 2 (2) to (5), including footnotes 4 and 5, states:
"(2) During the spring trial period, the graduation examinations shall take place from 2 May to 10 June, in the autumn trial period from 1 September to 20 September.
(3) In the spring test period, the tests and partial tests of the common part of the graduation examination conducted in the form of a didactic test (the didactic test) and of the joint part of the graduation examination performed in the form of written work (the written work) shall be carried out between 2 May and 15 May. The sub-examinations of the common part of the oral examination shall be held from 16 May to 10 June before the examination committee (the "oral examination of the common part '). The specific dates for the holding of didactic tests and written work during the spring examination period shall be determined by minister4) by 1 September of the school year in which the final examination is held. The timetable for the holding of the didactic tests and written work (hereinafter referred to as the Single Test Schedule) shall be determined by the Ministry by 31 December of the school year in which the final examination is held; the data are published by the Ministry in a way that allows remote access.
(4) Profiler part examinations 5) take place during the spring examination period between 16 May and 10 June. Tests carried out in the form of a written examination ("written examination ') and a practical examination (" practical examination') shall take place not earlier than 1 April. In cases where the nature of the test so requires, a practical examination may be carried out at an earlier date.
(5) In the autumn trial period, the didactic tests and written work of the common part of the graduation examination shall be held between 1 September and 10 September, oral examinations of the common part between 11 September and 20 September. The specific dates of the didactic tests and the written work in the autumn examination period shall be determined by the Minister4) by 1 February at the latest before the graduation examination in the following school year. The uniform test scheme shall be determined by the Ministry by 15 August at the latest before the graduation examination and published in a manner that allows remote access.
4) Paragraph 80 (1) of the Education Act.
5) Paragraph 79 (4) and (5) of the Education Act. '
3. In Paragraph 2 (6), "31 October 'is replaced by" 20 September';
4. In Paragraph 2, the sentence "Where the nature of the test so requires, a practical examination may be carried out within an earlier period, at the end of paragraph 6. 'is added.
5. Paragraph 2 (7) reads as follows:
"(7) The specific dates of the oral examinations of the common part and the specific dates of the compulsory and optional tests of the profile part shall be determined by the school director no later than two months before they are conducted in accordance with paragraphs 3 to 6, so that they do not overlap with the single test scheme. ';
6. Paragraph 4 (6) reads as follows:
"(6) Changes in the student's data referred to in paragraph 2 (a) and (g) which have taken place since the transmission of the Centre's data pursuant to paragraph 5 shall be notified without delay by the Director of the Centre. Changes in the data of the pupil referred to in points (c) and (e) of paragraph 2 which occurred during the period following the transmission of the data of the Centre pursuant to paragraph 5 due to the transfer of the pupil pursuant to § 66 (4) of the Education Act or the change in the field of education under § 66 (3) of the Education Act shall be notified to the Centre by the Director of the School without delay. Changes according to the second sentence may be made at the latest by the beginning of the test of the profile part of the graduation exam in accordance with § 2 (4) and (6). '
7. In Article 4, the following paragraph 7 is inserted after paragraph 6:
"(7) A pupil admitted to the final year of education under Section 63 of the Education Act after the deadline referred to in paragraph 5 (a) shall submit an application for the following autumn trial period. This period shall also be considered as a proper term for the completion of the final examination by this pupil. ';
Paragraph 7 shall become paragraph 8.
8. Paragraph 4 (8) reads as follows:
"(8) The student shall receive an extract from the Centre's information system validated by the school director no later than 5 days after the transmission of the Centre's data pursuant to paragraph 5 and shall confirm the accuracy of the information contained therein by signing. ';
9. In Article 6 (6), the words "at the same level of difficulty 'shall be inserted after the words" cannot'.
(10) In Article 8 (3), the first and second sentences are replaced by the following: "Each working sheet shall contain, in a unique combination, either three test tasks processed by the Centre and one test role processed by the School (hereinafter referred to as the" School test role ") as defined by the Centre, or four test tasks processed by the Centre. The paper form of the relevant working sheet shall be produced by the school through the Centre's information system from a set of test tasks processed by the Centre and, where appropriate, from one school test role. ';
11. in Paragraph 8 (3), the last sentence is deleted;
12. In Section 8, at the end of paragraph 5, the sentence "The pupil draws lots from at least five working lists."
13. in Article 11 (2):
"(2) The safety deposit box shall also contain:
(a) the list of pupils,
(b) a test report in the classroom;
(c) guidelines for contracting entities;
(d) security envelopes for completed record sheets and student attendance lists;
(e) other auxiliary materials. ';
14. in Article 13 (2), the sentences of the third and fourth shall be deleted;
15. In Paragraph 13 (4), the third sentence shall be replaced by the sentence "The Director of the School shall, following a call from the Centre, arrange for the transmission of a safety deposit box to the Centre in the manner specified by the Centre."
16. in Article 22 (2) and (3):
"(2) The didactic test is evaluated by the Centre. The results of the didactic tests shall be made available by the Centre to the Director through the Centre's information system in the spring trial period no later than 15 May, in the autumn examination period no later than 10 September. They shall be made available to pupils on the following working day following receipt of the results. In the spring examination period, the school director shall make the results available to pupils by listing the results of the didactic tests. The extract, provided with facsimile signature of the Director of the Centre, shall be made by the Director of the School through the Information System of the Centre for each pupil who carried out the didactic test.
