of 26 June 1990
on catering in social care facilities
The Ministry of Health and Social Affairs of the Czech Republic provides, in agreement with the Federal Ministry of Labour and Social Affairs and participating central bodies, pursuant to § 177 (4) of Act No. 100 / 1988 Coll., on Social Security, as amended by Act No. 110 / 1990 Coll., and under § 58 (d), (f) and (h) of the Czech National Council Act No. 114 / 1988 Coll., on the jurisdiction of the Czech Socialist Republic institutions in social security:
GENERAL PROVISIONS
Subject matter
This decree regulates the conditions for catering in social welfare establishments (1) (hereinafter referred to as "facilities'), for the joint catering of elderly and severely disabled citizens provided by such facilities, (2) for the catering of recipients of certain other welfare services (hereinafter referred to as" catering ') and sets the level of remuneration for the food provided.
Boarders
Meals are provided
(a) to the dependants and residents of social welfare institutions,
(b) old citizens,
(c) severely disabled citizens,
(d) children present at the childcare centre;
(e) participants in recreational training camps and social health and other courses;
(f) civil servants, 4)
(g) voluntary care workers;
(h) workers of equipment according to a special regulation, 14)
(i) with the agreement of the head of the establishment to other citizens.
(1) All-day meals are breakfast, lunch, dinner and two side meals; for diet diabetic, protein and nutritious breakfast, lunch, dinner and three side dishes.
(2) Diet diet may be provided on the advice of the physician concerned; The diet may be provided to the diners referred to in § 2 (h) and (i) provided that the type of diet in the establishment is regularly prepared.
(3) The method of reporting and checking-out a diet is laid down by the head of the establishment.
Meal units
Meals shall be provided in accordance with the principles of good nutrition, taking into account age, the state of health of the boarders and according to food units. A catering unit means the financial standard of the average cost of food per day of accommodation in an all-day dining establishment; in an establishment where all-day meals are not provided, the catering unit means the daily financial standard of the average cost of food per main meal (breakfast, lunch, dinner) or, where applicable, one side meal.
Food costs
Compliance with the average cost of food shall be monitored at least once a month by comparing the value of the food actually consumed with the costs calculated on the basis of the actual number of diners for the reference period and the food unit. Any differences shall be accounted for on 31 December of the calendar year in accordance with a special rule. 15)
(1) Meals are provided by the preparation of a diet in an establishment, by taking a diet from another establishment or, where appropriate, by a diet from other organisations.
(2) The removal of food from social care institutions (hereinafter referred to as "the Institute") 5) to another establishment, or even to the households of the boarders referred to in § 2 (b), (c) and (i), may be negotiated only if sufficient capacity and facilities are provided for in the catering operations of the institutes and if this does not degrade the level of catering of the trustees and residents of the institutes.
(3) Food collection from other organisations to the establishment must be agreed in writing. In particular, the specific conditions for diets and the level of remuneration shall be agreed in the agreement.
STATUS IN SINGLE SPECIES OF EQUIPMENT
STATUS IN CONTRACTS
In institutions5) Except for pensioners' homes, all-day meals are provided as part of the comprehensive care according to the catering units referred to in § 8; in institutes with daily stay, lunch and two side meals are provided.
(1) The food units are:
(a) in institutions for disabled young people, in institutes for disabled young people with associated mental disabilities, in institutes for disabled young people with multiple defects, in institutes for mentally disabled young people and in separate departments (institutes) for weekly stays 16) in disabled young people, in bodies for disabled young people with associated mental disabilities, in bodies for disabled young people with multiple defects or mentally disabled youth

(b) in separate departments (institutes) for the daily residence of disabled young people, disabled young people with associated mental disabilities, disabled young people with multiple defects, mentally disabled young people and young people arriving in institutions for disabled young people

(c) in the homes of pensioners and in other institutions for adult citizens, including those for weekly stays (16)

