DECLARATION
Ministry of Defence
of 5 November 1999
on the scope and manner of providing in-kind formalities to soldiers in basic or replacement service and to soldiers in reserve called for military exercises
According to § 84 (3) of Act No. 220 / 1999 Coll., on the course of basic or replacement service and military exercises and on certain legal ratios of soldiers in reserve:
Provision of meals in kind
(1) In-kind eating means the delivery of food, namely breakfast, lunch and dinner. Food is made up
(a) hot food; or
(b) cold meals; or
(c) food for the separate or group preparation of food.
(2) Refund in money for food or food means the financial value of the species and quantities of each food corresponding to the diet and, where appropriate, the food supplement. Refund in money shall be paid if it is not possible to ensure in-kind meals through the supply of food or food referred to in paragraph 1 or if the service authority so decides. 1)
(3) Material means means means a dining cutlery with a cover and can opener, which are given to the soldier when the basic or replacement service takes place.
(1) Natural catering shall be provided to a soldier in primary or replacement service and to a soldier called for military training ("soldier") from the date of entry into military active service to the day of release from the services. 2)
(2) In-kind meals and compensation in cash are not provided to the soldier at the time
(a) following a day of insolence,
(b) leave without entitlement to cash formalities;
(c) stay in the hospital.
Food supplements and food supplements
Food and food shall correspond to the food ration and food supplements, their energy standards and nutritional values set out in Annex 1 and the average food consumption composition set out in Annex 2.
(1) The dietary benefits, according to the complexity of the military occupation (hereinafter referred to as "employment"), are:
(a) basic diet,
(b) food levy for paratroopers.
(2) The subsistence allowance for paratroopers is granted to a military-executive paratrooper for the duration of his continuous practical paratrooper training and to a soldier who prepares in the Czech Republic to perform duties in the units of the multinational armed forces.
(1) The following food supplements are provided for each diet according to the complexity of the job employed:
(a) food addition A - health,
(b) food addition B - in case of strenuous employment,
(c) the addition of food C - in the case of a particularly strenuous job,
(d) food addition D - for generals, officers, ensigns and rotmasters for military training and for soldiers assigned to the duties of professional soldiers;
(e) the addition of food E - in physical activity,
(f) the addition of food F - for sports championships under the responsibility of the Ministry of Defence.
(2) Food supplements are provided only when providing in kind meals except food supplements A. Food supplements shall only be issued on days of entitlement to at least 2 daily meals, to the first of them. Food addition And it belongs regardless of the number of meals delivered.
(3) Only the following food supplements are given for each diet:
(a) the basic ration of food supplements A, B, C, D, E and F;
(b) the food supplement D for paratroopers.
(4) There is only one food supplement for each diet. Only food additive D is produced with food addition A, B and C.
(5) Where a soldier who receives a food levy for a paratrooper is engaged in a job providing food supplements B to F for a basic food levy, he may be given a basic food levy and an appropriate food supplement if it is more favourable to him.
(1) The addition of food A is given to a soldier
(a) inability to serve for sickness or injury in the care of the berth of the crew or other health care establishment, on an equal footing;
(b) staying in services in cases where health situations so require, in particular threats to epidemics or to bad drinking water.
(2) The addition of food B is given to a soldier when
(a) employment at the place of permanent dislocation of the unit which lasts for at least 24 hours, except in the case of shift duty, 3)
(b) training for the first three weeks of military active duty;
(c) the exercise of guard duty;
(d) the provision of flight actions, if the duration of the period during which the flight operation is operated is at least 10 hours;
(e) practical training with dogs in sub-officers' schools and in dog service courses, if the duration of training is at least 4 hours per calendar day.
(3) The addition of food C is given to the soldier when
(a) the exercise of shift or employment outside the place of permanent dislocation of the unit, if prepared or given food outside the place of permanent dislocation of the unit;
(b) life-threatening, health-threatening, significant property value or the environment or a disaster-stricken service,
(c) focusing on training for a military show or a mass performance at the department;
(d) shift or employment between 22 and 6 hours in air defence services;
(e) carriage or practical training in driving from 22 hours to 6 hours for at least 3 hours, by drivers of military equipment;
(f) the exercise of watch service in the Castle Guard.
(4) The addition of food D shall be given to the general, officer, ensign and sergeant in military training and to other soldiers assigned in the capacity planned for the professional soldier in carrying out the tasks referred to in paragraph 2 (a) and paragraph 3 (a) to (c).
(5) The addition of food E is given to a soldier when
(a) focusing on central training and carrying out a military show or mass body show;
b) focus on sports games in larger organizations.4)
(6) The addition of F food is given to a soldier when concentrating on sports games of the Czech Army.
Money compensation and cash compensation supplement
(1) Money compensation is paid for individual meals to be delivered at the level of their financial value.
(2) Money compensation is not paid for food supplements except food supplements C and E.
(3) A cash refund supplement shall be paid to the soldier together with the money refund if he is involved in:
(a) employment or sporting or mass cultural events organised by the service and not being able to eat at the service;
(b) employment with a non-prepared unit and cannot be secured by import or contract.
