amending Act No. 48 / 1997 Coll., on Public Health Insurance and amending and supplementing certain related laws, as amended
Parliament has decided on this law of the Czech Republic:

1. in Article 16a (2), the words "or located in homes for persons with disabilities 27h" shall be added at the end of the text of point (a);
Footnote 27h reads:
"27h) § 48 of Act No. 108 / 2006 Coll. '.
2. in Article 16a (2), at the end of the text of point (b), the words "or, for reasons laid down by special law, 27i) without his consent, in the case of the admissibility of the taking over and further holding of the insured person in constitutional custody, the agreement of the judge (j) shall be added."
footnotes 27i and 27j are as follows:
"27i) § 24 of Act No. 20 / 1966 Coll., as amended.
27j) Sections 191a to 191g of Act No. 99 / 1963 Coll., Civil Code, as amended. '
3. in Article 16a (2), at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) in assessing the medical fitness of the insured person for the collection of tissues and organs, in the collection of tissues and organs and in the dispensary care of the insured person after the collection of tissues and organs under the Transplant Act 27k."
Footnote 27k reads:
"27k) Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organ and on the Amendment of Certain Laws (Transplant Act), as amended. '.
4. in Paragraph 16a, the following paragraph 4 is inserted after paragraph 3:
"(4) The regulatory fee referred to in paragraph 1 (f) shall not apply in the case of constitutional care of a born child, from the date of birth to the date of release from the hospital where the birth took place or until the date of release from another hospital of constitutional care to which the child was transported for medical reasons immediately after birth. ';
Paragraphs 4 to 8 shall be renumbered paragraphs 5 to 9.
5. In Article 16a, paragraphs 10 and 11 are added:
"(10) The health care establishment may not levy regulatory fees in connection with the provision of paid care, which under this law is not subject to regulatory fees. In the event of a repeated infringement of this law, the health insurance company is entitled to impose a fine of up to CZK 50 000 on this medical establishment.
(11) Repeated grant of a fine to a healthcare establishment pursuant to paragraph 10 shall give rise to the termination of the contract for the provision and reimbursement of health care without notice in accordance with Article 17 (3). '
6. in Article 16b (2), "Article 16a (6) and (7)" is replaced by "Article 16a (7) and (8)";
This Act shall take effect on the day of its publication.
