on the scope, amount and manner of provision of natural and financial formalities for non-military secondary school pupils who are not in active service and who are continuously preparing to serve as an occupational soldier
According to Section 166 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
§ 1
Natural essentials
Natural essentials are provided in the form of provision, equipment, transport and accommodation.
§ 2
Provision of provisions
(1) Proper formalities are intended for meals in kind, foodstuffs and material products.
(2) In nature, eating means eating, breakfast, lunch and dinner. Food is made up
(a) hot food; or
(b) cold meals; or
(c) food for the separate or group preparation of food.
(3) If food or food cannot be provided in accordance with paragraph 2, it shall be paid in cash. Refund in money for food or food is the final value of the species and quantities of each food corresponding to the diet.
(4) Material means means a dining cutlery with a cover and can opener which are given to a student of a military secondary school ("the pupil ') on the date of entry into a military secondary school (" the school').
§ 3
Natural catering
(1) Natural meals shall be provided to the student from the day of taking up school until the day of completion of his studies or the day of employment to the service of the professional soldier, except for:
(a) stay in the hospital;
(b) links,
(c) maternity leave;
(d) absence from school.
(2) The period of absence at school is for the purposes of this decree the period of school holidays, study leave, family visits and treatment at the place of permanent residence. The time of absence is not the day of leaving school.
Food intake for pupils and food supplements
§ 4
Food and food must correspond to the diet levy for the pupil and the addition of food, their energy standards and nutritional values set out in Annex 1 to this Decree and the average composition of food consumption set out in Annex 2 to this Decree.
§ 5
(1) The student shall receive a subsistence allowance throughout the course of his studies until the date on which the basic or alternative military service takes place. 1)
(2) If the pupil is in practical training with a military department, military establishment or a military rescue department (hereinafter referred to as the "military department '), he shall be provided with a diet dose to be prepared with the military department.
(3) A health supplement is provided for the student's diet. Food addition A is issued to a pupil in the care of the berth of a crew or other health care facility on an equal footing, or if required by the health situation in a school or military unit, particularly in the threat of epidemics or bad drinking water.
§ 6
Money compensation and cash compensation supplement
(1) Money compensation is paid for individual meals to be delivered at the level of their financial value.
(2) A supplement to the refund in money shall be paid to the pupil together with the refund in money if he participates in a sporting or mass cultural event organised by the school and if he is not able to eat in school or in a military unit.
(3) The amount of the supplement to the refund in cash is equal to the lowest amount of the diet under the special legislation. 2) Of this amount, it is paid to be replaced in cash for breakfast 20%, for lunch 40% and for dinner 40%.
Energy, nutrition and financial value of the diet for pupils and food supplements
§ 7
(1) The financial value of the food levy for the pupil and the food supplement is determined by multiplying the average consumption of each food in kilograms per person per day in accordance with Annex 2 to this Decree by their average commercial prices per kilogram. The average commercial price shall be the average price per kilogram of each type of food purchased for the last 3 months.
(2) The financial value of the food levy for the pupil and the food supplement is adjusted depending on the development of commercial food prices. The adjustment shall be made if the total difference in the average trade prices of all types of food purchased over the last 3 months is more than or less than 5% compared to the trade prices during the period in which the adjustment was last made.
(3) The financial value of the dietary levy for the pupil and the food supplement shall be adjusted not earlier than the first day of the month following the finding of the difference referred to in paragraph 2.
§ 8
(1) The financial value of the diet is increased by 10% on the days of food preparation in groups of up to 25 people to a student studying in the field of provision. The financial value of the subsistence allowance for a military school affected by disasters or other serious situations threatening life, health or the environment may be increased by up to 20%.
(2) The energy and nutritional value of the dietary levy for the pupil and the addition of food, as well as their financial value, may not be exhausted on a monthly basis. However, the monthly mean of the draw must correspond to the values set for the diet for the pupil in the range of 5% to 5% below the specified values. The annual mean of drawing shall not exceed 10% to 3% below the specified values.
§ 9
Provision of equipment
(1) The equipment is provided by the supply of military equipment and by providing free service for its repair and maintenance. Free services are laundry, dry cleaning, treatment, repair and maintenance of equipment components (hereinafter referred to as "maintenance ') and hair treatment.
(2) Device components are provided to the pupil
(a) owned;
(b) entrusted for use which, after the cessation of entitlement to equipment, is transferred to the possession of the pupil;
(c) entrusted for use which, after the cessation of entitlement to equipment, does not go into the possession of the pupil;
(d) of a consumer character.
