Government Regulation
of 8 July 1952
on the organisation of customs administration.
The Government of the Czechoslovak Republic orders, with the consent of the President of the Republic pursuant to § 1 of the Constitutional Act No. 47 / 1950 Coll., on adaptations in the organisation of public administration:
The planned development of the economy, in particular the interest in the implementation of the foreign trade plan, requires that customs duties, in particular the control of the circulation of goods in contact with a foreign country, be provided in the field of the Ministry of Foreign Trade, by special authorities.
The Ministry of Foreign Trade shall exercise its competence in customs matters through the Central Customs Administration and its subordinate bodies.
(1) The Central Customs Administration is established in the Ministry of Foreign Trade as a special component.
(2) The Central Customs Administration performs the current tasks of the Ministry of Finance and the Regional National Committees on Customs matters and the current tasks of the Ministry of Finance pursuant to Section 14 of Act No. 92 / 1946 Coll., on Bound Foreign Exchange Economy (Foreign Exchange Act).
(1) The central customs administration is subordinate to customs.
(2) Customs shall carry out the tasks of the Regional National Committees in customs matters.
(3) Customs and their divergences are established or abolished and their responsibilities are further defined by the Minister for Foreign Trade in agreement with the participating members of the Government.
(1) The personal office of customs staff is the Ministry of Foreign Trade.
(2) The Ministry of Foreign Trade shall take over, in agreement with the relevant ministries, the current staff of the Ministry of Finance and the national committees working on the matters referred to in Sections 3 (2) and 4 (2).
Customs staff shall be required to wear uniform in the performance of their duties. The Foreign Trade Minister shall provide details in agreement with the participating members of the Government.
(1) The customs duties and levies levied shall be charged in 1952 in the current manner.
(2) In order to waive the customs claim or to compensate for the loss of benefits by the central customs administration, the approval of the Ministry of Finance shall be required if the amount to be waived exceeds, on a case-by-case basis, 500,000 CZK.
The material equipment of the Ministry of Finance as a customs authority goes into the use of the Central Customs Administration, the material equipment of the Regional and District National Committees as customs authorities goes into the use of customs.
All provisions shall be repealed if they are contrary to this Regulation.
The measures taken to implement this Regulation before it is effective shall be deemed to be measures under this Regulation.
This Regulation shall enter into force on 1 August 1952; they shall be carried out by the Foreign Trade Minister in agreement with the Finance and Interior Ministers.
