GOVERNMENT REGULATION
of 28 April 2004
on the unilateral abolition of the visa requirement in respect of the Principality of Andorra, the Republic of Bolivia, the Federative Republic of Venezuela, the Republic of Brazil, the Republic of Guatemala, Japan, the Principality of Monaco, the Republic of Nicaragua, New Zealand, the Republic of Paraguay, the Republic of El Salvador, the Republic of San Marino, the Holy See, the Sovereign Order of the Maltese Knights, the Special Administrative Region of the People's Republic of Hong Kong, the Macao Special Administrative Region of the People's Republic of China and the holders of the United Nations' Laissez-Passer '
The Government orders pursuant to Section 181 of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 140 / 2001 Coll. and Act No. 222 / 2003 Coll., and to be supplemented to the extent provided by the immediately binding regulation of the European Communities: 1)
§ 1
(1) Holders of valid diplomatic and travel passports of the Principality of Andorra may enter the territory of the Czech Republic and temporarily reside without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a professional activity. Holders of valid diplomatic passports of the Principality of Andorra who travel to the Czech Republic as members of a diplomatic mission or consular post to take up their duties may travel and reside in the Czech Republic for the duration of their secondment without visas. The same rules apply to family members living with persons mentioned in the previous sentence of the common household, provided they also hold valid diplomatic passports of the Principality of Andorra.
(2) Holders of valid passports of the Republic of Bolivia of Venezuela may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity.
(5) Holders of valid diplomatic, official and travel passports of Japan may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity. Holders of valid diplomatic and official passports of Japan who travel to the territory of the Czech Republic as members of a diplomatic mission or consular post to take up their duties may travel and reside in the territory of the Czech Republic for the duration of their secondment without visas. The same rules apply to family members living with persons mentioned in the previous sentence of the common household, provided that they also hold valid diplomatic and official passports of Japan.
(6) Holders of valid diplomatic, service and travel passports of the Principality of Monaco may enter the territory of the Czech Republic and temporarily reside without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity.
(8) Holders of valid diplomatic, official and travel passports of New Zealand may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a professional activity. Holders of valid diplomatic and official passports of New Zealand who travel to the territory of the Czech Republic as members of a diplomatic mission or consular post to take up their duties may travel and reside in the territory of the Czech Republic for the duration of their secondment without visas. The same rules apply to family members living with persons mentioned in the previous sentence of the common household, provided that they also hold valid diplomatic and official passports in New Zealand.
(10) Holders of valid travel, diplomatic or official passports of the Republic of Salvador may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity.
(11) Holders of valid diplomatic, service and travel passports of the Republic of San Marino may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a professional activity.
(12) Holders of valid diplomatic, service and travel passports of Holy See may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity. Holders of valid diplomatic and service passports of Holy See who travel to the territory of the Czech Republic as members of a diplomatic mission to take up their duties may travel and reside in the territory of the Czech Republic for the duration of their secondment without visas. The same rules apply to family members living with persons mentioned in the previous sentence of the common household, provided that they also hold valid diplomatic and service passports of the Holy See.
(13) Holders of valid diplomatic passports of the Supreme Order of Maltese Knights may enter the territory of the Czech Republic and temporarily reside without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a professional activity. Holders of valid diplomatic passports of the Supreme Order of Maltese Knights who travel to the territory of the Czech Republic as members of a diplomatic mission to take up their duties may travel and reside in the territory of the Czech Republic for the duration of their service without visas. The same rules apply to family members who live with persons mentioned in the previous sentence in the common household if they also hold valid diplomatic passports of the Supreme Order of the Maltese Knights.
(14) Holders of valid passports The special administrative areas of the Hong Kong People's Republic of China may enter the territory of the Czech Republic and temporarily stay without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity.
(15) Holders of valid passports The Macao Special Administrative Areas of the People's Republic of China may enter the territory of the Czech Republic temporarily without a visa for a maximum period of 3 months, unless the purpose of their stay is not to pursue a gainful activity.
(16) Holders of valid United Nations travel documents (UN) "Laissez-Passer 'issued under the UN Convention on Privileges and Immunities, which was approved by the United Nations General Assembly on 13 February 1946, and under the Convention on Privileges and Immunities of International Professional Organisations, which was approved by the United Nations General Assembly on 21 November 1947, may enter the territory of the Czech Republic and temporarily reside without a visa for a maximum period of 3 months, unless the purpose of their residence is to pursue a professional activity. Holders of these valid travel documents, which are accredited to the UN representative offices in the Czech Republic, may reside in the territory of the Czech Republic without visas during their secondment.
§ 2
The following shall be deleted:
1. Government Decree No. 349 / 2001 Coll., on the visa waiver for passport holders of the Special Administrative Region of the People's Republic of China Macao.
2. Government Decree No. 350 / 2001 Coll., on the visa waiver for passport holders of the Hong Kong Special Administrative Region of the People's Republic of China.
3. Government Decree No. 460 / 2001 Coll., on the visa waiver for holders of diplomatic, official and travel passports of Japan.
4. Government Decree No. 461 / 2001 Coll., on the visa waiver for holders of diplomatic, official and travel passports of New Zealand.
5. Government Decree No. 581 / 2002 Coll., amending Government Decree No. 461 / 2001 Coll., on the visa waiver for holders of diplomatic, official and travel passports of New Zealand.
6. Government Decree No. 462 / 2001 Coll., on the visa waiver for holders of diplomatic and travel passports of the Principality of Andorra.
7. Government Decree No. 463 / 2001 Coll., on the unilateral abolition of the visa requirement in relation to the Principality of Monaco, the Republic of San Marino, the Holy See and the Supreme Order of the Maltese Knights.
8. Government Decree No. 485 / 2001 Coll., on the visa waiver for holders of United Nations' Laissez-Passer travel documents, European Union travel document "Laissez-Passer" and European Union replacement travel document "Emergence Travel Document."
§ 3
(1) This Regulation shall enter into force on the day of its publication.
(2) Paragraph 1 (4) expires on the date of entry into force of the Agreement between the Government of the Czech Republic and the Government of the Federative Republic on the partial lifting of the visa requirement approved by the Government of the Czech Republic on 10 March 2004.
(3) Paragraph 1 (5) expires on the date of entry into force of the Agreement between the Government of the Czech Republic and the Government of the Republic of Guatemala on the abolition of the visa requirement approved by the Government of the Czech Republic on 19 November 2003.
(4) Paragraph 1 (8) expires on the date of entry into force of the Agreement between the Government of the Czech Republic and the Government of the Republic of Nicaragua on the visa waiver for passport holders, approved by the Government of the Czech Republic on 31 March 2004.
(5) Paragraph 1 (10) expires on the date of entry into force of the Agreement between the Government of the Czech Republic and the Government of the Republic of Paraguay on the visa waiver for passport holders, approved by the Government of the Czech Republic on 19 November 2003.
(6) Paragraph 1 (11) expires on the date of entry into force of the Agreement between the Government of the Czech Republic and the Government of the Republic of El Salvador on the visa waiver, approved by the Government of the Czech Republic on 17 March 2004.

1) Article 4 (1) (a) and Article 4 (3) of Council Regulation (EC) No 539 / 2001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement.