(d) in separate departments (institutes) for the daily stay of adult citizens

(2) Within the limits laid down in paragraph 1, the level of the food unit shall be determined by the competent social security body administered by the Institute.
(3) Where the Institute provides catering by means of a diet collection from other organisations, the competent social security body administered by the Institute shall, on a proposal from the Institute or the District Institute of Social Services of the Food Unit, by way of derogation.
(4) Food costs are further increased by 100 CZK per person per calendar year to improve the diet at the holidays.
(5) When eating in recovery camps, recreational stays, tours and sports games, the competent social security body administered by the Institute may set up a catering unit up to a maximum of 52 Ccs; This amount may be increased by 20 ccs when taking a diet from other organisations.
Reimbursement for food
(1) Residents and trustees of the Institute shall bear the cost of food in payment for constitutional welfare under a special provision. 6)
(2) Old citizens, severely disabled citizens and care-care workers provided by the institutions shall pay for the diet of the amounts corresponding to the purchase price of raw materials plus material and personnel costs (hereinafter referred to as "overhead") related to the preparation of a diet of 35% of the cost of raw materials. the amount of the overhead shall be rounded to ten. The purchase price of raw materials is the cost of food consumed for food preparation, including losses resulting from natural loss of raw materials.
(3) A diet of normal and diet counts for 15% breakfast, 35% lunch, 30% dinner and 10% daily meal unit for one side meal. For a diet of diabetic, protein and nutrition, breakfast is 14%, lunch is 32%, dinner is 27%, and one side dish is 9% of the entire daily dining unit.
(4) The diners referred to in Article 2 (i) shall pay for the diet the amounts determined in accordance with paragraphs 2 and 3; this payment may be increased by a premium of up to 20% of the purchase price of raw materials.
(5) For disabled sports games, recovery camps, recreational stays and tours, accompanying workers shall be provided with free meals at the same value as participants in disabled sports games, recovery camps and recreational stays, unless they are provided for a given day in accordance with the rules on travel expenses compensation. 7)
MAINTENANCE IN HOME-PENZIONS FOR PENSIONS, PERSONAL CITIZENS WITH OWN CUCHES FOR PENSIONS AND STATIC BALANCE SERVICES FOR CHILDREN
(1) Meals in pensioners' homes (hereinafter referred to as "pension") are a service provided according to the possibility of this institution and the requirements of the population. 11) Residents of the guesthouse can be provided with all-day meals or individual meals or side dishes.
(2) Lunch is provided in separate dining rooms with their own kitchen for pensioners (hereinafter referred to as "dining hall").
(3) All-day meals are provided at the childcare centres (hereinafter referred to as "the station").
(1) The catering unit for residents of the pension is determined by the competent social security body administered by the pension, after consultation with the population, based on the catering units established for residents of the institutions [Paragraph 8 (1) (a)].
(2) The catering unit for pensioners in the dining room and the children present at the station shall be determined by the competent social security body which manages these establishments; it can be based on 35% of the value of the food unit established for the population of the institutions [§ 8 (1) (c)], if it is the dining room, and the food unit established for the trustees of the institutes [§ 8 (1) (a)], if it is the station.
Reimbursement for food
(1) Residents of pension homes, old citizens, people with a hard disability and volunteer care services provided from the pension or dining room shall pay the amounts determined in accordance with Article 9 (2) and (3) for the diet.
(2) The parents of children present at the station or of other persons responsible for their upbringing shall pay the amounts determined in accordance with Article 9 (2) and (3) for the diet.
(3) The diners referred to in § 2 (i) shall pay the amounts determined in accordance with § 9 (2) and (3) for the board, cafeteria or station; this payment may be increased by a premium of up to 20% of the cost of raw materials.
STATUS IN RECRACY OF EASTERN TABORES AND SOCIAL HEALTH AND OTHER KURSKS
(1) When eating in recreational training camps and social health and other courses (hereinafter referred to as "the course '), the catering unit shall be determined by the competent social security body, which shall be organised by the course (hereinafter referred to as" the organiser') up to a maximum of 52 CZK at all-day meals.
(2) If the organiser provides catering by means of imports from other organisations or from other organisations, he may increase the catering unit by up to another 20 CZK.
(3) The course participants are provided free of charge; The staff of the organiser shall be provided with meals under the conditions laid down in Section 9 (5). If the organiser's staff is not provided with a free meal, they shall pay the payment for the diet in the amounts laid down in Article 9 (2) and (3).
COMMON AND FINAL PROVISIONS
(1) If catering is provided by food collection from other organisations, the diners pay the amounts agreed in the agreement for the diet (Section 6 (3)).
(2) The competent social security authority may reimburse the establishment or other organisation in which the catering of elderly and severely disabled citizens is provided, from its budget directed at up to 35% of the purchase price of raw materials.
(3) The level of the food unit of a civilian serving citizen is laid down in a separate regulation. 17)
The social needs of the elderly and those with a severe disability may be granted a common meal allowance under a special rule. 14)

Efficacy
This Decree shall take effect on 1 July 1990.
