GOVERNMENT REGULATION
of 24 May 2006
amending Government Regulation No 225 / 2004 Coll., on certain details of the implementation of selected market measures of the common organisation of the market in milk and milk products, as amended by Government Regulation No 120 / 2005 Coll.
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No. 225 / 2004 Coll., on certain details of the implementation of selected market measures of the common organisation of the market in milk and milk products, as amended by Government Regulation No. 120 / 2005 Coll., is amended as follows:
1. Paragraph 6a, including the title and footnotes Nos 11a to 11e, reads:
Aid for the use of skimmed milk and skimmed-milk powder used as feed
(1) Applications (a) to grant aid for the use of skimmed milk or skimmed-milk powder, where appropriate, incorporated in a compound feedingstuff or used for denaturing, shall be submitted by the approved producer of compound feedingstuffs or denatured skimmed-milk powder Fondu11b on the form issued by it without delay during the preceding calendar months11c).
(2) The application for aid for the use of skimmed-milk powder bought in for the sale of skimmed-milk powder from public storage (11d) incorporated in a compound feedingstuffs or used for denaturing shall be submitted by the natural or legal person participating in the partial tendering procedure (11e) Fondu11b) on the form issued by it immediately for the preceding calendar months11c).
(3) The payment of aid for skimmed milk and skimmed-milk powder processed into compound feedingstuffs or used for denaturing shall be made by the Fund no later than 90 days from the date of receipt of the impeccable application for such support (11c).

2. The following Section 7c is inserted after Section 7b, including the title and footnotes 14a to 14f:
Use of casein and caseinates in cheese production
(1) The application for authorisation of the use of casein14a or caseinates 14a) in the manufacture of selected cheeses 14b) for a period of 12 months (hereinafter referred to as "the application for authorisation") shall be submitted by a natural or legal person to the Fund on the form issued by it, in accordance with the conditions laid down by the European Communities 14c); an application for authorisation shall be submitted for each establishment separately. The application for authorisation shall include:
(a) a document certifying that a natural or legal person is an entrepreneur under a special legislature5);
(b) the applicant's declaration concerning compliance with the percentages of 14b) casein14a) and 14a) in the production of selected cheeses 14b);
(c) the declaration by the applicant to report and keep a register in accordance with European Community14d);
(d) the declaration by the applicant to bear the costs of the collection and laboratory analysis in the framework of the control carried out by the Fund;
(e) the applicant's declaration that the cheese with the addition of casein14a and caseinates 14a) will be used as a technologically necessary ingredient 14e) other food 14f);
(f) a dossier in which the applicant indicates the origin, composition and quantity of raw materials 14d) used in the manufacture of selected cheeses 14b), justifying the technological necessity of processing casein14a) and casein14a); and
(g) a declaration by the applicant to indicate on the packaging of the product the content of added casein14a) and caseinates 14a) in percentage and country of origin. The addition of casein14a) and casein14a) in the manufacturer's cheese shall be appropriately notified to the cheese customers.
(2) An overview of natural and legal persons authorised to use casein14a and caseinates 14a) in the production of selected cheeses 14b) for a period of 12 months will be published by the Fund in a single national diary and in a way that allows remote access. This summary shall be kept up to date by the Fund.
(3) The Fund shall withdraw an authorisation issued following an application for authorisation pursuant to paragraph 1 in cases of breach of the applicant's declaration or at the end of the applicant's activity.

Efficacy
This Regulation shall enter into force on 15 June 2006.