(4) Refund supplement in money is not paid on days
(a) proper leave, special leave, leave without entitlement to cash and medical leave;
(b) short-term leave to leave the service;
(c) walks.
(5) The amount of the supplement to the refund in cash is equal to the lowest amount of the diet under the special legislation. 5) Of this amount, it is paid to be replaced in cash for breakfast 20%, for lunch 40% and for dinner 40%.
Energy, nutrition and financial value of foodstuffs
(1) The financial value of the diet and food supplements is determined by multiplying the average consumption of each food per kilogram per day as set out in Annex 2 by their average trade prices per kilogram. The average commercial price is the average price of each type of food purchased for meals over the last 3 months.
(2) The financial value of food supplements and food supplements is adjusted depending on the development of commercial food prices. The adjustment shall be made if the total difference between the average trade prices of all types of food purchased over the last 3 months is more than or less than 5% compared to the commercial prices of the period in which the adjustment was last made.
(3) The financial value of food supplements and food supplements shall be adjusted not earlier than the first day of the month following the finding of the difference referred to in paragraph 2.
(1) The financial value of the diet is increased by 10% to the soldier
(a) in the cooking course on the days of food preparation,
(b) to a soldier in a permanently separated part of a unit of up to 25 persons who separately prepares food and processes separate accounting for food consumption.
(2) In accordance with paragraph 1, a further 10% may be increased by the financial value of the dietary benefits depending on the extent to which food is purchased in retail trade.
(3) The financial value of the diet and food supplements for a unit of 26 to 100 people where the purchase of food in retail trade is necessary can be increased by up to 10% depending on the extent to which food is purchased in retail trade.
(4) The financial value of the dietary benefits and food supplements for the emergency work unit in disasters or other serious situations affecting life, health, significant property value or the environment, or for the disaster unit, may be increased by up to 20%.
(5) On 24 December of each calendar year, the financial value of the dietary benefits shall be increased by 50% for the soldiers present at the service for the dinner service.
(6) The energy and nutritional value of food supplements and food supplements and their financial value may not be used up every day of the month. However, the monthly mean of the draw must correspond to the values established for each diet and food supplement in the range of 5% to 5% below the specified values. The annual mean of drawing shall not exceed 10% to 3% below the specified values.
Provision of equipment
(1) The equipment shall be provided by the supply of military equipment and free services or by compensation in cash. Free services are laundry, dry cleaning, treatment, repair and maintenance of military equipment and hair treatment.
(2) According to his position, a soldier will be provided with military equipment.
(a) to be owned;
(b) entrusted for use which, after the completion of military active service, becomes the owner of a soldier;
(c) entrusted for use which, after the completion of military active service, does not go into the ownership of a soldier;
(d) of a consumer and personal nature.
(3) Money compensation is granted
(a) for the acquisition and addition of military equipment not purchased;
(b) for the acquisition and use of civil clothing by a soldier who has been permitted to wear it at work;
(c) for military equipment which cannot be provided.
(4) The amount of compensation in respect of the acquisition and addition of military equipment is determined according to the level of retail prices.
(5) The equipment shall be provided to the soldier from the date of taking up military active duty to the date of release from the services. 2)
Military equipment at funeral
If a soldier dies, a military uniform with no shoes and a laundry kit will be set to bury him.
Orthopaedic footwear and oversized military equipment
(1) Orthopaedic footwear is provided on the basis of a voucher prescribed by the doctor, instead of shoes which would otherwise belong to the soldier. Orthopaedic footwear becomes the owner of a soldier after the military service or after the service life of the footwear.
(2) A soldier called for military training who has been authorised to wear his own orthopaedic footwear is not provided.
(3) Excessive size of military equipment is provided by a special contract for a soldier.
(4) Oversized military equipment is not provided to a soldier called for a military exercise who has been permitted to wear his own civil clothing.
(5) A soldier called for a military exercise, who wears his own orthopaedic shoes and his own civil clothing, is compensated in cash for wearing them.
Replacement and maintenance of military equipment
The military equipment referred to in Article 10 (2) (c) and orthopaedic footwear referred to in Article 12 (1) shall be changed if not suitable for further use. Maintenance shall be carried out only for military equipment referred to in § 10 (2) (b) and (c).
Provision of transport formalities
(1) The service authority shall provide for the carriage free of charge, the reimbursement of the declared expenditure in cash and the reimbursement of the necessary ancillary expenditure.
(2) Reimbursement of travel expenses for proper holidays, special holidays and medical leave is granted to a soldier for travel from his place of employment to his permanent or temporary residence in the Czech Republic and back.
Scope of transport formalities
The reimbursement of travel expenses shall be at the rate of travel expenses for the second class of passenger train or bus. When using a private road motor vehicle, reimbursement of travel expenses equal to the ticket price shall be paid to the soldier.
How to accommodate soldiers
(1) The soldier shall be provided with accommodation from the date of entry into service of the military until the day of release from the services. 2)
(2) Soldiers are normally accommodated in military accommodation facilities. Petty officers are accommodated separately from the team. The masters, officers, officers and generals in reserve called for military training are accommodated separately from the men and petty officers.
(3) Soldiers stay in separate premises or separate spaces or outside military accommodation.
Efficacy
This Decree shall take effect on 1 December 1999.