(3) The Centre shall forward written work to the evaluators for evaluation. The evaluator transmits through the Centre's information system the evaluation of the written work of the student to the Centre in terms set by the Centre. The Centre shall make the results of the written work available to the School Director within 3 working days of the meeting of the evaluation of all the written work of the school concerned. ';
17. in Article 23 (2), the second sentence is deleted;
18.Paragraph 23 (4) reads as follows:
"(4) If the pupil fails to perform any part test successfully, only this part test shall be repeated. This does not apply if the pupil chooses a different level of difficulty for the repair test; in that case, the pupil shall carry out a repair test of the test subject within the scope of all partial tests. ';
19. In Article 24 (2), the words "taking different forms' shall be inserted after the words" parts'.
20. Paragraph 25 (1) reads:
"(1) In the event that the test consists of several parts in different forms and the pupil has not successfully performed any part of the test, he shall repeat the part of the test which he has failed. '
21. in Paragraph 25, paragraph 2 is deleted;
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
22. in Paragraph 26 (3):
"(3) The Centre shall collect the results of the graduation examination based on the results of both its parts and without undue delay, in the spring trial period no later than 3 working days after the collection of the results for each school and in the autumn trial period no later than 3 working days after the collection of the results of the individual pupil shall make the results available to the Director of the School through the Centre's information system. ';
23. in Paragraph 26 (5) (a), the word "worse" is replaced by the word "higher."
24.
(1) Protocols under § 27 to 31 and records under § 32 are included in the compulsory documentation of the graduation examination; they shall be drawn up and transmitted between the school or the Commissioner and the Centre through the Centre's information system. Forms of protocols and records shall be made available by the Centre through the Centre's information system before the start of the graduation examinations, no later than 1 April of the relevant school year, unless otherwise specified.
(2) Protocols under § 27 to 31 are imposed at school in the manner laid down by the Act on archiving and file service and amending certain laws (11). The time limit shall be:
(a) 5 years for the protocol referred to in Article 27 and the record referred to in Article 32;
(b) 45 years for protocols under Sections 28 to 31.

25. in Articles 27 (3), 28 (1) and 30 (2), the word "archiving" shall be replaced by "storage."
26. in Paragraph 29 (2):
"(2) The report on the results of the common part of the pupil's graduation exam shall be processed by the Centre and made available to the school director through the Centre's information system in the spring trial period no later than 15 June and in the autumn trial period, at the same time as making the results of the graduation examination referred to in Article 26 (3) available. ';
27. in Paragraph 29 (6):
"(6) The form of the report on the results of the common part of the pupil's graduation examination, the model of which is set out in Annex 4 to this Decree, shall be accompanied by a grey underprint with an motif of the leaves and the national emblem, a watermark with motifs of the lipos branches on each side of the form, a serial number of the form and at least a six-digit number of the form. It shall be drawn up on a sheet of 210 x 280 mm format with a tolerance of 3 mm. ';
28. in Article 29a (3) (a), the words "school identifier" are replaced by the words "legal person who carries out school activities."
29. Paragraph 33, including the title and footnote 13, reads:
Issue of a certificate
The school director shall, on the basis of the data made available by the Centre pursuant to Article 26 (3), issue a certificate of graduation to a pupil who has successfully completed both parts of the final examination within 3 working days of their disclosure. The Certificate of Graduation is drawn up by means of the Centre's Information System and issued by the School Director on a form in accordance with the model laid down in the Decree on certain educational documents13).

30. In Paragraph 38 (b), the words "in the case of the contracting authority and the assessor of the oral examination of the common part of the final examination" shall be inserted after the words "at the school concerned."
31. Paragraph 41, including the title, reads:
Evaluator
The evaluator of the oral examination shall normally perform his duties at the school of which he is a teaching staff. If the school where the oral examinations are to be held does not have a sufficient number of teaching staff to fulfil the conditions for the performance of the evaluation function for the subject, the school director may appoint another evaluator in accordance with § 42 (3). Written work is evaluated by the evaluator through the Centre information system. '
32. in Paragraph 42 (2) (a), the words "is the test subject of the common part of the graduation examination" shall be replaced by the words "commissioned."
33. In Paragraph 44 (2), the words "oral examinations of the common section 'shall be inserted after the words" the evaluator'.
34. in Article 48 (4), the sentences of the second and third paragraphs are deleted;
Transitional provisions
1. The specific dates for conducting the didactic tests and written work in the spring trial period of 2012 shall be determined by the Ministry by 30 September 2011.
2. In the autumn test period in 2011, the final examination, including the repair and replacement tests for this test period, shall be carried out according to existing legislation.
3. In the school year 2011 / 2012, pupils are enrolled for the spring trial period according to § 4 of Decree No. 177 / 2009 Coll. until 15 December 2011. The school director shall transmit for the spring trial period in the school year 2011 / 2012 the data referred to in § 4 (2) to (4) of Decree No. 177 / 2009 Coll. The Centre shall, by 19 December 2011 at the latest. The student will receive an extract from the Centre's information system validated by the school director by 22 December 2011 at the latest and will confirm the accuracy of the information contained therein by signing.
4. In the school year 2011 / 2012 and 2012 / 2013, the pupil cannot take an optional exam from the test subject informatics.
Efficacy
This Decree takes effect on 30 September 2011.