(3) Money compensation is granted for the acquisition and addition of military equipment which cannot be issued.
(4) The training requirements shall be granted to the pupil from the date of taking up the school until the date of completion of the study or the date of the initial or replacement military service. 1) Engineering components issued prior to the performance of essential or alternative military services pursuant to Article 9 (2) (a) and (b) shall no longer be issued to it.
§ 10
Provision of military equipment
(1) Basic military equipment is provided to the pupil. Personal protective equipment and other equipment may be provided to the pupil for the performance of his studies. The pupil is also given ownership of a military equipment of a personal character.
(2) For military equipment which is not secured at the cost of the State, the pupil shall be compensated in cash for his acquisition or replenishment. The amount of compensation in cash for the acquisition or addition of military equipment shall be determined according to the level of retail prices.
(3) When a pupil is transferred to another school, he is left with the basic military equipment for pupils only with the military equipment provided for in § 9 (2) (a) and (b).
§ 11
Military equipment at funeral
If a student dies, he sets out to bury a suit for a student with no shoes and a laundry kit.
§ 12
Orthopaedic footwear and oversized military equipment
(1) Orthopaedic footwear is provided on the basis of a voucher prescribed by the doctor to the pupil instead of shoes which would otherwise belong to him. After completion of the study or after the expiry of the life of the footwear, orthopaedic shoes are left to the pupil.
(2) Excessive size of military equipment is provided by a special order for pupils.
§ 13
Replacement and maintenance of military equipment
The military equipment referred to in Paragraph 9 (2) (c) shall be rotated as necessary. The replacement of orthopaedic shoes shall be carried out in the same way as for footwear which would otherwise belong to the pupil. Maintenance shall be carried out only for equipment referred to in Article 9 (2) (b) and (c).
§ 14
Provision of free transport and reimbursement of travel expenses in cash
(1) Free transport ("transport") is provided by the service authority.3)
(2) Where the transport is not secured in accordance with paragraph 1, compensation shall be granted for the proven cost of the journey in cash (hereinafter referred to as "compensation for the journey ').
§ 15
Transport for school holidays
(1) Reimbursement of travel expenses for school vacations4) is granted to the student for travelling from the school to a place of permanent or temporary residence in the Czech Republic or to a border crossing station or road crossing point or to a place of departure of the aircraft and back.
(2) When driving by train, the pupil shall be entitled to reimbursement of travel expenses for the second carriage class of the passenger train or to reimbursement of travel expenses for the bus.
§ 16
Transport to medical facilities
(1) The reimbursement of travel expenses to a medical institution designated by the treating physician for treatment, examination or hospitalisation, which are in the interest of preparing for a future occupation, is granted to the pupil for a journey from the school to the place of the medical establishment and back.
(2) When driving by train, the student shall be entitled to reimbursement of travel expenses for the second carriage class of the passenger train, at a distance of at least 101 km in one direction for the first carriage class or to reimbursement of bus travel expenses.
§ 17
Method of accommodation student
(1) The student is granted accommodation in military boarding schools. The accommodation shall be provided free of charge except for the cost of electricity consumed for the use of electrical appliances. If it is not possible to provide accommodation in a military boarding house, it will be provided in another military facility or another operator's accommodation.
(2) The accommodation referred to in paragraph 1 shall be granted from the date of taking up the school throughout the course of the studies, including the period of experience with the military service, except for:
(a) stays and trips outside the school place;
(b) study leave;
(c) holidays and school holidays.
(3) Free accommodation can also be provided to a student who is resident in a school-based or a place that allows daily commute.
§ 18
Pocket
(1) A student shall be granted a monthly allowance of 60% of the private service provided for by a special legislature5) from the date of taking up school throughout the course of his studies, except for:
(a) the performance of the essential or substitute service for which it is entitled to cash requirements under a specific legislation;
(b) links,
(c) maternity leave.
(2) The school director will increase the student's allowance based on study results
(a) up to 80% of a serving private if he has achieved an overall assessment of "he has benefited very well,"
(b) up to 100% of a serving private if he has achieved an overall assessment of "served with distinction."
(3) The increased allowance referred to in paragraph 2 shall be granted on 1 February and 1 September of the calendar year and shall be rounded up to the nearest ten crowns.
§ 19
Efficacy
This Decree shall take effect on 1 December 1999.
